One judge upholds death sentence, other acquits: Split ruling in Jharkhand HC on Maoist ambush that killed 6 cops

Twelve years after a Maoist ambush in Jharkhand's Dumka district killed five policemen, the state High Court has delivered a split ruling. While one judge has upheld the lower court's order of capital punishment, the second one set aside the order and acquitted the two people accused in the case.
While delivering the split ruling on July 17, a Division Bench of Justices Rongon Mukhopadhyay and Sanjay Prasad disagreed on whether there was enough evidence to sustain the conviction and the capital punishment that the Dumka sessions court had ordered in 2018.
The ruling pertains to a Maoist ambush that killed Pakur SP Amarjit Balihar and five others on July 2, 2013. The SP and his team were on their way back from a meeting when some Maoists ambushed their vehicles and fatally shot them. Apart from the officer, five other policemen – Rajiv Kumar Sharma, Manoj Hembrom, Ashok Kumar Srivastava, Chandan Kumar Thapa, and Santosh Kumar Mandal – were killed.
The attack left some others wounded. In 2018, the two accused — Pravir Murmu alias Pravir da and Santan Baskey alias Tala da — were sentenced to death. After hearing their criminal appeal, the Division Bench of the High Court delivered a 197-page judgement on July 17.
Setting aside their conviction, Justice Rongon Mukhopadhyay said eyewitnesses in the case – the policemen who survived the attack — could not credibly identify the accused. He also noted the lack of direct involvement of, or recovery of incriminating material from, the two convicts.
Justice Prasad, however, took a divergent view and held that the eyewitnesses had identified Pravir and Tala in court and that 'the gruesome murder' of an IPS officer and his team 'did not evoke any sympathy'.
Affirming the death sentence, Justice Prasad directed the state government to provide a compensation of Rs 2 crore to the family of the SP, and give a job in the rank of the deputy superintendent of police or the deputy collector to one of his children. He also ordered a compensation of Rs 50 lakh and Grade 4 government jobs to the families of the five other policemen.
Special Public Prosecutor Vineet Kumar Vashistha said the split verdict means the case will now be referred to the Chief Justice for reassignment. He went on to say that Justice Prasad considered the case to fall under the 'rarest of rare' category.
'The matter will now be placed before the Chief Justice of the Jharkhand High Court, who will reconstitute a bench to rehear the case,' he said.

Lalit Maken, prominent trade union leader and Congress (I) MP from South Delhi, and his wife, Geentanjali, along with a visitor, Balkrishan Khanna, were shot dead in their Kirti Nagar house by two unidentified youths. A Congress (I) worker of the area, Suresh Malik, who used to drive Maken's car, was also shot in the shoulder. He is out of danger. The assailants, it appears, were aware of Maken's programme. 'Gas Leak Sabotage' The Union Carbide Corporation has ruled out everything but sabotage as the cause of last year's chemical disaster in Bhopal, the company lawyer, Bud G Holman, said. His comments went further than any previous statement by Union Carbide on the cause of the gas leak that reportedly killed 2,000 people and injured 2,00,000. A company spokesperson, Ed Vand Name Le, said later that the lawyer's statement should have been that the UCC has 'all but ruled out everything but sabotage'. He left open the possibility that the gas leak was accidental. Maken Murder: 3 Held Three persons have been detained in connection with the gruesome murder of Lalit Maken, his wife and a visitor to their house, the commissioner of police, Ved Marwah told a press conference. The three have been detained on the basis of information collected from the five eye witnesses to the crime, he said. All three were residents of South Delhi, Marwah added. The police commissioner promised a reward of Rs 1 lakh to any person giving clues leading to the arrest of Maken's assailants. Parliament Adjourned A stunned and grieved Parliament adjourned as news of Congress (I) MP Lalit Maken's killing came in. Speaker Balram Jakhar, PM Rajiv Gandhi and Opposition leaders paid tributes in the Lok Sabha prior to adjournment. In the Rajya Sabha, chairman R Venkataraman broke the news to a shocked House soon after Question Hour and adjourned the proceedings.

Madras High Court tells MEA to reconsider passport application of ‘stateless' 23-year-old

MADURAI: The Madurai Bench of the Madras High Court recently came to the rescue of a stateless woman, born to Sri Lankan parents in a refugee camp in Karur, after her passport application was rejected by the Ministry of External Affairs (MEA) without affording her the opportunity of a hearing. Following a petition filed by the woman, S Harinaa, Justice C Saravanan directed the MEA to reconsider the application within three months by obtaining a fresh report from the police. Harinaa was born to two Sri Lankan nationals in a refugee camp at Rayanoor in Karur district in February 2002. Wanting to study abroad, she had earlier moved the HC in 2022, against rejection of her passport application. While disposing of her petition in June 2023, the court had observed that there are provisions under the Passports Act, 1967, which enables the centre to issue passports to even non-citizens, if it feels it would be in public interest. Since Harinaa holds citizenship neither in Sri Lanka nor India, the court also declared her a stateless person. However, her application was once again rejected in May last year, challenging which she moved the court again. The second rejection order was passed based on a police verification report which included wrong information that Harinaa was born in Sri Lanka. The Deputy Solicitor General of India, opposing Harinaa's plea, told the court the MEA feels that issuance of a Certificate of Identity to Harinaa may not be in the interest of the nation. However, Justice Saravanan observed that there are ample numbers of documents, including Harinaa's birth certificate, to show she was born in India, while there are no records to indicate she was born in Sri Lanka and entered India either legally or illegally. Noting that these aspects were not considered by the MEA, the judge gave the above directions.
