HC quashes civil court's gag order against media in Dharmasthala burial case

Hindustan Times13 hours ago
The Karnataka high court on Friday quashed a sweeping gag order issued by a Bengaluru civil court that barred media outlets, YouTube channels, and people from publishing reports or commentary related to the ongoing investigation into alleged mass burials of victims of suspected sexual assault and murder over a period of two decades in Dharmasthala. The court directed the trial court to reconsider the matter afresh. HC quashes civil court's gag order against media in Dharmasthala burial case
According to Bar and Bench, justice M Nagaprasanna allowed a petition filed by YouTube channel Kudla Rampage challenging the ex parte interim injunction issued on July 8, 2025. The civil court order had restrained the publication of any 'defamatory content' against the family running the Dharmasthala Manjunathaswamy Temple.
'The impugned ex parte injunction order passed by the trial court is quashed. The case is being sent back to the competent court for fresh consideration of the interlocutory application. The trial court should take note of the points made in this order,' the high court said.
It further added, 'The competent court should decide the case expeditiously. This court has not expressed any opinion on the civil suit, criminal proceedings, charges, counter-charges. All arguments between the parties are kept open except for one point considered in the order.'
The original injunction was obtained by Harshendra Kumar D, brother of Veerendra Heggade, who sought the removal and de-indexing of over 8,000 digital links -- including news reports, social media posts, and videos -- alleging they contained defamatory content against him, his family, the Dharmasthala temple, and related institutions.
Welcoming the high court ruling, A Velan, counsel for Kudla Rampage, said in a press statement, 'Karnataka High Court did not just pass a judgment; it restored a fundamental pillar of our democracy. The attempt to draw a curtain of silence over a matter of profound public agony and national importance has failed.'
'In a landmark verdict that will resonate far beyond the confines of this case, the High Court has quashed the sweeping and unprecedented gag order that sought to muzzle the media and stifle public scrutiny of the Dharmasthala mass burials case,' Velan said.
He also criticised the trial court's order: 'The trial court's ex-parte injunction was a textbook example of an unconstitutional 'prior restraint' on speech. It was overbroad, passed without jurisdiction, and cast a chilling effect not only on the 338 named respondents but on any media house or individual who dared to report on the case. It sought to criminalize journalism.'
Meanwhile, in Dharmasthala, the Special Investigation Team (SIT) wound up its search operations for the day after failing to locate any human remains at two more spots -- Spot 7 and Spot 8 -- identified by the complainant.
'Both sites were excavated thoroughly based on the complainant's directions. However, nothing was recovered from either location today. The investigation at the site has been closed for the day,' an SIT officer said, on condition of anonymity.
Earlier, partial skeletal remains were recovered from Spot 6, including about 15 bones, some of which were broken. A skull was not found, officials confirmed. These remains have been sent to the Forensic Science Laboratory (FSL) for further analysis, said officials.
'The FSL team is examining the bones already recovered, but the process is likely to take time. Only after detailed analysis can any clarity emerge about the age, sex, and cause of death,' another officer added, also requesting anonymity.
The anonymous complainant, a former sanitation worker, has alleged that multiple bodies -- including those of women and minors -- were buried across temple-affiliated lands in Dharmasthala between 1995 and 2014. Thirteen such locations were identified as part of the SIT probe, based on his testimony.
'We're following standard procedures and coordinating closely with forensic teams. Not every site may yield physical evidence, but we are documenting everything for completeness,' a senior official said.
Home minister G Parameshwara on Friday reviewed the investigation and said the state is monitoring social media posts about the case. 'We will keep a watch on posts that may wrongly impact society,' he told reporters after a meeting with senior officials, including chief secretary Shalini Rajneesh.

Watch film first: Kerala Story director on Pinarayi Vijayan's National Award criticism

Kerala Chief Minister, Pinarayi Vijayan, condemned the National Award win for 'The Kerala Story'. In an exclusive interview with now, the film's director, Sudipto Sen, reacted to the criticism from the senior politician, referring to the Chief Minister's support for former Kerala CM, VS Achuthanandan, in the said he read the entire post made by Vijayan on X, in which he called 'The Kerala Story' a film that "spreads blatant misinformation with the clear intent of tarnishing Kerala's image and sowing seeds of communal hatred." advertisementWhen asked to comment on the post, Sen said he doubts that Vijayan had even watched his film before criticising its National Award win. "I have, I have a mixed bag reaction. Number one, I'm sure he did not see the film. I would request, he's a very, very senior politician and a very, very revered politician, so I would request him to watch the film," he recalled Vijayan's support for Achutanandan's statement a few years back. He elaborated, "And if he had watched the film, then he would know that 15 years back, his senior, Comrade VS Achuthanandan, came to Delhi to have a press conference to say that the way PFI (Popular Front of India) kind of communal outfits are converting women there, Kerala will turn into Islamic state in the next 20 years. It is on record. The video is available on YouTube. You need not check with me."He went on, "When he did that press conference in Delhi, there was a protest in Kerala. And you know who actually came in support of VS Achuthanandan sir? Mr Pinarayi Vijayan, who was his deputy in the Communist Party - I think he was the joint secretary or something. He supported VS Achuthanandan's concern wholeheartedly."Sen highlighted the irony of Pinarayi's current statement and his actions 15 years back."What he said at that time and what he's saying now are the complete opposite. Which Pinarayi Vijayan sir should I trust?"The filmmaker continued to call himself someone who believes in art, and is unaware of the dynamics of politics. He said, "I am not a politician. I don't understand their style of talking, the style of the strategies of their political life - how it evolves. I'm not the right person to make any comment on any politician's point."He then referred to the film's certification by the censor board, highlighting that due diligence was done while it was originally released in 2023."I will only say the censor board gave a certificate to the film after two months of rigorous checking. They checked the authenticity of each and every dialogue. I stand by every word spoken in the film. I stand by every scene shown in the film. And anybody can challenge my film shot by shot. I am there to answer."advertisement Sen said he would rather focus on the adulation that he's getting for the film, and for the prestigious honour. He said for every Pinarayi Vijayan-like criticism, there are hundreds of congratulatory messages that he would rather read first."The critics are outnumbered in the film. I love my critics. I love my people who praise the film, praise the award, congratulate me. As a human being, I am also a greedy person. I am counting the congratulations. I am right now only reading the congratulatory messages. I will be reading the criticism later," he concluded.'The Kerala Story' won two awards at the 71st National Film Awards - Best Direction, and Best Cinematography. The film follows a group of Kerala women who are coerced into embracing Islam, sexually abused and are eventually made to join ISIS. The initial promos claimed that thousands of Hindu women have been converted to Islam - which was challenged by various a court case, the makers accepted to add two disclaimers, stating that the figures mentioned in the film were "inauthentic and that the movie was a fictionalised depiction of events."- EndsMust Watch IN THIS STORY#Pinarayi Vijayan

