Kerala HC dismisses petition filed by teacher charged under POCSO Act
The petitioner who was an Arabic teacher at a school in Malappuram and was placed under suspension following the registration of the FIR over a year ago, approached the court, seeking that a departmental inquiry report and the consequential proceedings following the incident be set aside. Among other reasons, he said that he had been acquitted in the criminal trial, after the survivor and her mother 'turned hostile'.
'Benefit of doubt'
Referring to the ancient education system in India where teachers were known as 'rishis', and the 'rishi ashram' was a veritable 'gurukul' where students were loved and cared for as members of the guru's family, the Bench of Justice D.K. Singh said the petitioner was acquitted in the criminal case on the benefit of doubt. Even if a person is acquitted in a criminal trial, the same would not necessarily lead to discharge in a domestic inquiry. Being her teacher, the petitioner had a fiduciary relationship with the survivor. The crime is grossly unbecoming of a schooteacher.
The petitioner teacher was accused of sexually assaulting the student since January 2023 while she was reading standing near the petitioner in the classroom. The Wandoor police filed an FIR in 2024, under provisions of the POCSO Act and the IPC after being alerted by the headmaster. The child had told her mother about the assault and she informed the headmaster.

Lucknow: A Special Court (PMLA) in Lucknow has convicted three individuals — Saurabh Sahu, Ashwani Kumar, and Mamta Sinha — in a money laundering case filed by the Enforcement Directorate (ED). They were sentenced to imprisonment for three years along with a fine of Rs 50,000 for each accused. The ED initiated an investigation based on an FIR registered by CBI, SPE, ACB, Lucknow, UP against Amar Nath Sahu and others for violation of sections 120B, 420, 467, 468, and 471 of IPC, 1860, and 13(2) read with 13(1)(d) of the PC Act, 1988. In the FIR, it was alleged that Amar Nath Sahu and other accused caused a loss of approximately Rs 3.20 crore to the then Allahabad Bank, Jankipuram branch, Lucknow, during 2004-2006 by sanctioning and disbursing loans in connivance with borrowers. The ED investigation resulted in the attachment of proceeds of crime (POC) amounting to Rs 16,42,248 in the form of two immovable properties. The Special Court (PMLA) in Lucknow delivered its verdict on June 30TNN, convicting Saurabh Sahu, Ashwani Kumar and Mamta Sinha for money laundering in a case filed by the Enforcement Directorate's Lucknow Zonal Office in 2017. The trial against co-accused Amar Nath Sahu was abated due to his death. The court found the remaining three accused guilty under Section 3 of the Prevention of Money Laundering Act (PMLA), 2002. The court also ordered the confiscation of two attached immovable properties, ruling that they were involved in money laundering.

Gujarat HC grants Asaram Bapu his ‘final' bail extension
The Gujarat High Court extended convicted self-styled godman Asaram Bapu's temporary medical bail by one month on Thursday while explicitly stating this would be the final extension. The 86-year-old is currently serving a life term for raping a woman disciple from Surat at his Ahmedabad ashram between 2001-2006. The Division Bench of Justices Ilesh Vora and PM Raval rejected Asaram's lawyer's request for a three-month extension, granting only 30 additional days. This follows the court's previous interim extension from June 30 to July 7. Asaram had originally been granted three months' bail in March. The controversial spiritual leader was convicted in January 2023 under multiple IPC sections including 376(2)(C) for rape, 377 for unnatural offenses, and 354 for assault with intent to outrage modesty. He is simultaneously serving a separate life sentence for the 2013 rape of a minor at his Rajasthan ashram. The current bail extension stems from the Supreme Court's March directive permitting temporary medical release, with instructions to seek any further extensions from the Gujarat High Court.

Schoolteacher arrested for sexually assaulting 16-year-old boy sent to judicial custody
The 40-year-old woman teacher of a prominent city school, who has been arrested for allegedly sexually assaulting a Class 12 boy, was on Thursday sent to judicial custody. On Thursday, the teacher, who was in police custody since Saturday, underwent a psychiatric test at a government hospital. Later, police produced her in court, which remanded her in judicial custody. The police sought extension of her custody, but as the investigation officer could not provide reasonable grounds, the court remanded the teacher in judicial custody till July 16. Sources said the police will soon take court permission for recording the boy's statement before a magistrate, a mandatory procedure in Protection of Children from Sexual Offences (POCSO) Act cases. As part of the investigation, the police are also examining the mobile phone of the teacher and her conversations with the boy. The alleged sexual assault came to light when the 16-year-old boy's parents observed changes in his behaviour and encouraged him to open up. According to police sources, the accused is an English teacher. She is married and has two children. Police said the woman tried to get close to the boy sometime in December 2023. She then allegedly took the help of a friend who contacted the boy on her behalf. The teacher allegedly took him in her car to an isolated place and sexually assaulted him, police said, adding that she also allegedly took the boy to five-star hotels in south Mumbai and the western suburbs, where she made him consume alcohol before sexually assaulting him. After the boy revealed it to his parents, they decided against taking any major action as he was about to leave the school after the board exams. However, the boy slipped into depression after clearing the exams and leaving school. The parents approached the police when they found that the accused was trying to contact him again, a source said. The police registered an FIR against the teacher and arrested her on Saturday under relevant sections of the Bharatiya Nyaya Sanhita BNS), the POCSO Act and the Juvenile Justice Act.
