Land survey: Sabah civil servant, retired govt officer charged with bribery
Smith A. Lewas @ Simon, 56, and Lusiwoi Kisa, 62, pleaded not guilty after the charges were read separately before judge Jason Juga.
According to the charge sheet, Smith, who was then serving as a Grade J17 technician at the Kunak Assistant Collector of Land Revenue Office, had allegedly solicited a bribe of RM54,000 in cash from one Goefle Joseph, 39.
The money was allegedly intended as an inducement to process a new land application following a survey of land lots under the Smallholders Scheme in Madai Baturong, Kunak, involving Joseph's lot and 26 others.
The offence was allegedly committed at a studio in Kunak around 8pm in May 2016.
Meanwhile, Lusiwoi, who was then with the Sabah Land and Survey Department, was charged with soliciting a RM12,000 bribe from Cornilius Jomol @ Terence, 71.
The money was purportedly sought as inducement to conduct a land survey for a group led by Cornilius and 16 others, despite there being no available lots left for survey or application under the SPPKMB Kunak at the time.
Lusiwoi, who was then serving as an administrative assistant (Grade N17), in Kota Kinabalu, allegedly committed the offence in Lahad Datu in June 2016.
Both face charges under Section 17(a) of the Malaysian Anti-Corruption Commission (MACC) Act 2009, punishable under Section 24(1) of the same act.
If convicted, they could face up to 20 years' jail and a fine of not less than five times the value of the bribe or RM10,000, whichever is higher.
Sabah MACC deputy public prosecutor Nurul Izzati Sapifee prosecuted while Smith was represented by lawyer Vivien Thien and Lusiwoi by Jhassery P. Kang.
Nurul Izzati earlier offered bail of RM8,000 and RM15,000 respectively, with one local surety each.
Additional conditions included reporting to the MACC once every two months, surrendering their passports to the court, and refraining from contacting or intimidating prosecution witnesses.
Jason set bail at RM10,000 for Smith and RM6,000 for Lusiwoi, each with one local surety, along with the additional conditions as requested by the prosecution.
The court fixed Sept 11 for case mention.

It urged the authorities to take 'immediate, transparent and meaningful action' to serve justice for the former political aide. This comes after the Attorney‑General's Chambers (AGC) classified a fresh probe into Teoh's death as requiring no further action (NFA) due to insufficient evidence to bring charges. 'Over this 11-year span, despite multiple efforts by civil society and Teoh's family to call for a proper investigation of the case and a court finding of criminal wrongdoing, no one has been held accountable, and the officers implicated were never charged. 'More than a decade later, justice remains elusive for Teoh and his family,' the organisations said in a statement. Teoh was found dead on July 16, 2009, after falling from the fifth floor of Plaza Masalam in Shah Alam, Selangor. He had earlier been questioned for several hours by Malaysian Anti-Corruption Commission (MACC) officers at the Selangor MACC headquarters. Before 2018, two special investigation teams were set up to look into Teoh's death – one in 2011 and the other in 2015 – but both cases were classified as NFA by the public prosecutor. In 2019, police launched an investigation under Section 342 of the Penal Code for wrongful confinement. A re-investigation was ordered by the Kuala Lumpur High Court in November last year, directing the police to re-examine all aspects of the case. This was also classified as NFA.

Freelance preacher investigated over distribution of sex videos
PETALING JAYA: A freelance religious speaker is under police investigation for allegedly sharing explicit videos involving his wives and other women, following a report lodged by his second wife. Shah Alam District Police Chief, Assistant Commissioner Mohd Iqbal Ibrahim, said the report was received at 12 noon on June 16. Following the report, police arrested the complainant's husband and seized two mobile phones and a laptop belonging to the suspect. 'A review of the suspect's mobile phone uncovered several sex videos involving the suspect and his wives, as well as explicit images of other women. 'The suspect was remanded for four days until July 5 and has since been released on police bail pending the completion of investigations,' he said in a statement. Mohd Iqbal said the investigation is being conducted under Section 509 of the Penal Code, Section 233 of the Communications and Multimedia Act 1998, and Section 14 of the Minor Offences Act 1955. He added that if convicted under Section 509 of the Penal Code, the offender could face up to five years' imprisonment, a fine, or both. 'Under Section 233 of the Communications Act, offenders may be fined up to RM50,000, jailed for up to one year, or both, with an additional RM1,000 fine for each day the offence continues after conviction. 'For offences under Section 14 of the Minor Offences Act, the penalty is a fine not exceeding RM100,' he said. Kota Setar District Police Chief ACP Siti Nor Salawati Saad, said the incident was detected through a viral video on Facebook on Friday (July 4), reported Sinar Harian. "In the 23-second video, the motorcyclist is believed to be a woman based on the dark clothing worn. "She is seen riding against traffic towards Jitra while holding a mobile phone, ignoring other vehicles coming from the opposite direction," she said in a statement on Saturday (July 5). A police report was made at the Kota Setar police station at 7.34pm on Friday. "Police are currently conducting an initial investigation and seeking cooperation from PLUS to identify the motorcyclist. "Anyone who has information or recognise the individual in the video are urged to contact the Kota Setar Traffic Investigation Officer, Sergeant Mohd Khairulnizam Abdul Aziz, at 011-2835 0767 or the Kota Setar Traffic Police Station at 04-732 1222," she explained. She added that the case is being investigated under Section 79(2) of the Road Transport Act 1987 for not conforming to traffic directions and signs.
