The David Seymour ‘bots' debate: Do online submission tools help or hurt democracy?

A discussion document on a Regulatory Standards Bill is not, on the face of it, the sort of thing that might have been expected to prompt 23,000 responses.
But in an age of digital democracy, the Ministry for Regulation was probably expecting it.
The bill
, led by ACT Party leader David Seymour, is controversial. It sparked a response from activists, who used online tools to help people make their opposition known. Of the 23,000 submissions, 88 percent were opposed.
Seymour this week told RNZ's
30 with Guyon Espiner
, that figure reflected
"bots" generating "fake" submissions.
He did not provide evidence for the claim and later explained he wasn't referring to literal bots but to "online campaigns" that generate "non-representative samples" that don't reflect public opinion.
Seymour has previous experience with this sort of thing. The Treaty Principles Bill got a
record 300,000 submissions
when it was considered by the Justice Committee earlier this year.
Is Seymour right to have raised concerns about how these tools are affecting public debate? Or are they a boon for democracy?
Submission tools are commonly used by advocacy groups to mobilise public input during the select committee process.
The online tools often offer a template for users to fill out or suggested wording that can be edited or submitted as is. Each submission is usually still sent by the individual.

said submitting to Parliament used to be "pretty difficult".
"You'd have to write a letter and things like that. What the tools do allow is for people to very easily and quickly make their voice heard."
The tools being used now are part of sophisticated marketing campaigns, Williams said.
"You do get pressure groups that take particular interest, and it blows out the numbers, but that doesn't mean that officials should be ruling them out or refusing to engage or read submissions."
The Taxpayers' Union has created submission tools in the past, but Williams said he isn't in favour of tools that don't allow the submitter to alter the submission.
He has encouraged supporters to change the contents of the submission to ensure it is original.
"The ones that we are pretty suspicious of is when it doesn't allow the end user to actually change the submission, and in effect, it just operates like a petition, which I don't think quite has the same democratic value."
Clerk of the House of Representatives David Wilson said campaigns that see thousands of similar submissions on proposed legislation are not new, they've just taken a different form.
"It's happened for many, many years. It used to be photocopied forms. Now, often it's things online that you can fill out. And there's nothing wrong with doing that. It's a legitimate submission."
However, Wilson pointed out that identical responses would likely be grouped by the select committee and treated as one submission.
"The purpose of the select committee calling for public submissions is so that the members of the committee can better inform themselves about the issues. They're looking at the bill, thinking about whether it needs to be amended or whether it should pass. So if they receive the same view from hundreds of people, they will know that."
But that isn't to say those submissions are discredited, Wilson said.
"For example, the committee staff would say, you've received 10,000 submissions that all look exactly like this. So members will know how many there were and what they said. But I don't know if there's any point in all of the members individually reading the same thing that many times."

But Williams said there were risks in treating similar submissions created using 'tools' as one submission.
"Treating those ones as if they are all identical is not just wrong, it's actually undemocratic," he said.
"It's been really concerning that, under the current parliament, they are trying to carte blanche, reject people's submissions, because a lot of them are similar."
AI should be used to analyse submissions and identify the unique points.
"Because if people are going to take the time and make a submission to Parliament, at the very least, the officials should be reading them or having them summarised," Williams said.
Labour MP Duncan Webb is a member of the Justice Committee and sat in on oral submissions for the Treaty Principles Bill. He said he attempted to read as many submissions as possible.
"When you get a stock submission, which is a body of text that is identical and it's just been clicked and dragged, then you don't have to read them all, because you just know that there are 500 people who think exactly the same thing," he said.
"But when you get 500 postcards, which each have three handwritten sentences on them, they may all have the same theme, they may all be from a particular organisation, but the individual thoughts that have been individually expressed. So you can't kind of categorise it as just one size fits all. You've got to take every single case on its merits."
Webb said he takes the select committee process very seriously.
"The thing that struck me was, sure, you read a lot [of submissions] which are repetitive, but then all of a sudden you come across one which actually changes the way you think about the problem in front of you.
"To kind of dismiss that as just one of a pile from this organisation is actually denying someone who's got an important point to make, their voice in the democratic process."

