Notices to bldg tenants to remove illegal extensions
Mumbai: After a 35-year-old woman lost her life and another was injured following the collapse of a portion of an unauthorised structural extension of a rehabilitated tenement (RT) building at Byculla (W), the Mumbai Building Repairs and Reconstruction Board is issuing warning notices to tenants of such buildings in the city to remove unauthorised extensions.
Unauthorised structural extensions have been made by many tenants of such buildings.
On May 28, a portion of unauthorised structural extensions, protruding beyond the original building line on the fifth floor, which were carried out by tenants of the building, collapsed.
Following the incident, officials of the repair and reconstruction board visited the site and instructed tenants to remove unauthorised extensions.
The Mumbai Building Repairs and Reconstruction Board is now issuing warning notices to tenants in reconstructed RT buildings in its jurisdiction.
"The reconstructed tenement buildings were built between 1980 and 1990 after Mhada acquired rights to the buildings, which became dangerous and reconstructed these buildings. The Mumbai Building Repairs and Reconstruction Board carries out regular maintenance of these buildings.
There are 388 buildings across the city, but unauthorised extensions have been carried out over the last 10 to 15 years, and some of the buildings are very old.
This particular building, which has 193 residential rooms and 11 non-residential rooms, is also very old. We are issuing notices to tenants of these buildings to remove the unauthorised extensions," said a Mhada official.
"Residents carry out these unauthorised extensions as they are hamstrung due to the small size of their rooms.
But while carrying out these extensions, they do not take adequate precautions," said a Mhada official.
Activist Santosh Daundkar said, "BMC has a dedicated Building and Factory department, which has a designated officer for carrying out action, including removal of unauthorised construction under the MMC Act, and they carry out action accordingly. Mhada also has officials to carry out such action, but they don't carry out any action as required. They only initiate action when an incident occurs. Mhada is lackadaisical when it comes to action against unauthorised construction.
It has to be alert and take systemic action against unauthorised construction."

HC slams BMC for ‘no drastic action' against high-rise despite no fire nod for 15 years, OC for 18 floors
The Bombay High Court on Monday expressed 'shock' over 'glaring' multiple violations, including no fire NOC (no-objection certificate) for the entire building for 15 years and no Occupation Certificate (OC) for nearly half the floors of a 34-storey high-rise in Tardeo in South Mumbai. It slammed the Brihanmumbai Municipal Corporation (BMC) for 'failing to take drastic action' and permitting nearly 50 families to occupy the flats by risking their lives and questioned it for 'complete lawlessness'. The HC asked the flat purchasers and developers why such 'daylight violations' were required to be overlooked in view of the fire incidents in high-rises in the city. The court also sought a response from the civic body as to why water supply and electricity to the building cannot be cut, and questioned the department concerned as to why permission was given to operate lifts in the building. The HC stated that the developer and flat purchasers were occupying the units at their 'own risk' and there shall be civil and criminal liability on them if rights of third parties, including staff and servants, are violated or breached due to such incidents. A division bench of Justices Girish S Kulkarni and Arif S Doctor, while hearing batch of pleas pertaining to the tower of Willingdon View Cooperative Housing Society, Tulsiwadi, Tardeo, noted that the construction was completed in 2010 and the BMC permitted the building to be occupied thereafter without fire NOC for nearly 15 years. The bench expressed 'surprise' after reviewing a BMC joint inspection report highlighting gross violations by developer Satellite Holdings, noting the building only had a part Completion Certificate (CC) from ground to the 16th floor. 'What is further glaring and which would in fact shock our conscience is that floors 17 to 34 have no OC,' the bench noted, adding that the floors were illegally occupied. The HC observed that apart from several illegalities recorded by the BMC, one more illegality was that the entire 34-storey building lacked approval from the Chief Fire Officer (CFO) of the BMC, without which no person can occupy the building. 'We are at a complete loss to understand as to how such illegality and that too with impunity can at all be tolerated by the BMC and as to how there can be resistance on the part of the members/flat purchasers under the garb of any regularization application and more particularly when the developer admittedly has undertaken several unauthorised works including Floor Space Index (FSI) violations,' the bench observed. It noted that flat purchasers were trying to convince the court by seeking a 'complete go-by to the lawful requirements while chanting the routine mantra of regularisation'. The court further stated that compliance with fire safety norms by the CFO for any high-rise was 'non-negotiable' in view of past fatal fire incidents, including Kamla Mills fire, and 'there cannot be relaxation of such norms in any manner whatsoever'. It directed the CFO to file an affidavit on fire safety compliance and violations, and further asked the BMC's building and proposal department to file an affidavit in view of serious doubts raised in 2012 as to whether floors 1 to 16 can actually be said to have any OC. 'In the meantime, we are of the clear opinion that in such a situation, all the land purchasers/members of the society, who in our prima facie opinion are illegally occupying their flats and who actually need to vacate and more particularly those from 17th to 34th floor, shall continue to do (occupy) so at their own risk and consequences,' the HC said, adding they shall not be liable to be compensated by authorities in case of an untoward incident. Posting further hearing to Thursday, the HC said that if the BMC and other authorities respond that such gross illegalities require water and electricity supply to be cut, it would have no alternative but to permit the authorities to take appropriate action.

