DUP assembly member Phillip Brett submitted a written question at Stormont two weeks ago 'to ask the minister for the economy whether her department has any plans to remove students from the Irish Republic from the university student cap'.
Sinn Féin economy minister Caoimhe Archibald, whose remit includes third-level education, responded last week that 'improving student mobility remains a priority for me and I am committed to removing barriers for people from here who want to study in the South and vice versa. Removing southern students from the number cap by increasing fees would not support this aim'.

Undergraduate fees have a statutory maximum across the UK of £9,535 (€11,082) a year. Local students in Northern Ireland pay £4,855 because Stormont has chosen to subsidise the difference. To keep this subsidy under control, Stormont caps the number of places for local students.

The cap is a disaster, preventing growth for the sake of a counterproductive giveaway. One-third of students from Northern Ireland who want a local place are unable to get one, forcing them to study in Britain, where they have to pay the maximum fee anyway. They might as well have paid it to stay at home – but then Stormont could not congratulate itself on its generosity.
Students from the Republic are treated as local students throughout the UK under the terms of the Common Travel Area. When studying in Northern Ireland, they apply for capped places and pay the £4,855 (€5,681) fee, which they can borrow from the UK's government-owned loan company. Students from Britain pay the full UK fee in Northern Ireland and hence are outside the cap. They, and students from abroad, have become the only hope of university expansion in the region.
So when the DUP asked about moving students from the Republic outside the cap, it was opening the door to significantly increasing their numbers.
Sinn Féin's refusal assumed paying full fees would have the opposite effect, deterring applicants from the Republic.
Of course, there is a constitutional subtext for both parties. More cross-Border students and identical treatment of northern and southern students are matters of great importance to Sinn Féin. The DUP is only interested in southern students as a source of revenue and growth, although this is not a hostile stance – it takes the same view on students from Britain.

Whatever view anyone takes on this is largely irrelevant in practice, as Britain and the Republic each contribute just 2,000 students, or 3 per cent of total enrolment at Northern Ireland's universities. Numbers from the south have tripled this decade, but from an absurdly low base.
Perhaps the difference in fees is a fairly small part of the story, especially as it can be borrowed on excellent terms.
Students from further afield might be more attracted to Northern Ireland if its third-level sector was simply larger, offering more choice and suffering from less of a perception of provincialism. Students from the Republic are twice as likely to study in England as in Northern Ireland, despite having to pay twice as much.
As the current system is not working well for anyone, there is little to lose by trying different approaches.
If southern students were moved outside the cap, northern universities would immediately have 2,000 more local places, plus a motivation to grow by increasing their appeal to southern students. Universities currently have no such motivation and put in the effort to match. It is far from certain that raising fees for southern students would cancel this out. Stormont could at least make a serious attempt to model various scenarios.
Full UK fees might not have to be charged to expand certain courses, for example. The Irish Government might provide some assistance, although the €1,000 rise in contribution fees in the Republic suggests the moment to ask may have passed.

Sinn Féin is objecting to higher fees in the south, and will almost certainly never agree to them in the north. If it took a step back from this populist grandstanding, it might see its objectives clash. Identical treatment of northern and southern students may be hampering cross-Border mobility by limiting northern places.
If the number of southern students in the north did increase significantly under the current system, they would be displacing Sinn Féin's northern constituents, which could prove highly unpopular.
Northern Ireland's universities want fees for everyone to rise to the UK maximum, rendering the cap unnecessary and unleashing the sector's growth potential. Stormont is ignoring their increasingly urgent pleas. Southern students could help test the waters for a badly-needed policy that otherwise has little chance of being delivered.

Eir seeks £67m in damages from rival BT relating to dispute over NI public sector contract
Irish telecoms giant Eir was kept 'unlawfully in the dark' by its rival BT when tendering for the biggest public sector contract in Northern Ireland, the High Court in London has heard. On the opening day of the hearing, in which Dublin-based Eir is seeking damages from BT of £67 million (€78 million), the background to the long-running dispute was outlined, with Eir's barrister arguing that BT had a 'wealth' of secret information that led to it winning the £400 million contract in 2018. 'Eir went from being one of Northern Ireland's largest public sector players to being marginalised completely from the market ... and BT effectively stepping into their shoes in what was a role reversal,' Eir's barrister, Robert O'Donoghue, KC, said on Thursday. The tender process for the lucrative nine-year Northern Ireland Public Sector Shared Network (NIPSSN) contract ran between April 2016 and March 2018. In 2020, Ofcom, the UK telecoms regulator, fined BT £6.3 million for unlawful anticompetitive practices during the procurement process. During his opening submission, Mr O'Donoghue referenced the Ofcom ruling and 'turbocharged' legal obligations it had previously placed on BT to ensure a level playing field for its competitors. 'Interestingly and prophetically BT objected to this additional obligation at the time,' he told the court. Eir, which is controlled by the French billionaire Xavier Niel, claims that Openreach (the network arm of BT) discriminated against it by failing to provide it with key information on costs and BT's fibre-to-the-premises on-demand product (FOD). BT and Eir were the only two bidders for the contract. For BT to portray its bid team as 'mavericks' in using FOD was 'self-serving nonsense', claimed Mr O'Donoghue, as the product 'is just another type of fibre that has been around many years'. 'The issue was that BT made it difficult to get a handle on costs ... Eir were kept unlawfully in the dark while BT had access to secret information on costs ... and the notion that the BT bid team had uniquely stumbled across some Holy Grail or secret source of FOD is obviously untrue.' The case is listed to run for four weeks. Some 14 witnesses, a 'considerable quantity' of expert material and complex technical background will be detailed, the court heard. 'It must be like staring at the foothills of the Matterhorn at the start of a climb,' Mr O'Donoghue told Judge Adam Johnson. 'But we submit that the points of this case are not actually that complicated, and to a material extent, not actually in dispute. 'The long and the short of it is, that everything matters, is admitted by BT. The starting point is that BT admitted the infringements to Ofcom.' The case continues.

