Isha Foundation refutes allegations of sexual assault on student
at the Perur All Women Police Station based on a complaint lodged by the parents of a victim student.
In a release, Isha Foundation said, "The allegations made by the parents of the child are false, malicious, and defamatory. No such incident occurred at the school. In 2019, they made certain allegations, which were duly investigated and addressed. Since a case of bullying was found, the other student was issued a migration certificate. After the incident, the couple's elder child continued at the school for another three years, and the student wrote a positive testimonial after leaving the school, and even volunteered at the school. Notably, three months after the alleged incident, the parents applied for admission to the school for their younger child, who was about seven years old.'
'After their eldest child graduated from Isha Home School (IHS), the child's mother volunteered at IHS from June 2022. Due to complaints from students, parents and teachers regarding her conduct, she was asked to leave, and her association with the school was terminated by March 2024. Disgruntled by her removal, she has been attempting to twist the situation with false allegations of sexual assault. This is a calculated effort to malign the reputation of the school and the ashram, and we have initiated appropriate legal action," the release stated.

Protection against misuse: on POCSO Act, adolescent sex
The key objective of the Protection of Children from Sexual Offences (POCSO) Act, 2012 is the protection of children, but over the past few years, courts around the country and rights activists have called for some exemptions. Noticing a trend that adolescents, above 15 years but under 18, in voluntary relationships and having consensual sex were often being persecuted, the courts sought a review. In that backdrop, senior advocate Indira Jaising's written submission to the Supreme Court that consensual sex between teenagers aged 16-18 years must not be criminalised is a welcome move. She was appointed amicus curiae and her submissions are part of a petition filed by advocate Nipun Saxena. Her brief challenged the designation of 18 years as the age of consent. She said the only solution lies in declaring that sex between consenting adolescents between the age of 16, an almost universal age of sexual maturity, and 18, is not a form of 'abuse'. Ms. Jaising called for this exception to be read into the POCSO Act and Section 63 (sexual offences), of the Bharatiya Nyaya Sanhita (BNS). 'Such an exception would preserve the protective intent of the statute while preventing its misuse against adolescent relationships that are not exploitative in nature,' she said. In a 2023 report, the Law Commission had said that it was against changing the age of consent. It advised 'guided judicial discretion' instead, while sentencing in cases that involve children between 16 and 18 years in a voluntary, consensual relationship. Under the POCSO Act and under several provisions of the Indian Penal Code and the BNS, whoever commits a penetrative sexual assault on a child — who is anyone below 18 years — can face stringent punishment under Section 6 of the POCSO Act, Section 9 of the Prohibition of Child Marriage Act, 2006, and provisions of the IPC and BNS. A 16-year-old is considered a 'child' under Section 2(d) of the POCSO Act and hence her consent does not matter. But caveats have to be put in place so that the broad intent of the law is adhered to, as the Madras High Court suggested in 2021, in Vijayalakshmi vs State Rep. The High Court said the age difference in consensual relationships should not be more than five years to ensure that a girl of an impressionable age is not taken advantage of by an older person. Educating adolescents about the law on sexual offences and its consequences is a must too. Criminalising normal adolescent behaviour is not the way to protect against non-consensual, exploitative sexual offences.

Interfaith marriages without religious conversion illegal: Alld HC
Prayagraj: The Allahabad high court ruled that interfaith marriages without religious conversion are illegal and refused to quash criminal proceedings against a man accused of marrying a minor at an Arya Samaj temple, reports Rajesh Kumar Pandey. The Allahabad High Court directed the state home secretary to investigate how Arya Samaj temples are issuing marriage certificates without following rules and submit a compliance report. The court declined to set aside the criminal proceedings against the man who married a minor after allegedly kidnapping her. In his order dated July 24, Justice Prasant Kumar made it clear that the investigation has to be made by an officer not below the rank of deputy commissioner of police. Before passing the above directions, the court found that the applicant and the victim belong to different religions. "There is averment in the application that they have solemnized marriage in Arya Samaj Mandir at Prayagraj. However, the same could not have been done without proper conversion as per the existing law," added the court. With these observations and directives, the court dismissed the petition filed by one Sonu alias Shahnur, who had moved the court to quash summoning order dated September 12, 2024 issued against him as well as the entire proceedings of criminal case going on against him under section 363 (punishment), 366 (kidnapping a woman to compel her to marry) 376 (rape) of IPC and sections 3/4 of the Protection of Children from Sexual Offence (Pocso) Act at Nichlaul police station of Maharajganj district. During the course of hearing, the counsel for the applicant submitted that Shahnur had solemnized marriage with the victim on February 14, 2020. He further submitted that since the girl was minor, she was sent to Nari Niketan and when she became an adult, she started living with the applicant. On other hand, the government counsel submitted that the girl is minor as per her high school certificate and she could not have solemnized marriage with the applicant. He submitted that the applicant and the victim come from different religions, as such, their marriage cannot be considered valid until and unless proper conversion is carried out in accordance with the provisions of the UP Prohibition of Unlawful Conversion of Religion Act, 2021. He further submitted that the marriage certificate has been issued by Arya Samaj Mandir, which seems to be a fabricated document. In support of his arguments, the state counsel quoted an earlier order passed by this court, in which the court pointed out that certain people who claim themselves of Arya Samaj and are getting marriages solemnized illegally with mala fide intentions without even verifying the age of the couple. The court will hear the case next on August 29.

Bihar: Teen held for raping, killing 5-year-old girl; second such case in 4 days
Gaya: A 14-year-old boy was arrested for allegedly raping and strangling a five-year-old girl to death on Saturday night near a village under the Dobhi police station area. This marks the second such incident involving minors in Gaya district within the past four days, police said. The parents searched for her after they returned home and foundthe body with a towel wrapped around her neck in the nursery and informed the police around 10 pm (Representative photo) The girl's parents had gone to an adjacent village for paddy plantation while she was playing outside the house. The accused allegedly lured her on the pretext of purchasing chocolates around 7 pm and took her to a nursery in the forest department near Piparghati market and raped her, police said. The parents searched for her after they returned home. 'They found the body with a towel wrapped around her neck in the nursery and informed the police around 10 pm. She was bleeding from her private part when she was recovered,' Dobhi station house officer (SHO) Mukesh Kumar said. Police said that the family, belonging to a Scheduled Caste, was financially not stable. A case under Sections 103(1) and 62(2) of the Bhartiya Nyaya Sanhita and Sections 4 and 6 of the Protection of Children from Sexual Offenses (POCSO) Act was registered with Dobhi police station. 'The body was sent to ANMMCH at Gaya for autopsy,' senior superintendent of police (SSP) Anand Kumar said. Meanwhile, a driver and a technician were arrested for allegedly gang-raping a 26-year-old female candidate inside an ambulance on Thursday, while she was being taken to a hospital after fainting during a race held as part of the home guard recruitment in Bihar's Bodh Gaya.
