
Meta, TikTok Can Be Sued By Mother Of New York Teen Killed While 'Subway Surfing'
Meta Platforms and TikTok owner ByteDance must face a wrongful death lawsuit by the mother of a 15-year-old Manhattan boy who died while "subway surfing" on a moving train, a New York state judge ruled.
Justice Paul Goetz ruled on Friday that Norma Nazario can try to prove Meta and ByteDance "goaded" her son Zackery into subway surfing by addicting him to Instagram and TikTok, where he viewed content about "dangerous challenges."
Meta, ByteDance and Snapchat parent Snap have faced thousands of lawsuits saying their platforms are addictive, causing harm to children, schools and governments.
Zackery Nazario died on February 20, 2023, after he and his girlfriend climbed atop a Brooklyn-bound J train as it crossed the Williamsburg Bridge.
His mother said a low beam struck Zackery, causing him to fall between subway cars, which ran over him.
She said she later found several videos related to subway surfing on Zackery's social media accounts.
Meta and ByteDance called Nazario's death "heartbreaking," but claimed immunity from user content under Section 230 of the federal Communications Decency Act, and the free speech clause of the U.S. Constitution's First Amendment.
But the Manhattan judge said Norma Nazario could try to prove her son was targeted because of his age.
"Based on the allegations in the complaint," Goetz wrote, "it is plausible that the social media defendants' role exceeded that of neutral assistance in promoting content, and constituted active identification of users who would be most impacted."
Goetz said Norma Nazario may pursue wrongful death, product liability and negligence claims.
He dismissed her claims against New York City's Metropolitan Transit Authority, saying common sense and "the realities of life in this city" should have signaled to Zackery that subway surfing was dangerous.
Meta, ByteDance and their lawyers had no immediate comment. Norma Nazario's lawyers did not immediately respond to requests for comment. The MTA did not immediately respond to a similar request.
At least six people died from subway surfing in 2024, New York City police have said.
The case is Nazario v ByteDance Ltd et al, New York State Supreme Court, New York County, No. 151540/2024.

VIJAYAWADA: Special Enforcement Wing for Narcotic Substance Control — Elite Anti-Narcotic Group for Law Enforcement (EAGLE) — has uncovered an increasing trend of smuggling ganja in trains to transport it along with sedatives while posing as regular passengers. During an inspection aboard the Chennai-bound Coromandel Express on Thursday, EAGLE teams, in coordination with Railway Protection Force (RPF), nabbed a man smuggling ganja from Shalimar to Chennai. In separate incidents, the teams seized two packets of ganja from a passenger on the Tambaram Weekly Superfast Express and 19 kg from two people aboard the Rayagada Passenger. 'In light of recent seizures, EAGLE is preparing for Statewide raids and intensified inspections of trains and buses, especially after busting the 'chocolate ganja' racket being routed to Chennai and other destinations through Andhra Pradesh,' said EAGLE Chief Ake Ravi Krishna. He added, 'Intelligence inputs from neighbouring states and other enforcement wings are being actively pursued, with a strict action plan in place for sustained surprise inspections.' Over 400 personnel from EAGLE, RPF, Government Railway Police (GRP), and local police have been deployed to trace ganja sources, gather information, and conduct public awareness drives. EAGLE teams plan to hold counselling for private bus operators, State-run transport corporations, and cab services, urging them to check passenger's luggage in case of suspicion. 'Such cooperation will help curb ganja smuggling through public transport. We have apprehended smugglers using RTC buses and private cabs,' Krishna said. An interstate intelligence-sharing network has been set up, and properties of arrested smugglers are being seized and attached through court proceedings, he added. Officials noted that smuggled ganja originates from Chhattisgarh, Odisha, and Bihar.

Taiwan warns: These Chinese apps are sending users' data to China
Taiwan's National Security Bureau (NSB) has warning for users of Chinese apps. In an advisory, NSB said that China-developed apps like RedNote (Xiaohongshu), Weibo, TikTok, WeChat and Baidu Cloud pose security risks due to excessive data collection and data transfer to China. The alert reportedly comes following an inspection of these apps carried out in coordination with the Taiwan's Ministry of Justice Investigation Bureau (MJIB) and the Criminal Investigation Bureau (CIB) under the National Police Agency. NSB said that the results indicate the existence of security issues, including excessive data collection and privacy infringement. It further warned, "The public is advised to exercise caution when choosing mobile apps." NSB also pointed out that companies operating in China are obligated to turn over user data under domestic laws for national security, public security, and intelligence purposes. So, using these apps can breach the privacy of users. How NSB found out Chinese apps are sending data to China The agency said that it evaluated Chinese apps against 15 indicators spanning five broad categories: Personal data collection, excessive permission usage, data transmission and sharing, system information extraction, and biometric data access. According to the analysis, RedNote violated all 15 indicators, followed by Weibo and TikTok that were found to breach 13 indicators. WeChat and Baidu Cloud violated 10 and 9 of the 15 indicators, respectively. These issues encompassed extensive collection of personal data, including facial recognition information, screenshots, clipboard contents, contact lists, and location information. All the apps have also been flagged for harvesting the list of installed apps and device parameters. "With regard to data transmission and sharing, the said five apps were found to send packets back to servers located in China," the NSB said. "This type of transmission has raised serious concerns over the potential misuse of personal data by third-parties." Ban on Chinese apps across the world Taiwan's warning comes after several nations across the world have banned or restricted certain Chinese apps. In June 2020, India announced ban almost 100 Chinese-made apps, citing national security concerns. In November 2024, Canada ordered TikTok to dissolve its operations in the country. Last week, one of Germany's data protection authorities asked Apple and Google to remove Chinese artificial intelligence (AI) chatbot DeepSeek from their respective app stores. The Germany's data protection authourity accused DeepSeek of unlawful user data transfers to China. Several other countries too have announced similar restrictions on DeepSeek. Durg-bound train searched in Jhansi over bomb scare
Jhansi: A bomb threat delayed the Durg-bound Chhattisgarh Sampark Kranti Express on Friday night, when it was halted at Virangana Laxmibai Jhansi railway station for nearly an hour. The threat turned out to be a hoax, and the train resumed its journey after a thorough inspection. According to SP, GRP, Vipul Srivastav, after the train left Hazrat Nizamuddin railway station in Delhi around 6pm on Friday, a call was recieved at the railway helpline 139, claiming that a bomb had been planted in a sleeper coach of the train. The railway control room in Lucknow started preparations for search of the train at Veerangana Laxmibai Jhansi station. As the train reached the station at 11.31 pm, city magistrate Pramod Jha, SP (Railways) Vipul Kumar Srivastava, RPF commandant Vivekanand Narayan and security officials reached the spot and evacuated the platforms 2 and 3. Other trains coming to the platforms were diverted. All passengers were asked to deboard, and a thorough search was carried out.
