Elaborate reporting norms likely under PMLA

The
Financial Intelligence Unit
(FIU) is eyeing a fresh framework for reporting entities under the Prevention of Money Laundering (PML) Rules and will approach the Reserve Bank to enhance
reporting requirements
, people familiar with the development said.
Changes could include enhanced user details, immediate alert for any change in 'know your customer' (KYC) for accounts red-flagged for
suspicious transactions
and a fresh set of 'alert indicators' for capital market, money exchanges and bulk property or gems and jewellery purchases.
The move aims to make disclosures more robust in the fintech and cryptocurrency space to prevent suspicious transactions before it is too late to track.

"There is a need for enhancing the reporting requirement especially in fintech space and crypto currency, where enforcing agencies face maximum challenges. We are discussing it with RBI and other regulators and will formally approach them with a framework for detailed discussions," a senior official told ET.
Live Events
In April, both FIU-IND and RBI signed a memorandum of understanding (MoU) for better information exchange and effective implementation of requirements of the
Prevention of Money Laundering Act
and Rules.
While most of these reporting agencies send their reports to the FIU on quarterly basis with suspicious transaction reports, officials said that by the time the report reaches, money crosses several borders making it difficult to get the trail.
"The idea is that when a big bulk transfer or purchase happens, it will immediately send an alert to the internal system so that FIU can be immediately alerted, which makes it easier to track the transaction.
This will also help FIU to generate meaningful intelligence for law enforcement agencies like the income tax department, ED and CBI, the official said.
FIU had introduced the 'alert indicators' in 2022 for the capital market, but it is felt that these need to be revamped in view of technological changes over time.
"The idea is to track order spoofing, misutilisation of client funds by stock brokers and suspicious off-market transactions by brokers and users," the official added.

UP STF's big catch: Con with Rs 50,000 bounty held in Amritsar

1 2 L ucknow: The UP Special Task Force (STF) apprehended Harveer Singh, alias Kake Sardar, a notorious fraudster with a Rs 50,000 bounty on his head, in Amritsar, Punjab, on Tuesday. Harveer was wanted in connection with a cheating case registered at Paras Pur police station in Gonda under BNS Sections 420, 467, 468, 471, 504, 506, and 406. Harveer, originally from Basarke village in Tarn Taran district of Punjab, had been absconding after duping Gonda resident Sunil Kumar Dwivedi of Rs 50 lakh in 2021. Dwivedi's troubles began when he met Chandan Dixit, a co-accused from Chitrakoot, who introduced him to Harveer and Madan Gupta. They convinced Dwivedi to invest in a mining contract in Fatehpur, showcasing forged documents of a mining lease and promising a 10% partnership and substantial profits. Trusting them, Dwivedi handed over Rs 50 lakh, but the trio vanished without fulfilling their promises. The STF successfully apprehended Harveer near Parvati Hospital in Ranjit Avenue, Amritsar, based on intelligence inputs. The operation was led by STF inspector Jay Prakash Rai under the supervision of deputy SP Shailesh Pratap Singh. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Calcula cuánto podrías ganar invirtiendo en Cervecería Nacional CFD Empieza a invertir hoy Leer más Undo The team, comprising SI Gulzar Singh and constables Rohit Singh, Pankaj Tiwari, and Ajay Yadav, played a crucial role in arresting Harveer. HC questions prolonged detention in NE riots case

New Delhi: Delhi High Court on Tuesday wondered how long the prosecution can oppose bail for accused persons jailed in connection with the Feb 2020 riots that rocked northeast Delhi. During the hearing of one such case, the court asked Delhi Police how long the accused people could be kept in jail, after highlighting the passage of five years and the fact that arguments on charge were still not concluded in the terror case related to the 2020 riots. A bench of Justices Subramonium Prasad and Harish Vaidyanathan Shankar posed the question to Delhi Police during the hearing of the bail application of Tasleem Ahmed, accused in a case related to an alleged larger conspiracy in the riots, lodged under the stringent Unlawful Activities (Prevention) Act (UAPA). Ahmed, the owner of a coaching centre, is accused of being part of the larger conspiracy case in relation to the riots. In matters like this, 700 witnesses, how much time can a person be kept inside?" the bench observed, pointing out the delay the trial is likely to take. The court made the query after the accused's advocate, Mehmood Pracha, raised the issue of delay in the proceedings in the case. Pracha said he won't be making submissions on the case's merit but would seek relief on the ground of parity in relation to the delay in trial. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like One plan. "He (Ahmed) was arrested on June 24, 2020… I have already spent five years (in jail)," Pracha argued, seeking urgent relief. He claimed his client never caused a delay in the case proceedings. Special public prosecutor Amit Prasad opposed the submission, arguing that the prosecution cannot be blamed for the delay in trial as there were several occasions when the matter was adjourned at the accused persons' request. Pracha went ahead to confine his argument to the delay in trial. The court will continue to hear arguments on July 9. The violence in northeast Delhi in Feb 2020 left at least 53 people dead and around 700 injured.

Sand mafia growing unchecked, governance failing under CM: Gehlot

1 2 3 Jaipur: Senior Congress leader and former chief minister Ashok Gehlot criticised the Bhajan Lal Sharma-led BJP govt in Rajasthan, accusing it of surrendering to the sand mafia and failing to uphold law and order in the state. Speaking on the birth anniversary of senior Congress leader Late Girija Vyas at PCC Tuesday, Gehlot said, "The sand mafia has completely taken over. Sand prices are skyrocketing, and the common man can't even afford to build a home. During our tenure, we faced challenges too, but we tried to control them. Today, it's a free-for-all." He alleged that a deep-rooted nexus now exists from the grassroots to the top, resulting in unchecked violence. "Police are being attacked, people are being run over by trucks, and anyone refusing to align with the mafia is being crushed—literally. This is not governance, this is lawlessness," he said. Gehlot further questioned chief minister Bhajan Lal Sharma's priorities. "What is the point of frequent tours and public visits if there is no governance on the ground? Crimes are happening everyday — rapes, robberies, thefts. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like Free P2,000 GCash eGift UnionBank Credit Card Apply Now Undo These are burning issues. Why isn't the CM acting?" Criticising administrative inertia, Gehlot noted the delays in implementing officer promotions and appointments. "Promoted officers continue to work on their old posts. IPS officers promoted to DIG are still functioning as SPs. IAS officers faced similar delays. Now that a new DGP is in place, what is stopping the govt?" He further accused the BJP govt of losing grip over public grievance redressal systems and claimed that law and order in the state was deteriorating. "The public doesn't know where to go. Mafia elements are on the rise, and complaints at the thana (police station) level are simply not being heard," he said. "The chief minister should deploy his IB discreetly to investigate whether what we are saying is baseless or not. If our concerns hold merit, he should act swiftly to fix them. If not, fine—we'll accept it was political exaggeration. But it must be verified by his own agencies," he added.