Wrongful loss of public money of BMC to which common Mumbaikars give tax: Court
IN THE detailed order rejecting anticipatory bail to an accused in the Mithi river desilting scam case, a Mumbai court said that wrongful loss of public money is caused to the civic body, to which the common Mumbaikar gives tax every year. While rejecting the pre-arrest bail plea of BMC Engineer Prashant Ramugade, the court said that as an officer in an important post, it is his duty to safeguard public interest, but he had 'failed to do so'. The court last week rejected the pre-arrest pleas of Ramugade and businessman Bhupendra Rajpurohit, a contractor. The Mumbai Police Economic Offences Wing (EOW) opposed Rajpurohit's plea alleging that he had submitted forged documents to the BMC without actually desilting and transporting silt from the riverside to the dumping sites, causing wrongful loss to the BMC. '…material prima facie show that the applicant is one of the conspirators along with other co-accused, and he successfully got tenders every year since 2018 in the name of either of his companies or those run through his relatives,' the court order said. It added that fake photographs were uploaded and fake logsheets maintained to show that the vehicles were making trips to collect silt from the river. 'There is wrongful loss of public money of the public body, to which the common Mumbaikar gives tax every year,' additional sessions judge N G Shukla said in the order on June 27. In the case of Ramugade, the court referred to statements of witnesses showing that he was designated to monitor the silting activities and the progress in work. The police suspect that wrongful losses of more than Rs 65 crore were caused to the BMC. 'Being officer on an important post, it was duty of the applicant (Ramugade) to safeguard the public interest, but he failed to do so,' the court said.

Senior Bhubaneswar municipal official assaulted on duty, told to apologise to BJP leader
A group of men allegedly dragged out and assaulted a senior on-duty official of the Bhubaneswar Municipal Corporation (BMC) during a grievance hearing on Monday. The incident occurred in the BMC office premises when the official, Additional Commissioner Ratnakar Sahoo, was conducting a grievance redressal meeting at his chamber. According to the police complaint that Sahoo filed, six-seven unknown individuals entered his chambers and aggressively asked whether he had spoken to Jagannath Pradhan, a BJP leader from Bhubaneswar. Sahoo said he responded that he had a telephonic conversation with Pradhan earlier in the day. The group then allegedly started assaulting him without any provocation and demanded that he apologise to Pradhan. Why they wanted him to apologise was not made clear. 'They beat me brutally in full public view with an attempt to murder, in the presence of public representatives, i.e. corporators of the BMC, BMC officers, staff, and citizens. While I was trying to shield myself and plead for mercy, they threatened me and attempted to forcibly drag me into a vehicle, saying that I must come to Jagannath Pradhan and apologise,' Sahoo said in the complaint. The assailants also allegedly snatched his mobile phone and uploaded scandalous content as his WhatsApp status, he said. The incident has sparked outrage, with BMC officials staging a cease-work protest blocking a major road outside the BMC office. They demanded the immediate arrest of the miscreants. There was heavy police deployment within the BMC premises following the incident. Police sources said they have registered a case and arrested three persons, including BMC corporator Jeevan Rout, in connection with the attack. Police said they were investigating the involvement of other persons. Pradhan described the incident as unfortunate and said that he knew two people allegedly involved in the attack. He also said the BJP government would not shield anyone and would take action against all those involved in the assault. The issue has also triggered a political row, with the Leader of Opposition and former chief minister Naveen Patnaik calling the attack 'appalling'.