More may stand before the four week cut-off but candidates are competing for an uncertain prize. Like almost all Māori wards, New Plymouth District Council's newest seat might be pulled from under the victor after three years, via a government-ordered referendum at October's election. He sits on Taranaki Regional Council's Policy and Planning Committee and South Taranaki District Council's Te Kāhui Matauraura. Moeahu said several New Plymouth councillors who had become experienced with iwi and hapū aspirations are stepping down, leaving him worried about candidates from right-wing ratepayer groups and the Act Party. "That's why I'm throwing my hat in the ring," he said. "If this is the last term for the Māori ward I want to be there and face up to whoever they chuck at us." Moeahu wants a specific win: the return of land taken from Puketapu hapū in 1968, with no record of compensation. Youth MP wants to see Pasifika voices in politics amplified

Photo: Facebook / Lemauga Lydia Sosene Māngere Youth MP Marques Tominiko has returned home from Parliament feeling proud of how he represented his people, but he also thinks that South Auckland remains under the radar. "I feel like I represented my community to the best of my ability, and I just feel very proud at this moment," Tominiko said. The 16-year-old admitted that it was intimidating to be surrounded by young people from bigger electorates, places with established political histories and strong connections. But Tominiko stood firm, wearing his ie faitaga and ulafala through the halls of Parliament, making a distinct impression among the suits and Western attire. After participating in debates and questioning ministers, Tominiko said the experience was powerful and frustrating, reflecting the promise and persistent gaps for Pasifika youth in politics. "Something that I wanted to make sure of whilst I was at Parliament was that I didn't come as an individual," he says. "I came as the representative of not only my MP, the Honourable Lemauga Lydia Sosene, but also my Māngere community, the voices of Māngere youth, Pasifika as a whole, and South Auckland. "Walking around, people would ask me where I'm from, and when I said South Auckland, Māngere, they'd ask, 'Where's that?' It shows we're still unknown and underrepresented." Despite New Zealand having its most diverse Parliament to date, Tominiko said Pasifika priorities remained low on the agenda, and young people were increasingly frustrated by being excluded from decisions that directly affect them. Marques said some argued these should be scrapped in the name of "equality" but that ignored the reality for many Māori and Pasifika families. "Yes, we have more Pasifika MPs, and even our Deputy Prime Minister is Pasifika, but we're still unseen and unheard. Our priorities aren't high on the list for this government. "It's not about equality. It's about equity. Look at the stats: Māori and Pasifika are at the bottom for NCEA pass rates, retention and university entry. These scholarships exist to give us opportunities we're not given otherwise." Manukau Ward Councillor Lotu Fuli agreed, supporting Tominiko's stance. "I believe in scholarships for Māori and Pasifika. The whole point of such scholarships is to address the inequities that exist to try to even up the playing field. If we get to a stage as a society where those inequities no longer exist, then the need for such scholarships will go." Tasi Poumale, McAuley High School teacher and community leader, said ethnic scholarships could help break barriers and that visible role models are equally important. Poumale suggested that councils should prioritise civic education to encourage more young Pasifika people to vote, engage, and raise their voices. "Our Pacific students need to see Pacific role models in those leadership spaces. Education is access to a lot of opportunities ... ethnic scholarships are equitable because not every family has the same resources. "Council should be going into schools, especially year 11, 12, 13, running workshops ... If they go in and educate and encourage, then our rangatahi will have more exposure and opportunity to participate." Photo: LDR / PMN News / Joseph Safiti Associate Education Minister Barbara Edmonds said Youth Parliament's handling of challenging issues showed the importance of allowing young people to speak truthfully, without fear of censorship. She hoped for the growing number of Pasifika youth MPs this year, but said that the government must allow them to speak openly. "The whole point of Youth Parliament is to give young people and rangatahi a chance to be heard. The issue of censoring their speeches so they don't criticise the government goes against the spirit of this. Youth MPs should feel safe to say what they think and not let anyone force them to think any other way. "What was pleasing to see was so many young Pasifika Youth MPs come to Parliament. Their engagement and speeches were outstanding. It gives me so much hope for this next generation I think they could have done an even more important job if their speeches weren't vetted and they weren't told not to criticise." For Tominiko, the experience reinforced his belief that Pasifika youth must become comfortable with discomfort to claim their rightful place, even when politics felt unsafe. "Politics is not safe for Pasifika youth right now," he says. "But by getting into those spaces where we're not welcome, we can make them safe. Le Posh: French bakers Veronica and Didier Crevecoeur vanish leaving unpaid bills

