New Plymouth rates blunder caused by lack of financial reporting knowledge

An external review following a
New Plymouth District Council rates GST blunder
- which could've cost it $20 million in lost revenue - indicates key managers may not have a sufficiently sophisticated understanding of the rating process and its impacts.
The Simpson Grierson review found the council lacked financial reporting and modelling capability which "strongly suggests a need for training, and possibly recruitment/restructure and training".
Council chief executive Gareth Green conceded an earlier restructure - which saved the district council $10 million - played a part in the error.
"That necessitated some significant pressure being applied through the business.
"I think that pressure along with other pressure points in the local government sector has contributed to this [mistake] occurring, so certainly the pressure that restructure has applied has had an impact, most definitely."
He was instigating another restructure designed to bring more financial and local government experience to council staff.
Green said this would result in a "small number of job losses" due to new positions being created.
He wasn't thinking about falling on his sword.
"I do take full responsibility for this, but I am not tendering my resignation at the current time.
"My total focus at this point is leading this organisation through this situation and making sure we can resolve it in the best possible way."
The Simpson Grierson review also
uncovered two further bungles
.
It revealed the council hiked average residential rates 12.8 percent rather than 9.9 percent as advertised.
The gaffe equated to $102 per ratepayer or $3.1 million.
The review also identified an annual plan wording error relating to industrial water use which could've cost council a further $1.4 million in lost revenue.
In his report, consultant Jonathan Salter said sophisticated knowledge and understanding of the rating process and rating impacts tended to be the domain of specialist officers with a long-standing understanding of the rating function.
These staff were usually intimately familiar with the council's financial reporting and modelling systems, the valuation and rating information database and the district itself, he said.
"There appears to have been a lack of capability in these two areas. This strongly suggests a need for training, and possibly recruitment/restructure and training."

Mayor Neil Holdom said one reason why he called for an independent review when the GST error was discovered was so council could learn from its mistakes.
"I just want to make it clear the councillors - the governance team - made decisions based on information that was incorrect.
"Our long-term plan was audited by Audit NZ and they also didn't pick up this error in our rating calculation model."
Holdom said the proposed restructure would bolster the financial capability and bring people onboard council with local government experience.
The Simpson Grierson report also recommended an independent legal review be a component of the annual rate setting process, and that council not rely on the Audit NZ review alone.
Holdom said an extra-ordinary meeting on 22 July would consider a proposal for future annual-plan and long-term plan calculations to be externally peer reviewed as part of a parcel of steps to address the recent errors.
Salter also wanted the council to review how it handled documents.
"It appears that document management may have been an issue ... the restricted water supply targeted rate issue appears to have arisen from an incorrect 'cut and paste' from another document."
Holdom earlier described the GST blunder as a "typo" and a "cut and paste" error.
The Simpson Grierson consultant also thought council should consider moving away from an average residential rates model to an overall rates model.
"This would be a more transparent and certain disclosure. If there is reference to the 'average' rather than 'overall' rates increase, this concept should be defined."
At the extraordinary council meeting on 22 July, the mayor would recommend councillors approve a one-off rates refund to all residential property owners to ensure the average residential rates increase equalled 9.9 percent.
That would require council to find $3.1 million in savings elsewhere.
Councillors would also vote on amending the rates resolution wording regarding properties on a restricted water flow - usually industrial users - to ensure council was able to charge $418 for each cubic metre of water as intended.

