Efforts made to curb illegal loudspeakers at religious structures: HC; no contempt action on govt

Mumbai, Jul 8 (PTI) The Bombay High Court on Tuesday said the Maharashtra government has made substantial and earnest efforts against illegal loudspeakers at religious structures and hence, there was no need to initiate any contempt action.
Out of these, 343 were removed and 831 loudspeakers were given license and permission. Notices were issued to 767 structures warning them to not exceed the noise decibel limits and FIRs were lodged in 19 cases.
Government pleader Neha Bhide told the court that a nodal officer of the rank of Inspector General of Police has been appointed to monitor the action taken against such illegal loudspeakers.
The bench said it was 'satisfied' that the HC's 2016 directives have been complied with.
'It is evident that the authorities have substantially complied with the order. No case for wilful disobedience of directions of this court is made out as the authorities have made an earnest effort to comply with the order,' the HC said.
Hence, no contempt is made out and the contempt petition is disposed of, the court said. PTI SP GK

Advocate Shri Gopal Sharma, appearing for one side, said, 'Due to the bar association strike today, the court has fixed August 21 as the next date of hearing.' Advocate Shakil Ahmad Warsi, who represents the other side, told PTI that due to the rains, the bar association was on strike due to which the matter was posted for another date. The High Court's previous stay was vacated on May 19, and the documents related to that order were submitted in the trial court. The dispute dates back to November 19 last year, when Hindu petitioners, including advocates Hari Shankar Jain and Vishnu Shankar Jain, filed a suit in the Sambhal district court claiming the mosque was built over a pre-existing temple. A court-ordered survey was conducted on the same day (November 19), followed by another on November 24. The second survey on November 24 led to significant unrest in Sambhal, resulting in the death of four persons and injuries to 29 police personnel. The police booked SP MP Ziaur Rahman Barq and mosque committee head Zafar Ali in relation to the violence besides registering an FIR against 2,750 unidentified persons.
