Google loses US appeal over app store reforms in Epic Games case

July 31 (Reuters) - Alphabet's Google (GOOGL.O), opens new tab on Thursday failed to persuade a U.S. appeals panel to overturn a jury verdict and federal court order requiring the technology company to revamp its app store Play.
The San Francisco-based 9th U.S. Circuit Court of Appeals, in a unanimous ruling, rejected, opens new tab claims from Google that the trial judge made legal errors in the antitrust case that unfairly benefited "Fortnite" maker Epic Games, which filed the lawsuit in 2020.
Epic accused Google of monopolizing how consumers access apps on Android devices and pay for transactions within apps. The Cary, North Carolina-based company convinced a San Francisco jury in 2023 that Google illegally stifled competition.
U.S. District Judge James Donato in San Francisco ordered Google in October to restore competition by allowing users to download rival app stores within its Play store and by making Play's app catalog available to those competitors, among other reforms.
Donato's order was on hold pending the outcome of the 9th Circuit appeal. The court's decision can be appealed to the full 9th Circuit and ultimately to the U.S. Supreme Court.
In a statement, Lee-Anne Mulholland, Google's vice president of regulatory affairs, said the appeals court's ruling "will significantly harm user safety, limit choice, and undermine the innovation that has always been central to the Android ecosystem."
The company said it would continue to focus on "ensuring a secure platform as we continue our appeal."
Epic CEO Tim Sweeney said in a social media post: "Thanks to the verdict, the Epic Games Store for Android will be coming to the Google Play Store!"
Google told the appeals court that the tech company's Play store competes with Apple's (AAPL.O), opens new tab App Store, and that Donato unfairly barred Google from making that point to contest Epic's antitrust claims.
The tech company also argued that a jury should never have heard Epic's lawsuit because it sought to enjoin Google's conduct — a request normally decided by a judge — and not collect damages.
Epic has defended the verdict and court injunction, telling the 9th Circuit judges that the Android app market has been "suffering under anti-competitive behavior for the better part of a decade."
In the trial court and in the appeal, Epic disputed arguments by Google that changes to its app business ordered by the court would harm user privacy and security.
Microsoft (MSFT.O), opens new tab filed a brief backing Epic, as did the U.S. Justice Department and Federal Trade Commission.
Epic separately is battling Apple over a U.S. judge's order requiring the iPhone maker to give developers greater freedom to steer consumers to make purchases outside its App Store.
Apple has appealed a ruling that said it violated a prior injunction in a lawsuit that Epic filed in 2020.

In the latest series of Stacey Dooley Sleeps Over USA, the presenter visited the oldest legal brothel in Nevada, the Mustang Ranch, to explore the lives of sex workers in the States. But she has now revealed that her daughter came along for the visit, when she was just eight-months-old, joking 'it sounds like a comedy sketch'. Stacey recalled the story at the Hay Literary Festival in Wales, during a panel with journalist Emma Barnett, where she discussed how she juggled balancing motherhood and work. The broadcaster explained that she brings her little girl along with her for filming - including to the more unusual locations. According to The Telegraph, she admitted: 'There's nowhere that child hasn't been. When she was eight months we had this gig in the diary to go to the States to make a documentary about this legal brothel in Nevada. 'I'd sort of signed the contract and was like: "oh, she'll be eight months, that'll be fine." 'Anyway, the trip comes, and I'm nowhere near comfortable leaving her so I take my eight-month-old child to this brothel in Nevada. 'I have to ask the sheriff for special permission, because she's under 18. It sounds like a comedy sketch, but it's legit!' Stacey explained that she had to rent a trailer for Minnie to stay in with dad Kevin and that the little girl would watch out the window while she was filming. She hilariously recalled that when she returned to the trailer to breastfeed, the prostitutes at the brothel would greet her daughter with: 'Morning Miss Minnie!' The presenter quipped: 'I'm like: she'll be open minded if nothing else!'

Aug 3 (Reuters) - Union members who assemble Boeing's (BA.N), opens new tab fighter jets in the St. Louis area rejected the U.S. planemaker's latest contract offer on Sunday and will strike at midnight on Monday, the International Association of Machinists and Aerospace Workers union (IAM) said. "IAM District 837 members ... deserve a contract that reflects their skill, dedication, and the critical role they play in our nation's defense," the union's Business Representative Tom Boelling said. Boeing said it was ready for the action. "We are prepared for a strike and have fully implemented our contingency plan," Boeing Air Dominance vice president and general manager Dan Gillian said in an emailed statement to Reuters. "We're disappointed our employees in St. Louis rejected an offer that featured 40% average wage growth," he added. Boeing's original proposal included a 20% general wage increase over four years and a $5,000 ratification bonus, as well as more vacation time and sick leave. The union had rejected the offer, saying it was insufficient. Last week, Boeing sent a new contract offer to the union with some minor compensation changes that would benefit senior union members, according to the company. The offer also kept current overtime policies, which Boeing had proposed modifying in the last contract offer. The workers assemble Boeing's fighter jets and the MQ-25, an aerial refueling drone being developed for the U.S. Navy. Boeing's defense division is expanding manufacturing facilities in the St. Louis area for the new U.S. Air Force fighter, the F-47A, after it won the contract this year. The upcoming strike by the union, representing 3,200 employees, would be much smaller than the one Boeing was hit with last fall, when 33,000 machinists at Boeing's commercial plane division walked out for nearly two months. Jerry Jones has been called out by rapper Jay-Z and former Cowboys star Dez Bryant over 'comical' and 'disrespectful' comments he made on the mess involving Micah Parsons. Jones brought up 2015 negotiations with Bryant and Jay-Z's agency Roc Nation when discussing the furor surrounding Cowboys linebacker Parsons. Parsons this week requested a trade amid a tense contract standoff, releasing an explosive statement that put Jones and the Cowboys in the firing line once more. Among Parsons' claims was that his agent had been shut out of talks with Dallas. When asked why he doesn't want to deal with linebacker's representatives, Jones told the Fort Worth Star-Telegram: 'Because when we have a problem with the player, the agent is nowhere to be found. Jay-Z said that Dez would make all meetings. 'Jay-Z and I negotiated the contract, spent hours. He said, "Anybody in my organization is on time." He said, "My office used to be on the street corner, and I've always been early. So, they will be on time." 'And what did I say? I said, "I'm going to call you (when I have a problem)." Jones' comments sparked a furious response from Bryant, a former Cowboys receiver who threatened to reveal more damaging stories if the Dallas owner did not stop mentioning him. 'In 2015, at the 21 club, on a napkin, Jerry Jones, Juan Perez, Shawn "Jay-Z" Carter, and Stephen Jones negotiated a five-year, $70milllion deal, which included a $45m guarantee and a $20m signing bonus for Dez Bryant,' it read. 'At the time, it was the second-largest contract for a wide receiver in NFL history. The claim that Mr. Carter or Roc Nation representatives did not return a call from Jerry Jones.