With nominations closing tomorrow, several councils across the country do not have enough candidates to fill the positions that need to be filled in certain electorates, or have vacancies that will go uncontested. As of Wednesday afternoon across the country's 16 regional and unitary councils, 47 regional council seats either wouldn't have an election, or would trigger a by-election because of the lack of candidates. Te Uru Kahika was calling for more New Zealanders to put their names forward for the 2025 local elections. New Zealand's longest serving regional council chair and current chair of Bay of Plenty Regional Council Doug Leeder was encouraging people who were considering standing to go for it. "This is about democracy being exercised by people in the community," he said. Regional and unitary councils make critical decisions that affect the environment, public transport, water quality, land use, flood protection, and climate resilience. "If you want a say in how your region prepares for climate change, manages rivers and lakes, or invests in public transport, this is your opportunity to step up," he said. "Councillors don't need to be experts, but they do need to be people who can listen, think about the issues, and want to make their communities and environment a great place to be. Leeder said if there was not enough candidates to fill a council's vacancies then a by-election was called. Leeder could not recall that happening in his 24 years in local government. Leeder himself will not be standing for re-election. Across the 16 regional and unitary councils Horizons Tonga Māori Regional Constituency and the Tasman District Council's Te Tai o Aorere Māori Ward have no candidates. While all 16 councils have constituencies or wards with either less nominations than vacancies or uncontested vacancies. A number of district councils also appear to be a few candidates short. Election management services company is tracking candidates for a number of councils. As of Wednesday afternoon data published on its website showed no nominations had been received for the Mayoralty vacancy at the Rotorua Lakes Council, while Central Hawke's Bay District Council, Chatham Islands Council, Hurunui District Council, Manawatū District Council and Selwyn District Council all had just one nomination. Several council at large or ward vacancies, as well as community boards also had less candidates than vacancies or were uncontested. Among them is Carterton District Council which had four nominations for eight council seats and Chatham Islands Council which had three nominations for eight council seats. In 2022 Local Government New Zealand (LGNZ) also noted "concerningly low" nominations in some parts of the country. On Tuesday, LGNZ chief executive Susan Freeman-Greene said electoral officers were reporting that overall candidate nomination numbers were generally on par with the same time last election. "[We] know from past elections that many candidates choose to wait until the final week to submit their nominations," she said. "We strongly encourage candidates not to leave things to the last day, to allow time for information to be checked and any issues resolved." Nominations close at noon on Friday, 1 August. Councillors to vote on new agreement of Lake Taupō and the Upper Waikato River with local iwi

Lake Taupō. Photo: RNZ / Rebekah Parsons-King Councillors in Taupō will vote on a new joint management agreement of Lake Taupō and the Upper Waikato River with local iwi Ngāti Tūwharetoa today. The legally required agreement has attracted controversy with one councillor calling in lobby group Hobson's Pledge to raise his concerns to a wider audience. The purpose of the draft Joint Management Agreement (JMA) is to protect the water of Lake Taupō (Taupō Moana) and the Upper Waikato River. It would see the council and Tūwharetoa Māori Trust Board collaborate on work such as monitoring and enforcement, district plan reviews, resource consent application assessments, and enabling customary activities. Tūwharetoa Māori Trust Board chair John Bishara said it's a very important day for both the board and council and he is looking forward to a positive result. "What [the JMA] does is reaffirms our relationship and partnership with our wai and inclusion of the Taupō District Council." The JMA is a legal requirement under the Ngāti Tūwharetoa, Raukawa, and Te Arawa River Iwi Waikato River Act 2010 (also known as the Upper Waikato River Act 2010), which mandates agreements between local authorities and Waikato River iwi trusts. The council already maintains agreements with Te Arawa River Iwi Trust (signed in 2017) and Raukawa Settlement Trust (signed in 2013). The council said "this agreement will enable the shared protection and restoration of these waterways for future generations." "While the council could manage these responsibilities independently, protecting and restoring the environment is a shared responsibility. Ngāti Tūwharetoa, as mana whenua and legal owners of the beds of Lake Taupō, the Upper Waikato River, and many of the tributaries, have both the cultural and legal right to be involved." But in a written statement Taupō District Councillor Duncan Campbell said he was concerned by the agreements financial implications, "treaty-framed governance language" and a lack of public consultation. "The agreement should be subject to public consultation and independent legal review - not because I oppose partnership, but because