‘Can't expect complainant to look at watch when he is assaulted': Mumbai court convicts man of murder of neighbour's friend in 2019

A sessions court in Mumbai Tuesday found a man guilty of assaulting his neighbour and murdering another man over suspicions that the neighbour's complaint led to the demolition of his house by the civic body. The court also convicted an accomplice of the man during the fatal fight while acquitting two others.
According to submissions made before the court by Additional Public Prosecutor Ashwini Rayakar, in 2019, the house of the accused, Siddhesh Dagale, in the eastern suburb of Mulund was demolished by officials of the civic body. Suspecting that this was done on the complaint of his neighbour, Vinayak Mahadeshwar, Dagale decided to confront him.
On April 24, 2019, Dagale went to Mahadeshwar's house, and a fight took place between them, with their respective friends joining in, as per the prosecution. The police claimed that a man named Dynanesh Gurav died in the fight. Mahadeshwar, the complainant in the case, suffered a fracture.
Dagale claimed innocence and blamed the death on delayed medical treatment and questioned why the FIR was filed only the next day. He alleged that there was a discrepancy in the time of the incident recorded by the police and the complainant.
'One cannot expect the complainant to be aware of the time and look at watch when he is assaulted and is in trauma of assault and more trauma on the fact that one of his friend(s) is lying unconscious nearby with his fate not known of (to) either of them. In such circumstances, (the) absence of (a) lack of time disclosed by (the) complainant does not imply adversity but in fact confirms (the) mindset of (the) complainant to be anxious and traumatic which corroborates case of prosecution,' the court said.
The court found no evidence against two others booked but convicted Dagale and his friend Suraj Salve alias Bhurji, on charges including sections 302 (murder) and 326 (causing grievous hurt) of the Indian Penal Code (IPC).
The accused sought to defend themselves by claiming that the incident was not a planned attack, but a sudden fight with no intention of murder. The court, however, said the victims were attacked with heavy logs of wood, multiple times, which was enough to cause death.
'Entire evidence does not show that Dnyanesh was one of the person(s) who was fighting i.e. (the) deceased had not fought with either
of the accused. He had no enmity with either of the accused. He merely intervened to save the complainant. There is nothing to indicate that he did any act to show that he was having fight with the accused,' the court said.

Bazad was found guilty of extorting a bribe of Rs 5 lakh in exchange for defreezing the bank account of a finance firm under ED investigation for links to Chinese loan apps. 'While awarding the sentence, this court should bear in mind the expectations of society to prevent corruption in public office by providing prompt conviction and stern sentence,' observed Judge Manjunath Sangreshi, Principal Special Judge for CBI Cases. At the time of sentencing, Bazad was serving as an inspector in GST and Central Excise, Chennai Zone. The CBI had filed a charge sheet against him under Section 384 of the IPC and Section 7 of the Prevention of Corruption Act. According to the CBI, on January 20 and 28, 2021, Mikhil Innani, Managing Director and CEO of M/s Apollo Finvest India Ltd., along with Diksha and Harish Innani, visited the ED office in Bengaluru. During this time, Bazad allegedly demanded Rs 50 lakh from Mikhil to close the case against Apollo Finvest. He also threatened to drag the case for at least 10 years and ruin the company's name and business if the amount was not paid. Eventually, Bazad managed to extort Rs 5 lakh, which was delivered by Manavendra Bhati on the night of February 9, 2021, at a pub in J.P. Nagar. The transaction was captured on CCTV.

A 70-year-old man convicted in the 1999 murders of his two minor daughters and the attempted murder of a third was arrested on Friday after evading custody for four years, the Delhi Police said. The man, identified by police as Hamidullah Bundu Khan, a former resident of Old Mustafabad in northeast Delhi, was located and arrested by the Crime Branch at his residence in Loni, Ghaziabad. Authorities said he had been granted parole while serving a 20-year sentence and subsequently absconded. 'After sustained intelligence gathering, the team successfully apprehended the convict, despite his repeated attempts to evade capture by frequently changing his hideouts,' said Deputy Commissioner of Police (Crime Branch) Aditya Gautam. He added that the arrest was made possible through a combination of technical surveillance, human intelligence, and specific leads. According to police, the case dates back to July 30, 1999, when Khan's eldest daughter reported to the Gokulpuri police station that her father had attempted to poison her and her two younger sisters the previous night. She told officers that Khan had returned home around 10.30 pm on July 29 and given each of his daughters a capsule, claiming it would help with a stomach ailment. The capsules, she described, were blue on the outside and white on the inside. The eldest daughter told police that when she questioned her father, saying she alone had stomach pain, he insisted all three girls take the medicine. Suspecting something was wrong, she pretended to ingest the capsule but hid it under her tongue. She told police she then saw her father forcibly administer the capsules to her younger sisters. The two younger children collapsed shortly after, displaying poisoning symptoms, including labored breathing and frothing at the mouth, according to the police report. The eldest daughter said she ran to alert neighbours, but by the time they returned to the house, Khan had fled. All three children were taken to a hospital, where the two younger girls were pronounced dead. The eldest daughter also exhibited symptoms but survived. Khan was arrested the following day, July 31, 1999, and later convicted under Sections 302 (murder), 307 (attempt to murder), and 328 (causing hurt by means of poison) of the Indian Penal Code. He was sentenced to 20 years of rigorous imprisonment. Police said that after being released on parole four years ago, Khan failed to return and remained untraceable, avoiding known contacts and frequently changing his location.

CHENNAI: A special court for Pocso cases in Chengalpattu on Friday sentenced a 53-year-old man to 20 years of rigorous imprisonment for raping a seven-year-old girl. The convict was identified as M Balaji, a resident of Vijayanagaram in Pallikaranai. The court found Balaji guilty on three charges and sentenced him to 20 years and imposed a fine of Rs 3,000. Additionally, a compensation of Rs 4 lakh was awarded to the victim. The crime took place on December 14, 2022, when the victim's mother was not at home. Balaji was booked under the Pocso Act and IPC for aggravated penetrative assault based on a complaint filed by the victim's mother. The Selaiyur All Women Police station investigated the case and arrested the accused.
