AGC backs ban on civil servants joining ‘Turun Anwar' rally
PETALING JAYA : The Attorney-General's Chambers has backed the chief secretary to the government's directive prohibiting civil servants from taking part in the upcoming 'Turun Anwar' rally, saying there is legal basis for the instruction.
The AGC said civil servants are bound by letters of undertaking Regulation 20(3) of the Public Officers (Appointment, Promotion and Termination of Service) Regulations 2012.
It said the undertakings include complying with all regulations, including the Public Officers (Conduct and Discipline) Regulations 1993, general orders, circulars, and directives issued by the government from time to time.
Both sets of regulations state that civil servants must not behave in any manner that could tarnish or bring disrepute to civil service and not make any public statements that could embarrass or tarnish the reputation of the government.
The AGC said civil servants must at all times remain loyal to the Yang di-Pertuan Agong, the nation, and the government.
'Any failure to comply with the regulations, general orders, circulars, and other instructions issued by the government may result in disciplinary action being taken against civil servants,' it said in a statement.
On Sunday, chief secretary to the government Shamsul Azri Abu Bakar said it was inappropriate for civil servants to take part in the rally 'because the action is not in accordance with the principle of loyalty to king and country as espoused by the Rukun Negara'.
However, Lawyers for Liberty director Zaid Malek said that Shamsul's statement lacked any basis in law and was contrary to the Federal Constitution, which guarantees the right to freedom of expression and the right to peacefully assemble.
He also said criticism, dissent, and protests were part of any democracy.
The AGC said although Articles 10(1)(a) and 10(1)(b) of the Federal Constitution grant every citizen the freedom of speech and expression, as well as the right to assemble peacefully without arms, these rights are not absolute.
'In line with that, any public assembly is also subject to existing laws, including special directives issued by the authorities, such as directives issued by the chief secretary to the government to civil servants,' it said.

"This funding, sourced through my office as the MP for Kulai, comes from both the Ministry of Rural Development (KKDW) and the Ministry of Economy. The upgraded drainage system aims to address the flooding issues that have long troubled the residents here," Teo said after inspecting the completed drain in Kampung Melayu Bukit Batu. The area, which has experienced frequent flooding for the last ten years, faced four floods this year alone due to its low-lying terrain. Earlier this year, in April, residents urged the authorities to take immediate action to address the flash floods, which have become a monthly occurrence since the beginning of the year. Several residents attribute the recurring floods to a poor drainage system, which has disrupted daily life for over 50 households and caused extensive damage to property. Juliana Boonadir, 43, a clinic manager, expressed relief at the completion of the new drainage system, calling it a long-awaited solution. "We've been hoping for a solution to reduce the risk of flooding. Every time the floods hit, so many of our belongings are damaged. While there's help, the losses are still considerable. This year has been the worst—four floods in the first three months alone. This new drain will be a great help," she said. Retiree Razman Hamzah, 64, commended the government for its commitment to addressing local flooding problems, noting that the new drain would help mitigate the damage caused by floods.

Thousands of demonstrators gathered near Sogo and Pertama Complex in Kuala Lumpur this afternoon for the 'Turun Anwar' protest. The crowd, which included Perikatan Nasional leaders and supporters dressed predominantly in black, is expected to march to Dataran Merdeka Over 2,000 police officers have been deployed across the city, with acting KL police chief Datuk Mohamed Usuf Jan Mohamad warning that any provocation or unlawful behaviour will be met with firm action. Anwar had earlier said the government welcomes criticism and peaceful assembly, but urged protesters to act responsibly. Police say ‘Turun Anwar' rally drew estimated 18,000, ended without incident
KUALA LUMPUR, July 26 — Police estimated that around 18,000 people took part in the 'Turun Anwar' rally in the capital today, said acting Kuala Lumpur Police Chief Datuk Mohamed Usuf Jan Mohamad. Despite the large turnout, Mohamed Usuf said the protest was peaceful. 'We would like to say thank you to those who participated in the rally today, for not stirring any unwanted trouble. 'So far, we have not received any police reports,' he told a press conference here after the crowd had dispersed. When asked if anyone would be called in for investigation, Mohamed Usuf said police would typically carry out a post-mortem before deciding if further action is necessary. More than 2,000 police officers and personnel were deployed for the rally, which began at 11am before protesters marched to Dataran Merdeka at noon. The rally lasted for three hours and ended without incident.