I support good governance." However Bishara said the Trust Board and council had been working together on the agreement for many years. "There's always room for consultation, however I don't think that consultation is going to improve the document that we already have worked with the council. Look I see the council as being the governors like we are, they represent their people." The Trust Board is the owner of the bed of Lake Taupō, including the Waikato River to Huka Falls and tributaries flowing into the lake, on behalf of ngā hapū o Tūwharetoa. "We believe that the ownership of the lake and the water column above it is Ngāti Tūwharetoa's, so we have huge rights and interests," Bishara said. Bishara said there has been opposition to bringing Lake Taupō into the agreement as the Upper Waikato River Act only covers the Waikato River, but he said it makes more sense to treat it as one connected system. "It's indivisible... to distinguish them separately wouldn't be appropriate. I believe that the council do agree with that but it is an extension of the Waikato River Settlement." Bishara said it has been a long journey and there a still many things to work out with the council, but he believes the board will get approval for the Joint Management Agreement. Campbell said his concerns with the JMA weren't with the Treaty itself, but with the ambiguity and breadth of language used throughout the agreement, particularly clauses that speak to 'shared responsibilities', 'partnership' and decision-making influence without precise boundaries. "When unelected parties are embedded in planning, consenting, enforcement, and land management processes, the line between co-management and co-governance blurs." Photo: 123RF An organisation representing financial mentors warns unethical debt collectors are harassing people to pay-off loans at their workplaces, homes and on social media. FinCap charity has released its annual Voices report after collecting data from more than 700 financial mentors. Its chief executive Fleur Howard said some debt collectors are deliberately panicking debtors and stricter rules are needed. "Financial mentors tell us they are working with people who are being harassed and coerced by debt collectors at work, at home, and on social media. This can endanger people's employment and embarrass them in front of their communities," she said. "These tactics force people to agree to repay debts they may not be legally responsible for, and repayment plans they can't afford. This can send people into a spiral of missed repayments, and see small initial debts balloon in size." The report shows half of those seeking help from a financial mentor are in work, while one in ten have a mortgage. Financial mentors have seen an 88 percent increase in waged or salaried clients earning over $1000 per week since 2021. The report states that many households have taken on debt to pay bills and keep food on the table, and a large burden of accumulated household debt has been building, much of which has become unmanageable. It said some debt collectors were also using coercion or illegitimate threats of legal action and turning up at people's workpaces, homes and sending excessive automated texts and emails. "This isn't about getting people out of debts that they legitimately owe," Howard said. "Some debts arise that should never have been issued under today's responsible lending rules. Sometimes, they are debts owed by a relative, which people are pressured into taking responsibility for, or there is actually no legitimate debt at all." Howard said many households were struggling with the burden of accumulated and unmanageable debt. "There are debt collection agencies who act responsibly, but the lax legal framework creates a wild west situation, where some unscrupulous debt collectors act unethically. " The Fair Trading Act governs all private debt collection and in May, Commerce and Consumer Affairs Minister Scott Simpson said he would review the Act later this year with a responsibility to "safeguard the interests of consumers and ensure that their rights are fairly upheld". Howard said that planned review, alongisde the Financial Services Reforms Bills currently before Parliament were important opportunities to fix the law around debt collection. "Debt collection reform will enable people to repay money they legitimately owe, without being subject to harassment and bullying," she said. David Verry from North Harbour Budgeting Services said the report echoed what financial mentors saw on a daily basis. He said when people believe that they're going to be talked about in social media, or somebody was turning up to their work premises they may feel forced to make some sort of payment that they may not be able to afford. "They'll feel forced into making some form of payment towards it before they make payments on other things, things like food or petrol for the car," he said. "When people turn up to people's places and they're in sort of pseudo uniforms that can be very intimidating for clients." Verry said currently there was no industry body that people could go to and complain about the actions of the debt collectors. "It's essentially an industry which is just completely unregulated, and what we would like to see is some boundaries put in place there," he said. "We'd like them brought into the Fair Trading Act. We'd like them to be licensed." Verry said financial mentors just want debt collectors to play the game fairly.