‘Rule of law must prevail': SC upholds Bombay HC order to vacate top 18 floors of Tardeo-tower without OC

The Supreme Court on Friday upheld the Bombay High Court order of last month that directed 'selfish' residents occupying the top 18 floors of a 34-storey tower in Tardeo, south Mumbai, having no Occupation Certificate (OC) to vacate their premises within two weeks. The HC had also raised concerns over no fire NOC to the entire high-rise and said that Brihanmumbai Municipal Corporation was free to take any action under notices issued by it as per law in case the residents fail to vacate the premises. The HC had clarified that members residing on 17 to 34 floors 'would be entitled to occupy the tenements, only after OC is granted.' Dismissing the special leave petition (SLP) filed by Willingdon View Cooperative Housing Society challenging the HC order, the SC bench of Justices J B Pardiwala and R Mahadevan on August 1 appreciated 'courage and conviction exhibited by the High Court in taking stern steps against such unauthorised constructions.' 'Sympathy towards the occupiers of such flats on the ground of hardship and difficulties at the end of the court would be thoroughly misplaced. At the end of the day, the rule of law must prevail,' the SC in its order noted. A division bench of Justices Girish S Kulkarni and Arif S Doctor of the Bombay HC on July 15 passed the order. The matter pertained to the high-rise occupied by 50 flatbuyers out of a total 62 flats. The bench had said that it will hear issues pertaining to the first to 16 floors on the next date of hearing. The HC had said that the residents of the tower situated at a prime locality in south Mumbai indulged in 'brazen illegalities' for years and were least bothered about their own and others' lives. 'Such an approach which is wholly contrary to law, cannot be countenanced, in fact, it would set an example to perpetuate illegalities. It needs to be deprecated,' the HC said. The Justice Kulkarni-led bench had rejected a request by the society to stay operation of the order citing a SC order in Campa Cola case. Aggrieved by the same, the society approached the SC, which perused material on record and refused to interfere with 'a very well-considered, bold and lucid judgment delivered by the Bombay High Court' and appreciated concerns expressed by HC. The SC bench led by Justice Pardiwala said that if the petitioners wanted some time to vacate the premises, they may go back to the HC and make a request, and the HC shall ensure that all its directions are 'scrupulously complied with'. 'Necessary legal action shall also be taken against the wrongdoers and erring officials if any. The Special Leave Petitions stand dismissed,' the SC held.

Madras High Court bars use of former CMs' photos, party symbols in welfare schemes

The Madras High Court has directed the Tamil Nadu government not to use photographs of former chief ministers, ideological leaders and insignia of political parties in the advertisements for welfare schemes, reported Bar and Bench on Saturday. A bench of Chief Justice Manindra Mohan Shrivastava and Justice Sunder Mohan also barred the government from naming or rebranding schemes after living persons, according to The Indian Express. The court delivered the order on Thursday while hearing a public interest litigation by All India Anna Dravida Munnetra Kazhagam MP C Ve Shanmugam. Shanmugam had sought directions to stop the Dravida Munnetra Kazhagam government in Tamil Nadu from using Chief Minister MK Stalin's name in public outreach programmes, such as Ungaludan Stalin (With You, Stalin), and Mudhalvarin Mugavari (chief minister's Address). The AIADMK MP claimed this violated Supreme Court guidelines and the Government Advertisement (Content Regulation) Guidelines, 2014. These government-funded welfare programmes featured 'the name of the incumbent chief minister in the nomenclature of the scheme' and included 'pictorial representations/photographs of certain ideological leaders and former chief ministers' linked to the Dravida Munnetra Kazhagam, Shanmugam's counsel, Vijay Narayan, was quoted as telling the High Court by The Indian Express. On the other hand, the advocate appearing for the Tamil Nadu government told the court that the material presented before the court is 'not government publications at all'. 'We are inclined to pass an interim order to the effect that while launching and operating government welfare schemes through various advertisements, the name of any living personality, photograph of any former chief minister/ideological leaders or party insignia/emblem/flag of (DMK) shall not be included,' the court said in its order. The bench also held that including the names of political leaders in the name of a government scheme is not allowed, reported Bar and Bench. The matter will be heard next on August 13.