Photo: NZME / Tracy Neal A couple who arrived in New Zealand and set up a French patisserie cut a swath of deceit before leaving the country suddenly. Tracy Neal explores the legacy left by French bakers Veronica and Didier Crevecoeur, whose victims are reeling in their wake. The crepes, gateaux, croissants and eclairs were once the talk of the town. But the couple behind the sweet French fare turned out to be a recipe for disaster for some landlords and businesses in the top of the South Island. They've been left shouldering debts left by Veronica and Didier Crevecoeur who, as it turned out, had a habit of not delivering on promises to pay their bills. They arrived in New Zealand around 2018 and were believed to have left this year, about the same time legal action against them was triggered over debt on a commercial lease. Inquiries by NZME since the court case in June have lifted the lid on a couple who some knew as "friendly", even "quiet and nice", and who brought a little taste of France to Picton, Blenheim and Nelson. "We could have been in Paris," said one neighbour of Le Posh patisserie in Nelson, who loved the aroma of pain au chocolat fresh from the oven, and coffee from a nearby roastery wafting through his house. But some landlords in the top of the South Island had a different view of the Crevecoeurs. One commercial property owner in Blenheim claimed they were "the worst tenants" he had ever known. "I'm 75 years old now and I've been in business since I was 19, and I've never struck anyone like them." The North Island-based businessman and director of an estate management firm says he was forced to evict the pair. "In the end I didn't give a s**t about the unpaid rent, I was just pleased to see the back end of them," he said. The owner of commercial premises in Picton where the Crevecouers launched the first of what would be four patisseries named Le Posh, said that despite the "wildly expensive" but "quite good" food they had on offer, they often had an excuse about why they couldn't pay rent, leases, or invoices on time, if at all. She ended up locking them out, and waved goodbye to around $3000 in unpaid rent, angry they had not only ripped her off, but allegedly done it to others as well. Then there was the owner of a home the Crevecoeurs once rented in Nelson, who says they struggled to get rent paid on time. "There was always a story about where money was coming from." Another Nelson business left out of pocket for vehicle maintenance and repair work said at first the couple paid, accompanied with free baguettes, but that soon changed and the debt grew. An Auckland property investment firm owed thousands for unpaid rent on commercial premises in Nelson claimed the couple were masters of deceit. "We are not novices at this, and we were taken in," a director of the company said. The Crevecoeurs also left a Marlborough homeowner $1000 out of pocket in rent owed on a beachfront home in Rārangi. A decision by the Tenancy Tribunal in December 2019 showed the landlord had applied for termination of the tenancy, rent arrears and refund of the bond. The Crevecoeurs were ordered to pay $1020 in rent arrears, but the Herald has been unable to determine if that money was ever paid. According to NZ Company Office records, the couple registered a company named Gazillions Limited, in July 2020 but it was removed a little under two years later. The company was classified as "internet only retailing" with a registered office in Blenheim. The couple moved to Nelson around 2021 and set up a patisserie by the same name. Le Posh, on the corner of Russell St and Haven Rd near Port Nelson, opened to media fanfare in January 2022. The Crevecoeurs told Stuff at the time they had "moved from Blenheim when the opportunity arose". They had planned to return to Australia to be closer to their children, but efforts were "stymied by the pandemic". They said Nelson was a "better fit" for their European flavours and fare. "They appreciate us being here. More people are happy to have a French patisserie," Veronica Crevecoeur said at the time. They then opened another Le Posh in Nelson, in a residential apartment and retail complex near Tāhunanui Beach, but that's where the New Zealand chapter to their story ended. In the Nelson District Court in June, the couple were ordered to pay more than $29,000 in unpaid rent, damages and legal costs. They didn't turn up to court, but the Crevecoeurs' son Alex, who responded to NZME's requests to several family members via social media, said that, sadly, it was likely "the tip of the iceberg". The property investment firm, Tawero Holdings (No2) Ltd, from whom the Crevecoeurs leased the second Nelson premises in November 2022, filed court action when they abandoned the lease. "They said they were going to retire and live half their time here and half overseas," one of the workers at a neighbouring cafe told NZME. According to the statement of claim filed by Tawero with the court, the couple took out a three-year lease on the second shop with an annual rent set of $20,000 (plus GST). They left owing $13,175 in rent and outgoings. Tawero Holdings sought, and was granted, a summary judgment of $22,547 against the Crevecoeurs, plus several thousand more in costs associated with re-letting the premises, plus damages. A summary judgment application allows a court to resolve a case without a full trial when the defendant had no genuine arguable defence. Judge Noel Sainsbury said in making the order the underlying basis was that the defendant had defaulted on the rent on premises leased to them by the plaintiff. "Clearly, the defendants have no defence to the claim," he said. A spokesperson for Tawero, who did not