
Convicted for pointing gun at SDM, Rajasthan BJP MLA Kanwarlal Meena disqualified from Assembly
The Assembly has issued an official notification confirming the termination.
Rajasthan Assembly Speaker Vasudev Devnani announced on Friday that MLA from Anta constituency, Kanwarlal, has been disqualified from the Rajasthan Legislative Assembly following his conviction in a court of law. The disqualification is in accordance with Article 191(1)(e) of the Indian Constitution and Section 8(3) of the Representation of the People Act, 1951. Devnani stated that the disqualification took effect from the date of conviction, and consequently, the Anta (193) Assembly seat in District Baran has been declared vacant. The Speaker clarified that the decision was made after receiving legal advice from the Advocate General of Rajasthan.
"I do not work under any kind of pressure," he emphasised. "All decisions are made strictly in accordance with the law and only after a thorough examination of all aspects." He further stated that precedent exists for such matters, noting that previous Speakers have also taken time to study and act on similar cases. Devnani cautioned against politicising the issue, underlining that the matter is purely legal in nature.
He explained that the Advocate General was asked to provide legal counsel on the day of the court's verdict regarding MLA Kanwarlal. According to established legal provisions, an MLA stands disqualified from the date of conviction, and the notification of the seat's vacancy is formally issued by the Legislative Assembly. He also referenced Article 177 of the Constitution, stating that the Advocate General has the constitutional authority to participate in the proceedings of the Legislative Assembly and offer legal opinions when required. Earlier, the Assembly Secretariat had issued a notice to Kanwarlal, requiring him to respond by May 7.
He was asked to clarify whether he had received any relief from the Supreme Court to stay his sentence. As the Supreme Court did not suspend the conviction or sentence, the Speaker was left with no option but to revoke his membership.
Meanwhile, Leader of Opposition in the Rajasthan Legislative Assembly, Tikaram Julie, has welcomed the disqualification of convicted MLA Kanwarlal Meena as a 'victory of justice, truth, and the Constitution.' He termed the action taken by the Assembly Speaker as a result of the Congress Party's continued struggle to uphold constitutional values.
'Satyameva Jayate—truth has prevailed. This is the triumph of the Congress Party's movement to save the Constitution,' Julie said.
He credited the success to the vision and resolve of national leaders Rahul Gandhi and Mallikarjun Kharge, stating that the Congress remained firm in its stand and fought relentlessly to defend constitutional values.
Julie called the development a key milestone in the Congress Party's 'Save Constitution' campaign, emphasising that their struggle was rooted in the rule of law and democratic principles. 'Our movement followed the path shown by our leaders, and in the end, the Constitution prevailed. Its dignity has been preserved,' he stated.

Madurai: on Monday ordered a limited interim injunction restraining from sending OTP verification messages during the party's enrolment drive 'Oraniyil Tamil Nadu'. Tired of too many ads? go ad free now A division bench of Justice S M Subramaniam and Justice A D Maria Clete, passed the interim orders on a PIL pertaining to DMK's 'Oraniyil Tamil Nadu', which is a mass membership drive organised across the state by DMK. "Digital membership drives conducted by the political parties in recent times are a new area of study, whereby there is a clear departure from the conventional modes of inducting party members. The bearing it has on the data privacy of the individual is a concern that has to be addressed. Hence, a clarity is required as to the means and infrastructure adopted by the political parties to collect, process and store data from the public. How this data is stored and processed and the implications on the right to privacy of the voter including the right to privacy of the political affiliation also ought to be examined," the judges observed. In the absence of accountability and transparency in the data collected from individuals across the state, it is an issue which needs elaborate analysis, the judges said. A valid and free consent is an essential part of such membership programmes organized by the political parties. Hence, no force or coercion shall be employed in such membership drives conducted by the political parties, they said. The judges then directed the DMK to provide details on the data privacy policy employed in this membership campaign and ensure the security of the data collected and whether 'informed consent' is obtained from the individuals in this membership drive. Justice Maria Clete, in a separate order, observed that when a query was put forth as to whether any mechanism or designated authority exists to address violations under the Digital Personal Data Protection Act, 2023, the Centre responded that rules have been framed under the Act and that the authority concerned is the joint secretary. However, the Centre sought time to verify and respond on the specific operational aspects and the institutional framework under the Act. The judge observed that she agreed to the interim order particularly in light of the serious concerns relating to personal data protection and digital privacy. However, she made it clear that such relief is extended with circumspection, particularly in the absence of a counter-affidavit and without full knowledge of the programme's operational framework. She also clarified that she did not agree with Justice Subramaniam's views pertaining to smaller or economically challenged political parties being put in a disadvantageous position. They are not immediately germane to the legal and factual matrix presently before the court, she said. The judges then ordered notice to the Centre, state and DMK and adjourned the hearing in the case by two weeks. The court passed the order while hearing a public interest litigation filed by S Rajkumar, a resident of T Athikarai village in Sivaganga district in Tamil Nadu.

Speaker inaugurates National e-Vidhan Application Seva Centre
Delhi Assembly Speaker Vijender Gupta on Monday inaugurated the National e-Vidhan Application (NeVA) Seva Centre at the Delhi Legislative Assembly Complex and marked the successful completion of its first phase. The Monsoon Session of the Delhi Assembly is likely to be held in the first week of August, according to Assembly sources. A Bill to regulate private school fees, which is currently in the form of an ordinance, is to be discussed and passed during the session. 'The inauguration of the NeVA Seva Centre and the successful completion of the first phase of NeVA marks a critical milestone in our commitment to a digital, transparent, and sustainable legislature. This initiative reflects our alignment with the Prime Minister's vision of 'Digital India', paperless governance, and the transformative idea of 'One Nation, One Application',' he said. Mr. Gupta said that it is unfortunate that earlier governments made no sincere efforts in this direction and with NeVA, the Assembly is now bridging that gap and paving the way for a more accountable and modern legislative ecosystem. 'The first batch of MLAs actively participated and showed keen interest in the working of the application. Each Member was provided with a smartphone preloaded with the NeVA application, allowing seamless access to the list of business, legislative questions, documents, and session updates,' as per a statement from the Assembly Secretariat. The three-day training programme, scheduled from July 21 to 23, is designed to equip MLAs with practical knowledge of the NeVA platform's tools and functionalities. The training will ensure their effective participation in the upcoming Monsoon Session by enabling a smooth transition to paperless legislative functioning.
