DEHRADUN: Uttarakhand HC has suspended the conviction and five-year rigorous imprisonment of a vaccine scientist found guilty of abetment to suicide following the death of his wife in 2015.
Justice Ravindra Maithani granted the relief to Dr Akash Yadav during the pendency of his appeal, saying his role was "undoubtedly essential for public health and national interest" and his conviction had rendered him ineligible to continue contributing to vaccine programmes.
Yadav, a vaccinologist with a PhD in biotechnology from IIT-Kgp, had been working as a senior manager at Indian Immunologicals Limited, a PSU that makes human and veterinary vaccines and plays a critical role in national immunisation efforts. tnn

Yadav was convicted by a sessions court under IPC section 306 for abetment to suicide but was acquitted under section 304-B (dowry death) and the Dowry Prohibition Act.
He married on May 7, 2015. His wife, who was employed at Pantnagar University, was taken to her maternal home by her brother on July 4, 2015, while Yadav was working in Hyderabad. She resumed her duties but died by suicide on Dec 14, 2015. In her suicide note, she stated that her husband would be responsible for her death. Yadav was arrested on May 11, 2017, and after spending more than three months in jail, he got bail on Aug 28.

On Jan 21 this year, the sessions judge of Rudrapur sentenced him to five-year RI and a fine of Rs 20,000 under Section 306.
After being granted bail, Yadav filed an interim application under section 389(1) of the Code of Criminal Procedure, seeking suspension of his conviction.
He submitted that because of the conviction, he had become disqualified from working with Indian Immunologicals Limited (IIL) and was unable to resume his scientific duties.
His counsel argued that the case met the criteria for exceptional circumstances, as the conviction had a direct impact on "work of national importance."
Justice Maithani noted that an appellate court can suspend a conviction if failure to do so would result in injustice or irreversible consequences. He cited the Supreme Court rulings in Navjot Singh Sidhu vs State of Punjab (2007) and Rama Narang vs Ramesh Narang (1995) and said that courts must examine whether maintaining the conviction would unfairly affect a person's professional standing or public interest responsibilities.
The bench observed, "This was a greater issue of public health and national interest. In light of the afore-stated reasons, the court was of the view that this was a fit case in which the order of conviction as well as execution of sentence, appealed against, should be suspended."
The high court suspended both the conviction and sentence during the appeal's pendency, allowing Yadav to resume his duties at IIL.

Man injured as iron rod from metro bridge under construction falls on autorickshaw

A 20-year-old man sustained critical head injuries on Tuesday when a long iron rod from an under-construction Metro Line 5 bridge fell on an autorickshaw he was travelling in Bhiwandi. The accident happened at around 2 pm at Vitthal Nagar, where the civil work for the Thane-Bhiwandi-Kalyan Metro line is being carried out. As per the police and onlookers, a tie rod of about 7 to 8 feet long and 20 mm in diameter came crashing down straight from the raised structure onto the passing autorickshaw. The rod came through the autorickshaw's roof and struck passenger Sonu Ali on the head. The local residents rushed Ali, who became unconscious, to a hospital where he is being treated. Bhiwandi's Bhoiwada Police are investigating the incident to determine whether negligence led to the mishap. The Mumbai Metropolitan Region Development Authority (MMRDA), the developing authority of Metro Line 5, imposed a fine Rs 50 lakh on civil contractor Afcons and Rs 5 lakh penalty on general consultant Systra-CEG-Systra India for supervisory deficiencies. Expressing regret over the incident, the MMRDA said in a statement, 'A tie rod, installed as part of the temporary support system to deck slab structure two months ago, unexpectedly fell onto an autorickshaw. A passenger suffered a head injury as a result.' 'MMRDA has ordered Afcons to cover all the medical costs and extend due support to the affected person,' an official said. The development authority has also set up an independent panel headed by the Chief Safety Manager of AICA, the overall consultant for Metro Line 2B, to probe the cause of the accident. A similar accident had happened in 2021 when five people were injured after an iron structure collapsed at Anjurphata during pillar construction for Metro Line 5.

SC cancels bail granted to DHFL promoter in loan scam case, directs him to surrender in two weeks

NEW DELHI: The Supreme Court on Tuesday cancelled bail granted to former DHFL promoter Dheeraj Wadhawan in the multi-crore bank loan scam case. A bench of Justices Sanjay Kumar and Satish Chandra Sharma passed the order after perusing the report filed by a medical board and directed Wadhawan to surrender within two weeks. The Delhi High Court on September 9, 2024 granted him bail on medical grounds saying Wadhawan fell within the parameters of a "sick person". The order came on an appeal filed by the CBI appeal against the high court order. Additional Solicitor General S V Raju, representing the agency, had earlier said said Wadhawan suffered from no serious medical ailments and huge amounts of money were siphoned off in the case. The Wadhawan brothers -- Kapil and Dheeraj-- were arrested in this case in July 2022. The agency filed a chargesheet in October 2022 following which a court took its cognisance. The FIR was registered on a complaint made by the Union Bank of India , which alleged DHFL, the housing finance company's then chairman-cum-managing director Kapil Wadhawan , then director Dheeraj Wadhawan and other accused entered into a criminal conspiracy to cheat the consortium of 17 banks led by the Union Bank of India, and in pursuance of the criminal conspiracy, the accused and others induced the consortium to sanction huge loans aggregating Rs 42,871.42 crore. Much of the amount was allegedly siphoned off and misappropriated by alleged falsification of the books of the DHFL and dishonest default in repayment of legitimate dues of the consortium banks, the CBI claimed.