Government urged to ‘get its act together' over third-level fees plan
The Government has been urged to 'get its act together' and level with parents and students on how much college fees will be in the new academic year. Minister for Finance Paschal Donohoe became the latest minister to refuse to confirm Government plans over third-level fees. The student contribution fee has been temporarily reduced for the past three years as part of cost-of-living packages accompanying the budget. The fees had been €3,000 before being temporarily cut by €1,000, saving families with multiple children at third level thousands of euros per academic year. Social Democrats TD Jennifer Whitmore told the Dail that students and families have been 'led down the garden path' by the Government and they are 'absolutely sick of its games'. Earlier this week, Higher Education Minister James Lawless said that student contribution fees will increase as there is no cost-of-living package to pay for what were temporary reductions introduced amid an inflation crisis. He said that fees will have to be reset, which means they will revert to the same level as previous years. He added that 'all of us in any walk of life have to play the hands we're dealt'. Ms Whitmore described these comments as 'utterly galling and incredibly tone deaf'. 'When will the Government get its act together and level with parents and students?' the Wicklow TD added. 'It has been five days since the higher education minister took to the airways and dropped the bombshell that parents and students will have to find another 1,000 euro to fund college before September. 'He did not try to sugarcoat that news — it was quite the opposite. Jamie Bryson and Daithí McKay cleared in Northern Ireland Nama misconduct trial
THREE MEN, INCLUDING loyalist activist Jamie Bryson and former Sinn Féin MLA Daithí McKay, have been cleared at Belfast Crown Court of charges relating to misconduct in public office. Bryson, 35, from Rosepark in Donaghadee, and co-accused Thomas O'Hara, 41, from Lisnahunshin Road in Cullybackey, were found not guilty of conspiracy to commit misconduct in public office. The charges had related to a Stormont committee hearing that examined the sale of the National Asset Management Agency's (Nama) Northern Ireland assets in 2015. McKay, 43, from Loughan Road in Dunnamanagh – who was chairman of the finance committee at the time – was found not guilty of misconduct in public office. Bryson and McKay said there are now questions for the Public Prosecution Service (PPS) over why the prosecution was brought. The PPS has said the available evidence had indicated it was in the public interest to prosecute. Trial judge Gordon Kerr KC said he believed Bryson had lied while giving evidence in the case, but said he was not involved in a criminal conspiracy. The long-running Nama trial had related to Bryson's 2015 appearance before the Stormont committee, chaired by McKay, which was investigating the sale of Nama's Northern Ireland assets to a US investment fund. The criminal probe was launched after the publication of leaked Twitter messages between Bryson, McKay and the account of O'Hara, who at the time was a Sinn Fein activist in north Antrim. McKay quit as an MLA within hours of the Twitter messages being published in August 2016. The Stormont Finance Committee inquiry was set up in 2015 amid political controversy over the multimillion-pound sale of Nama's property portfolio. Advertisement Nama, the so-called bad bank created by the Irish government to deal with the toxic loans of bailed-out lenders during the economic crash, sold its 800 Northern Ireland-linked properties to investment fund Cerberus for £1.2 billion. Giving evidence to the committee in 2015, Bryson used Assembly privilege to name former DUP leader Peter Robinson as a beneficiary of the sale. The then-first minister of Northern Ireland strongly rejected any suggestion he benefited from the deal. All other parties involved in the transaction also denied wrongdoing. Delivering his judgment in the non-jury trial today, the judge said: 'Despite his lies in court, I am sure that Bryson was at all times communicating with McKay. 'I am sure that the communications were designed to give Bryson the best advice and guidance to maximise his chances of giving evidence. 'My analysis of the messages do not show any occasion where McKay undertook to say or do anything outside his duties as chairman to ensure Bryson's evidence would be in open session. 'Clearing Bryson, the judge said the evidence did not establish there had been a criminal conspiracy between him and McKay. He said: 'In the absence of an agreement, the conspiracy charge must fail.' Turning to McKay, the judge said there was 'no doubt he deliberately misled the committee to ease the way for Bryson's presentation'. The judge pointed out the Assembly had its own code of conduct and said there was 'no precedent for a prosecution in these circumstances'. Clearing McKay, he added: 'I do not consider it my role to expand the offence.' The judge said the evidence against O'Hara 'fell well short' of anything which would convince him of his guilt.
