Governor's sanction required to take cognisance against CM: court

The Hindua day ago
The prosecution sanction from the Governor is required for a court to take cognisance against the Chief Minister in an alleged offence of abetment, the Chief Judicial Magistrate, Ernakulam, has said.
The court made the observation while considering a petition filed by Muhammad Shiyas, president of the Ernakulam District Congress Committee, seeking the registration of a case against Chief Minister Pinarayi Vijayan for abetment of violence.
The judge noted that the complainant must obtain prosecution sanction from the Governor for the court to take cognisance of the alleged offence.
In his complaint, Mr. Shiyas alleged that the Chief Minister abetted DFYI activists in unleashing violence against Congress and Youth Congress workers during the 'Navakerala Sadas' undertaken by the State Cabinet, which covered all 140 Assembly constituencies in the State. He pointed out that the Chief Minister had claimed the DFYI activists were carrying out a 'rescue mission' by removing Youth Congress workers protesting in front of the bus carrying him and his Cabinet colleagues. The statement of Mr. Vijayan amounted to abetment, he alleged.
The court posted the case for November 1.

MPs to jointly push for central fin aid

T'puram: The state will move forward with legislation to address the rising human-wildlife conflict, the state govt informed MPs at a high-level meeting convened by chief minister Pinarayi Vijayan on Friday. A draft bill is currently under consideration by the state's law department, it was revealed in the meeting. The MPs' conference, held ahead of the upcoming monsoon session of Parliament, deliberated on a range of pressing issues concerning the state from disaster relief and infrastructure development to financial concerns and environmental conservation. A key decision at the meeting was to take a united stand for the approval of central financial assistance based on the Post-Disaster Need Assessment submitted by the state. The assessment seeks Rs 2,221.10cr for Meppadi in Wayanad district and Rs 98.10cr for Vilangad in Kozhikode, both severely affected by past natural calamities. The MPs also agreed to jointly press the Centre to reinstate Section 13 of the Disaster Management Act, which was previously removed, and to seek urgent amendments to Section 11 of the Wildlife Protection Act. These changes would empower state govts to grant region-specific relaxations based on local needs and help secure central compensation for wildlife-related damages. On railway development, the CM urged the MPs to follow up on the memorandum he had submitted directly to the Union Railways minister. Specific demands include approval for the Thalassery–Mysuru and Nilambur–Nanjangud rail lines, a new line from Kanhangad–Panathur–Kaniyur, advancement of the Angamaly–Erumeli–Sabarimala railway project, and sanctioning of third and fourth railway lines in the state. The CM also called for allocation of funds to extend the Kochi Metro from SN Junction to Tripunithura Metro station. Vijayan underlined the need for coordinated intervention of MPs on financial matters. He flagged the reduction in Kerala's borrowing limit under the guarantee redemption fund, the Rs 965cr shortfall in IGST settlement, and the need to raise the borrowing ceiling to 3.5% of the state's GSDP. He urged the Centre to exempt loans taken by KIIFB and the state pension company from the borrowing cap and allow additional borrowing equivalent to the state's share in the Jal Jeevan Mission outside the current borrowing limit. The meeting also discussed proposals to link the Global City component with the GIFT City (Global Industrial Finance and Trade City) initiative and to seek timely central support for completing connectivity infrastructure. The MPs agreed on the importance of securing viability gap funding for the establishment of logistics parks under the Kochi–Bengaluru industrial corridor. Health-related demands raised at the meeting included the need to expedite the allotment of an AIIMS in Kerala, increase the premium under the Vay Vandana Yojana pension scheme and release the arrears due to the state under the National Health Mission. There was also a demand to grant official health worker status to ASHAs, who form the backbone of the state's community health system. Other crucial issues discussed included retaining the BrahMos missile production facility in Kerala, granting 'point of call' clearance to foreign airlines operating out of Kannur International Airport and the ongoing development of national highways across the state. The MPs also sought upgrades for the Kottapuram–Kozhikode stretch of National Waterway-3, declared as an extension of the national waterway, to meet national standards.

The meeting also stressed the need to put up a joint intervention to restore Section 13 removed from the National Disaster Management Act. Similarly, the meeting decided to request an immediate amendment to the law that empowers State governments to provide relief in the matters stipulated in Section 11 of the Wildlife Protection Act, taking into account the local needs. As a follow-up to the memorandum, the Chief Minister requested the MPs to bring projects like the Thalassery-Wayanad-Mysuru rail line, Nilambur-Nanjangud rail project, Kanhangad-Panathur-Kaniyur railway line, Angamaly-Erumely-Sabari railway line, and the allocation of funds for the extension of the Kochi Metro from SN Junction to Thripunithura Metro Station to the attention of the Union government. Financial issues The meeting decided to make necessary interventions in financial issues such as cutting the borrowing limit of the State as per the provisions of the Guarantee Redemption Fund, cutting the Integrated Goods and Services Tax (IGST) by ₹965 crore, raising the State's borrowing limit to 3.5%, exempting loans taken by the Kerala Infrastructure Investment Fund Board (KIIFB) and Pension Company from the borrowing limit etc. The meeting also agreed to take steps to seek timely Central support in providing viability gap funds for setting up logistics parks and completing connectivity infrastructure. The delay in allocating the All India Institute of Medical Sciences (AIIMS) in Kerala, the demand to convert the post of Accredited Social Health Activists as health workers, maintaining the Brahmos project in the State, providing a 'point of call' status for foreign airlines to operate services from the Kannur airport, development of national highways in the State, upgrading the waterway from Kottapuram to Kozhikode, which has been declared as an extension of National Waterway-3, to national standards and the construction of seawalls for coastal protection were also discussed in the meeting. Along with the construction of a seawall, action should be taken on the various proposals submitted to the Union government to protect the lives and property of fishers on the Kerala coast. The meeting decided to jointly coordinate steps to be taken in allocating more food grains to the State under the tide-over allocation. The meeting also decided to register the State's protest against the proposed Indo-U.S. Free Trade Agreement (FTA) and tasked the Chief Minister to send a letter to the Prime Minister in this regard.
