Officers told to get director's approval before sending summons to lawyers: ED
NEW DELHI: The Enforcement Directorate (ED) on Friday said it has directed its investigating officers not to issue summons to any advocate in violation of the protection extended to advocate-client privileges under Section 132 of the Bhartiya Sakshya Adhiniyam (BNS) and stipulated that summons could only be issued to lawyers under the exceptions provided in the law after the director's approval. The circular to the federal agency's field formations came hours after ED withdrew the summons issued to two senior lawyers, Arvind Datar and Pratap Venugopal, after the Supreme Court Advocates on Record Association (SCAORA) asked Chief Justice of India Bhushan R Gavai to take up the case.
Section 132 of BNS protects the advocate-client privilege and bars lawyers from disclosing communications between them and their clients. However, the section provides for three exceptions when this protection from disclosure shall not apply.
In a statement, ED said Friday's circular was issued for guidance of field formations on Section 132 of BNS. 'Further if any summons needs to be issued under the exceptions carved out in proviso to Section 132 of the BSA, 2023, the same shall be issued only with the prior approval of the Director, ED,' the agency statement said.
The agency also clarified that the summons were issued to Venugopal in his capacity as independent director of Care Health Insurance Ltd (CHIL), and not as a lawyer.
'In view of the fact that Pratap Venugopal is a Senior Advocate in the Supreme Court, the summons issued to him has been withdrawn and same has been communicated to him,' ED said.
'In the said communication, it has also been stated that if any documents will be required from him in his capacity as an independent director of CHIL, the same will be requested from him to be submitted by email,' the agency said.
The financial crimes probe agency is looking into money laundering allegations in connection with a case in which shares of Care Health Insurance Ltd (CHIL) were issued at a much lower price in the form of ESOPs on May 1, 2022, despite the rejection of the same by Insurance Regulatory and Development Authority of India (IRDAI).

IIT Madras Intern Sexually Harassed By Food Court Staff
Chennai: A 22-year-old man has been arrested allegedly for sexually harassing an intern at the IITM (Madras), police said on Saturday. The arrested was working at a food court inside the institute and he allegedly sexually harassed a 20-year-old intern on the campus on June 25 night, police said. Taking suo moto cognizance of the offence, the National Commission for Women chairperson Vijaya Rahatkar wrote to Tamil Nadu DGP calling for a fair and time-bound investigation under relevant provisions of BNS, 2023. 'NCW has also directed the authorities to ensure the victim receives immediate medical and psychological support,' the Commission said in a post on the social media platform X on Saturday. The incident occurred around 7.30 pm when the woman intern was walking alone in the campus. According to Kotturpuram police, the man who held a stick went close to her and pulled her hair. Immediately, the intern raised an alarm. The security personnel on the campus rushed to her rescue. The police later identified the suspect as one Roshan Kumar, a native of Maharashtra, who was working at a food court in IIT (M). He was arrested and remanded on June 26. Further investigation is on. Meanwhile, responding to the incident, the IIT (M) stated that an unfortunate incident took place at the IIT Madras campus on June 25, when a contractual employee of a vendor operating on the campus "misbehaved" with a woman student, visiting from other institute. 'The girl raised an alarm and the culprit was held by the institute security and handed over to the local police. IIT (M) has a zero tolerance policy towards sexual harassment and we are committed to provide a safe and secure campus to all,' the institute said in a statement.

Bengaluru 2 am heist: Thieves thought they hit jackpot after truck carrying Rs 15 lakh Hayabusa took wrong turn, but their plan crashed
In Bengaluru, thieves targeted a truck transporting high-end Suzuki Hayabusa motorcycles. While they failed to steal a complete bike, they made off with parts, damaging one Hayabusa in the process. Although they failed to steal the superbike itself, they managed to escape with several parts, the driver's phone, and to a TOI report, Nanda Lal, 45, from Dungarpur in Rajasthan, was driving a truck loaded with Suzuki Hayabusa bikes from Haryana. The delivery was meant for two Bengaluru-based dealers, Apple Auto Agency in Banashankari and Aryan Auto Agency in successfully dropped off some bikes at Apple Auto on June 22. But while heading to Bidarahalli later that night, he lost his way near East Point Hospital in Virgonagar. At around 2am, with hardly anyone on the road, he parked the truck by the roadside and walked into the hospital to ask for directions, leaving the keys in the when the thieves struck.