want to be named, told NZME taking legal action was a decision not made lightly but "a lot of deception" had been at play. "We are not novices at this, and we were taken in." He said the climate had been challenging post-Covid for tenants and landlords, but when people took advantage of others and were deceitful, it made it more difficult. "We were let down and lied to. "We just felt that in these circumstances, sometimes you have to take this sort of action to prevent these things from being perpetuated." The judgment granted included rent that hadn't been paid and outgoings, plus a damages claim for the costs associated with the early termination of the lease held by the Crevecoeurs, and the subsequent re-letting of the premises. They were also ordered to pay legal costs and disbursements of $6850 and interest of 12 percent per year on any non-payment. Tawero also sought indemnity costs, on the basis the Crevecoeurs had "promised to pay, but had left", but such costs were not normally granted, Judge Sainsbury said. Photo: NZME / supplied Inquiries by NZME into the whereabouts of the Crevecoeurs have failed to pinpoint their location. Efforts have been made to reach them via email addresses that appear to still be active, and via their social media accounts. "Commonsense" would suggest where they were, their son Alex told NZME. There were suggestions they were back in Australia, while Judge Sainsbury said in court he believed they were in Europe - possibly in France, where Didier is from. Many who NZME spoke with referred to an online site about the Crevecoeurs. The site, set up by someone on Cloudflare, which offered multiple security layers, said it was intended as a "public service warning" and that all information provided was based on reports from affected individuals. The site claimed the Crevecoeurs were back in Perth with family, and "likely continuing similar schemes", having suddenly left New Zealand earlier this year, leaving debts with "multiple businesses". It speculates they were "probably" looking to relocate to France, near Dieppe, where Didier Crevecoeur is from. The site said Veronica Crevecoeur, 66, grew up in Paris, and that Didier was a chef in various big hotels, and ran restaurants and bakeries in various locations. Few in the tight-knit business communities of Nelson and Marlborough wanted to talk about it, mostly out of embarrassment, but NZME has heard some of the stories Veronica Crevecoeur allegedly cooked up to gain people's sympathy. Others claim they dished out personal loans and haven't seen a cent in return. The woman whose commercial premises the Crevecoeurs leased in Picton soon after they arrived from Australia in about 2018, was initially thrilled. "I was excited when they approached me. Here were people who wanted to start a lovely French cafe." She said the food they made was good, but "grossly expensive". The property owner "turned the key on them" over their failure to pay rent, just before the Covid lockdown in March 2020. "They'd been there about 18 months, and I had to chase them the whole time for rent. Didier always played the 'totally surprised' game, always saying, 'I didn't know'." They left, and took the Le Posh signs, which then popped up in Nelson. "I think they just carted the signage around with them," the Picton property owner said. She believed the Crevecoeurs had operated businesses in Perth and Cairns. Australian business records showed Didier Crevecoeur operated Paris Crepes Cafe in Western Australia from December 2012 until April 2016. Information online showed two businesses by the same name in Western Australia - one in the High Street Mall in Fremantle, and the other in Subiaco. However, the owners of the buildings where the two businesses operated said they had not heard of the Crevecoeurs. The premises on the corner of Nelson's Russell St and Haven Rd, where the initial Nelson Le Posh sprung up, are now up for sale. There's a sad collection of baking tins, tools and furniture stacked up against the window of the worn-looking building. NZ Companies Office records showed the building was owned by Dharmendra Patel, who has so far failed to respond to NZME's requests for comment on whether he was owed rent. Robin Whalley, who had been a regular buyer of the pain au chocolat, was surprised they had gone so suddenly, and even more surprised when he learned why, when NZME called him. "We thought from the notice on the door they must have just gone for the weekend, and that they would be 'back soon', and then it never happened," Whalley said. The Nelson business, left out of pocket for work done on the Crevecoeurs' car, said when the free baguettes dried up and the money due on invoice never arrived, their patience ran out. "I'd go over and be very polite about it, and she'd [Veronica] say, 'I promise you, I promise you, but don't push me,'" the business co-owner and office manager, Tania, claimed. She said the promises continued, that the money would arrive on a certain day. "In the end I said to him [Didier], 'how can you treat people like that'? "And he said, 'It's my wife, it's my wife'!" She said he once came over with a bottle of champagne but they still hadn't been paid. Alex Crevecoeur told NZME he was prepared to stand by his father, whom he painted as a broken man. "My father is only guilty by association as for reasons unknown to me, he let her [his mother] handle all business and financial matters." Tania agreed. She felt that Didier was "a bit caught out by her". "I think he was trying perhaps, but they're both culpable." - This story originally appeared in the New Zealand Herald
