SC rejects convicts' plea against 2-judge bench hearing Godhra train burning appeals

Senior advocate Sanjay Hegde, appearing for two convicts, told a bench comprising Justices J K Maheshwari and Aravind Kumar that it has been held in the Red Fort terror attack case, in which Mohammad Arif alias Ashfaq was handed down the death penalty, that a three-judge bench has to hear cases pertaining to award of the capital punishment.
New Delhi, May 6 (PTI) The Supreme Court on Tuesday rejected the vehement submissions of few convicts that a two-judge bench cannot hear their appeals against conviction as the matter pertained to the award of death penalty to 11 accused in the 2002 Godhra train burning case.
A Constitution bench of the apex court had in its September 2014 judgement concluded that in all cases in which death sentence was awarded by the high court, such matters be listed before a bench of three judges.
Dismissing the submissions, the bench referred to relevant Supreme Court rules and the judgement, and said a three-judge bench has to hear appeals in cases where the high courts have either confirmed death penalty or awarded it after hearing the appeals of parties.
'The Gujarat High Court, in the present case, commuted the death penalty of 11 convicts into life imprisonment and did not award the death penalty…The trial court had awarded the death penalty in this case,' Justice Maheshwari said, adding the rule and the apex court judgement did not bar hearing of the appeals in the present case by a two-judge bench.
'The objection is repelled,' the bench said and commenced the final hearing in the case.
Earlier on April 24, the top court said it will commence final hearing on May 6 and 7 on the appeals filed by the Gujarat government and several other convicts in the 2002 Godhra train burning case.
On February 27, 2002, 59 people were killed when the S-6 coach of the Sabarmati Express was burnt at Gujarat's Godhra, triggering riots in the state.
Several appeals have been filed in the apex court challenging the October 2017 verdict of the Gujarat High Court which had upheld the conviction of several convicts and commuted the death penalties of 11 people to life term.
The high court had upheld the 31 convictions in the case and commuted the death penalties of the 11 convicts to life term, the counsel had said.
While the state has appealed against the commutation of death penalty to life term for the 11 convicts, several convicts have challenged the high court's verdict upholding their convictions in the case. PTI SJK SJK DV DV

New Delhi, Jul 29 (PTI) Union Minister Nitin Gadkari was on Tuesday conferred with the Chintamanrao Deshmukh National Award for public service here. NCP-SP supremo Sharad Pawar handed over the award, instituted by Pune-based NGO Sarhad, to Gadkari and praised the Union minister for developing a network of highways across the country. Pawar praised Gadkari for his blunt talk and the knack of getting difficult projects implemented. He also highlighted the minister's popularity among members of Parliament across party lines. Pawar said a large number of MPs have expressed great confidence in Gadkari's abilities to execute projects and develop a road network in the country. The NCP-SP supremo said Gadkari's popularity among MPs stems from the fact that he does not discriminate against anyone along party lines and genuinely believes that good roads are a prerequisite for a nation to prosper. Deshmukh, who hailed from Maharashtra, was the first Indian to be appointed as the governor of the Reserve Bank of India in 1943 and also served as the finance minister from 1950 to 1956. He had famously quit as the finance minister over the Union government's plans to bifurcate the then state of Bombay into Gujarat and Maharashtra and to designate Mumbai as a union territory. Deshmukh also served as the chairman of the University Grants Commission and as the vice chancellor of Delhi University. He died in 1982. The first Chintamanrao Deshmukh National Award was conferred on former diplomat Dyaneshwar Mulay. The seizure was made under the Chilakalapudi Police Station limits. Of the 10 apprehended, four are juveniles, Machilipatnam Deputy Superintendent of Police Ch Raja said. He told reporters police were trying to trace the source of the narcotic and its end location. He said a special team has been formed to conduct undercover operations and eradicate the presence of marijuana from Machilipatnam. The Krishna district police earlier arrested 520 people under the Narcotic Drugs and Psychotropic Substances (NDPS) Act and seized about 655 kg of ganja.
