The Gujarat High Court on Monday imposed a fine of ₹ 1 lakh on a man who attended virtual proceedings from a toilet seat while relieving himself on live video streaming, reported Bar and Bench. The court also said it is considering sending the person concerned, named Samad Abdul Rehman Shah, to jail as his conduct was contumacious. "The contemnor has admitted about his conduct during the live-streaming proceedings. Thus, at this stage, we direct the contemnor to deposit ₹ 1 lakh before the registry of this court before the next date of hearing," said a Division Bench of Justices AS Supehia and RT Vachhani. The High Court also noted that despite its order, the HC Registrar (Information & Technology) has not filed a reply and no steps have been suggested about how such incidents can be stopped. The counsel appearing for the Registrar told the Division Bench that he would assist the court on the next hearing date. The case has been listed for the next hearing on July 22. In June, a video went viral on social media showing Samad attending Gujarat High Court's virtual proceedings while seated on a toilet and apparently relieving himself. The incident took place on June 20 before the bench of Justice Nirzar S. Desai. Initially in the video, a closeup of the man featured, showing Samad wearing a Bluetooth earphone. Subsequently, he was seen keeping his phone at a distance, revealing that he was seated on a toilet. The man was appearing as a respondent in a case seeking quashing of a first information report (FIR). He was the complainant in the criminal case, Bar and Bench report said citing the court records.

The Gujarat High Court on Monday directed a man, who was captured on camera attending a virtual court proceeding while 'seated on a toilet seat' last month, to pay a fine of Rs 1 lakh in the contempt proceeding initiated against him. The Division Bench of Justice AS Supehia and Justice RT Vachhani, while dictating the order, said that a report of the court registry had revealed that the man had joined the virtual proceedings in the court of Justice Nirzar Desai on June 20 for a total period of 74 minutes, and was seen on a toilet seat while relieving himself. The Surat man, who was personally present in court on Monday, has been directed to deposit Rs 1 lakh to the court's registry before the next hearing on July 22. On the same day, the court also heard the suo motu contempt plea against Senior Advocate Bhaskar Tanna, who tendered an unconditional apology for appearing in a virtual proceeding while drinking from a beer mug. The Division Bench, during an oral exchange with Tanna, who submitted that he had 'no intention' to disrespect the court, asked if 'lack of intent could erase a contemptuous act'. In the case of the Surat man, the court also questioned his lawyer whether he had been advised about appropriate behaviour in court. The lawyer informed the court that the man had been advised to present himself in an appropriate manner. The lawyer had represented the man in the June 20 hearing, which pertained to quashing a case in which the Surat resident was a complainant. Meanwhile, referring to Tanna's case, the bench said that the court registry had submitted a report stating that the senior advocate remained connected to the virtual proceedings for 26 minutes on June 26 before Justice Sandeep Bhatt when he was 'seen talking on phone and having a drink in a beer mug' during the proceedings. While submitting his unconditional apology, Tanna said, 'I am not defending myself. I'm only pointing out so it can be taken care of. If control (with regard to joining the proceedings) is with the lawyers, this problem may arise. In my case, it was a pure error. If control is kept with officers of the court, our entry into the court wouldn't happen… And that's what the Supreme Court does.' During the hearing of the contempt petition, the court said that the Registrar of Information Technology had not submitted a report apprising the court about the 'mechanism to deal with contumacious litigants during online proceedings'. When the division bench was informed that the framing of the mechanism had been undertaken and submitted to the Chief Justice for approval, the court decided to hear the matter on July 22.

The Calcutta High Court on Monday said that it would hear two separate cases on alleged harassment of Bengali-speaking migrant workers from West Bengal in two different states, together this week and not separately. One of the two cases is about the harassment of Bengali-speaking migrant workers from West Bengal in Odisha, and the second case is about similar harassment in Delhi. It was alleged that these Bengal-speaking migrant workers were harassed by the Odisha and Delhi governments after branding them as illegal Bangladeshi infiltrators. The Odisha-related matter came up for hearing at the Division Bench of Justice Tapabrata Chakraborty and Justice Reetobroto Kumar Mitra. The Division Bench decided that instead of hearing the Odisha-related matter separately the same would be heard simultaneously and together with the Delhi-related matter on July 16. On Monday, the petitioner in the Odisha-related matter informed the court that most of the workers who were detained in Odisha after being branded as illegal Bangladeshi infiltrators have returned to West Bengal. The petitioner also expressed hope that the complications related to the return of a few other migrant workers from West Bengal who are still in Odisha will be resolved soon. On July 11, the Division Bench of Justice Chakraborty and Justice Mitra directed the Union Home Ministry to submit a report to the court on allegations that some Bengali-speaking migrant workers from West Bengal residing in New Delhi have been recently deported to Bangladesh. The Division Bench also directed the West Bengal Chief Secretary Manoj Pant to contact his counterpart in the Delhi government and also get a report from the state government there on the same matter, which will also have to be submitted to the court. Incidentally, on July 16, the Trinamool Congress will be organising a mega rally in Kolkata to be led by Chief Minister Mamata Banerjee against the alleged harassment of Bengali-speaking migrant workers in states outside West Bengal, especially in BJP-ruled states. Besides the main rally in Kolkata, the state's ruling party would also organise similar protest rallies in all the districts.

Kolkata: A Division Bench of the Calcutta High Court, on Friday, directed the Union Home Ministry to submit to the court a report on allegations that some migrant workers from West Bengal residing in New Delhi have been deported to Bangladesh. The Division Bench of Justice Tapabrata Chakraborty and Justice Reetobrata Kumar Mitra also directed the West Bengal Chief Secretary Manoj Pant to contact his counterpart in the Delhi government and get a report on the same matter from it, which will also have to be submitted to the court. The next hearing on the matter will be on July 16. The Division Bench gave this direction on Friday acting on a petition by an advocate at the same court that some migrant workers from West Bengal who were in Delhi for their livelihood had recently been branded as Bangladeshi infiltrators and subsequently deported to Bangladesh. The said advocate informed the court that those who have been deported to Bangladesh included an eight-year-old child, who was staying in Delhi with her parents. Recently, another case was filed at the Calcutta High Court accusing the Odisha government of unnecessarily detaining a group of migrant workers from West Bengal after branding them as illegal Bangladeshi infiltrators. However, the petitioner for the Delhi-related case, informed the Division Bench that at least in the case of the Odisha incident the detained migrant workers from West Bengal were not deported to Bangladesh, which happened in the Delhi case. The development at the Calcutta High Court happened just a day after a social media war broke out between the BJP's Information Technology Chief and the party's central observer for West Bengal Amit Malviya, and the West Bengal Chief Minister Mamata Banerjee over the reported eviction and harassment of Bengali-speaking migrant workers at Delhi's Jai Hind Colony. Malviya claimed that the Trinamool Congress was unnecessarily politicising the Jai Hind Colony development which was prompted by a court order identification of 26 illegal Bangladeshi infiltrators being apprehended from that area a few days back. On the other hand, Mamata Banerjee accused the BJP of spearheading an anti-Bengali agenda after being rejected by the voters of West Bengal in elections. She also stated that this harassment of migrant workers from West Bengal had been happening only in BJP-ruled states.
