
1MDB's lawsuit against me is malicious, former chairman tells court
Mohd Irwan said this was because he was a senior and high-ranking civil servant, holding the post of Finance Ministry secretary-general when Datuk Seri Najib Razak was prime minister and also finance minister.
"1MDB's main target was Najib. However, they wanted to blame someone other than him and I was an easy target because of my position as the ministry secretary-general.
"1MDB also wanted to sensationalise their case by falsely alleging that I was aligned to Najib and his alleged wrongdoings and that I, somehow, conspired or colluded with Najib in failing in my duties and responsibility to take the relevant steps to investigate the wrongdoers," he said.
Mohd Irwan said this in his witness statement when testifying as the second defendant during the hearing of the US$6.59bil lawsuit filed by 1MDB, as plaintiff, against him and former 1MDB chief executive officer Arul Kanda Kandasamy for breach of trust and conspiracy.
Mohd Irwan, who was former Treasury secretary-general, said the suit was clearly selective prosecution and done only to bring disrepute against him.
He said this was clear as he had resigned in 2018 and it was only three years later in 2021 when the government changed hands after the 14th General Election, was the action filed against him.
He said that at no point in time from May 2018 till May 2021 was a demand issued against him or was he asked to answer any allegations or given a chance to explain matters belatedly raised against him.
"Their conduct of bad faith is further shown when they filed this claim for alleged breach of duties as member of the board but yet, chose not to include the remaining members of the board at that material time, namely Datuk Kamal Mohd Ali and Datuk Seri Norazman Ayob, despite being aware that all decisions were collective decisions and none of the allegations made was a decision that I made on my own accord or attempted to push through without the consensus and approval of the entire board," he said.
Mohd Irwan said as a result of the lawsuit, he lost his reputation and his credibility had been tarnished.
"I am subject to ridicule and having to defend myself constantly. As a result, it is very difficult for me to continue to hold certain directorships as people are sceptical and weary of the allegations that have been made against me. Apart from that, I had to incur legal expenses in appointing solicitors to defend me," he said.
The hearing before Judge Datuk Raja Ahmad Mohzanuddin Shah Raja Mohzan continues on May 19.
In May 2021, 1MDB filed a lawsuit against Mohd Irwan and Arulkanda, accusing them of breach of trust and conspiracy, which led to losses of US$1.83bil, linked to the company's investment in 1MDB-Petrosaudi Ltd, which was subsequently converted into the Brazen Sky Limited investment, purportedly recoverable from the Bridge Global Fund.
1MDB also alleged that both defendants committed breach of trust and conspiracy by misappropriating US$3.5bil in company funds paid to Aabar Investments and US$1.265bil paid to International Petroleum Investment Company on May 9, 2017.
1MDB further alleged that Mohd Irwan conspired with Arul Kanda to extend his employment agreement, resulting in a payment of RM2,905,200 to Arul Kanda, all while disregarding the company's interests, which ultimately led to financial losses and damages.
Consequently, 1MDB is seeking US$6.59bil in damages from both defendants and an additional RM2.9mil from Mohd Irwan related to the extension of the employment agreement. – Bernama

AirAsia-Airbus aircraft deal supports Malaysia's aspiration to be Asia's leading aviation hub
PARIS: The signing of an agreement between AirAsia and Airbus for the purchase of A321XLR aircraft will further strengthen the airline's operational capabilities for short- and medium-haul routes, said Prime Minister Datuk Seri Anwar Ibrahim. The prime minister also witnessed the MoU exchange between 3P Capital Advisers and Ardian, a leading private investment firm from France, for the exploration of investment opportunities in the private markets. The private sector initiative can give Malaysians a wider access to alternative investments, Anwar said. Meanwhile, during his meeting with Imerys, an industrial mineral processing company that has been operating in Malaysia for over 25 years, Anwar said the company expressed its commitment to expand operations and support the development of a high-value, environmentally-friendly manufacturing sector in the country. In addition, Anwar held a meeting with the management of Arkema, a global leader in specialty chemicals, which is evaluating potential new investments in Malaysia. He said the company can potentially create more high-skilled jobs, expedite technology transfer, and enhance Malaysia's position as a major bioeconomy hub in the Asian region. AirAsia inks US$12.25b Airbus deal to add long range jets
KUALA LUMPUR: AirAsia has signed an agreement to buy US$12.25 billion (RM51.72 billion) worth of long-range Airbus 321XLR aircraft, with deliveries confirmed by 2028, said Capital A Bhd chief executive officer Tan Sri Tony Fernandes. He said the low-cost carrier inked a memorandum of understanding (MoU) with Airbus in Paris today for 50 A321XLRs with rights for 20 A321XLRs, the new fleet of which are targeted to serve Central Asia, the Middle East and Europe, among others. "This will probably make us one of the largest users of the XLR aircraft, the 321XLR, and is really the next stage of our transformative growth in terms of creating the world's first low-cost multihub network carrier. "This will enable us to fly to Europe, and we're hoping to launch our first European flight this year," he said during Capital A's virtual media briefing on Friday, in conjunction with the agreement signing ceremony. The agreement was signed between Fernandes and Airbus Commercial Aircraft chief executive officer Christian Scherer, witnessed by Prime Minister Datuk Seri Anwar Ibrahim. Fernandes said the next-generation A321XLRs will operate alongside AirAsia's all-Airbus fleet of A320 Family and A330 aircraft, and aims to carry 150 million guests annually by 2030, reaching a cumulative total of 1.5 billion guests since inception. He said AirAsia plans to finance the aircraft order through bank leases. Fernandes also confirmed that the group is set to announce another aircraft order next month, but declined to provide further details. Meanwhile, he said the group is working to issue its first bond by October this year. "This is the first time in our history that we've been rated by international credit rating agencies. "As interest rates begin to moderate, which I'm hopeful will happen soon, it's only natural for us to return to our traditional model of owning aircraft. "Previously, we shifted from the financing markets to operating leases due to high interest rates and strong capital availability in the leasing space. We're now reassessing that strategy," he said. On Capital A's proposed regularisation and restructuring plan, Fernandes said the company is expecting to resubmit the decision letter to Thailand's Securities and Exchange Commission within the next week or two. "Once we dispose of the aviation business, Capital A will effectively exit Practice Note 17 (PN17)," he said. He said that six of the group's non-airline businesses, namely Asia Digital Engineering (ADE), Teleport, AirAsia MOVE, OTA, BigPay, Santan, and AirAsia Brand Co (ABC) are currently exploring the possibility of a dual listing in Hong Kong. He said Malaysia offers a strategic position as a gateway into the Asean market, supported by political stability as well as investor-friendly policies and a dynamic industrial ecosystem. "I emphasised that Malaysia is now a major hub in the clean energy, semiconductor, and electrical and electronic sectors, and continues to play an important role in the oil and gas industry. "This potential has also been strengthened with the implementation of investment faciliation initiatives by government agencies," he posted on his personal X account, @anwaribrahim, after the meeting that was held in Paris on Friday. Anwar is leading a Malaysian delegation to the city in conjunction with a two-day official visit to France. French companies that participated in the roundtable session included Air Liquide, L'Oréal, Axens, Schneider Electric and Thales which have been well established in Malaysia and continue to show their strong commitment. France has remained one of Malaysia's top five trading partners among European Union members.
