A two-member bench of the Peshawar High Court (PHC) comprising Justice Ejaz Anwar and Justice Dr Khurshid Iqbal, has permitted the Khyber-Pakhtunkhwa Governor and his staff to use the Governor House in Nathia Gali for official purposes free of charge. The court also issued a notice to the provincial government, seeking an explanation over its alleged plans to convert the historic property for commercial use.
The ruling came during the hearing of a petition filed against the provincial government's move to repurpose the Governor House as a rest house. Representing the petitioner, advocates Shumail Ahmad Butt and Shiraz Butt argued that under Article 101(3) of the Constitution, a Governor is entitled to official residences as determined by a Presidential Order. According to a standing Presidential Order from 1975, governors are allowed to use designated official residences without charge. In K-P, these include the Governor Houses in Peshawar and Nathia Gali.
The petitioners informed the court that the provincial government had recently reclassified the Nathia Gali Governor House as a public rest house and handed its management over to the tourism department, which began renting out rooms, charging up to Rs40,000 per night. They maintained that the site holds constitutional and historical importance and cannot be converted without due process.
The petition further stated that no sitting governor had ever consented to the conversion or declassification of the property and that any change to its status would require a new Presidential Order.
The example of Punjab was cited, where the transfer of a Governor House was made lawfully through such an order.
The court accepted the arguments and ruled in favor of Governor Faisal Karim Kundi, allowing him continued use of the Nathia Gali residence for official functions. It also asked the provincial government to formally respond to the matter.
Meanwhile, PHC has issued a notice to the K-P government, seeking a formal response over its failure to establish a law university in the province despite clear court orders. The notice was issued during the hearing of a contempt of court petition filed against the provincial government.
A two-member bench comprising Justice Ijaz Anwar and Justice Dr Khurshid Iqbal presided over the proceedings. The petition was filed by Peshawar High Court Bar Association President Aminur Rehman Yousafzai, who appeared in court alongside General Secretary Advocate Ashfaq Dawoodzai and Advocate General KP Shah Faisal Utmankhel.

Niazi has served as the 13th prime minister of AJK from August 4, 2021, to April 14, 2022.

The Kissan Ittehad and the Sindh Abadgar Alliance have announced a protest movement across Punjab starting from August 11 due to the government's "failure" to fix the official wheat support price. "On August 11, a symbolic funeral for agriculture will be held outside the DC office in Kasur, and a protest will be held outside the Hyderabad Press Club on August 20," Kissan Ittehad Chairman Khalid Hussain Batth said on Saturday at a press conference at the Karachi Press Club. Sindh Abadgar Alliance President Zubair Talpur was also present on the occasion. Batth said protests would take place across all provinces, followed by a march toward Islamabad. "This time, we will protest before the wheat cultivation season begins," he said, clarifying that this movement has no affiliation with any political party. He added that over the past two years, the cost of wheat cultivation has been Rs4,000 per 40kg, while the government purchased wheat from them at only Rs2,200. "We are ready for a forensic audit," he said. "The government demands up to 45% in taxes but how can we pay taxes when we are not even making a profit?" He said if the government does not set a wheat support price before sowing begins, they will initiate talks with the prime minister and chief ministers. If there is still no decision, province-wide protests will be launched in Punjab on August 11 and in Sindh on August 20. "The government has failed to fix wheat prices for the last two years," he noted.

LAHORE: The Lahore High Court (LHC) has recently observed that issuing a police character (PS) certificate reflecting a criminal history of an accused despite his acquittal by a court of law in an FIR violates the individual's constitutionally protected right. The court said such a practice not only violates the individual's protected right to human dignity but also imposes a lasting and unjust stigma upon a citizen who has been exonerated through due judicial process. The court said, once an accused has been acquitted by a competent court of law, he is to be considered, treated and regarded as innocent person under the law. Despite a conclusive acquittal of an accused any continuous reference or inclusion of the relevant FIR in official documents like police character certificate is unwarranted, the court observed. The court passed this order in a petition of Abdur Rehman Faryad challenging issuance of a PC certificate mentioning his name in the FIR despite his acquittal by a competent court of law. The court said the petitioner is entitled to a PC certificate that reflects his acquittal and the absence of any subsisting criminal liability. The court said the allegations levelled against the petitioner do not involve moral turpitude, nor do they relate to any offence against the State. The court said it would be legally unjustified to draw any adverse inference or attach any stigma to the petitioner merely based on the registration of an FIR. The court; therefore, directed the Home Secretary Punjab to ensure the issuance of a PC certificate in favour of the petitioner, which accurately reflects his present legal status. The said certificate shall exclude and omit any reference whatsoever to FIR registered at Police Station Nawan Kot, Lahore, in the light of the petitioner's lawful acquittal and the absence of any existing criminal liability, the court added. The court noted that law enforcement agencies have the administrative authority to maintain internal records of reported incidents, including FIRs, for various legitimate purposes. The court said the retention of such data, so long as it is confined to lawful administrative use and is not disclosed or misused in a manner prejudicial to the rights of the individual and cannot be construed as a violation of fundamental rights guaranteed under the Constitution. The court; therefore, directed the office to transmit copy of the court order to the Inspector General of Police Punjab and the Chief Secretary Punjab, to ensure its strict implementation in light of the court's directions and observations.
