Cuttack: Orissa HC granted bail to Chintan Raghuvanshi, a 2013-batch IRS officer and deputy director of the enforcement directorate (ED), Bhubaneswar, who was arrested by CBI on May 30 in connection with an alleged bribery case.
Justice Gourishankar Satapathy allowed Raghuvanshi to go on bail on furnishing a bond of Rs 1 lakh with two solvent sureties of like amount, subject to conditions, including surrender of his passport and restrictions on travel without prior court permission.
Senior advocate Ashok Parija and senior advocate Saura Chandra Mohapatra, along with advocate Lalitendu Mishra, represented the officer.
The court, in its order on July 23, noted that Raghuvanshi has been in custody for over 50 days while the investigation is still ongoing and the trial has not yet begun.
"Bail is the rule, jail the exception," Justice Satapathy observed, underlining that an accused is presumed innocent until proven guilty.
The court also pointed out that the CBI has not sought custodial interrogation of Raghuvanshi at any stage and that he had cooperated with the investigation, including providing passwords to his mobile devices. It was also noted that the accused had not misused the liberty granted during interim bail.
The CBI has alleged that Raghuvanshi received illegal gratification through co-accused Bhakti Binod Behera. The tainted money was allegedly recovered from a vehicle linked to Behera. The primary evidence against Raghuvanshi includes phone conversations with the complainant and co-accused.
The court held that fears of Raghuvanshi being a flight risk could be addressed through appropriate bail conditions and said economic offences do not automatically warrant denial of bail.

The new measures were unveiled during a state-level workshop at the police headquarters in Lucknow. One of the biggest citizen-friendly reforms announced is easy public access to report financial crimes. Now, 112 (emergency helpline) has been integrated with EOW so that the common man can report cases of Ponzi scheme fraud, stamp fraud, plot/land fraud, multi-marketing fraud, trading, Non-Banking Financial Company (NBFC) fraud, and job fraud. "The agency is being transformed into a robust, trusted institution, both for professional enforcement and public outreach. Efforts are being made to ensure its officers receive professional expertise in line with the highest national standards," DGP Rajeev Krishna said. The DGP added that along with training and reforms, public awareness was a key component of EOW's new strategy. The agency has also developed eight animated booklets to alert citizens about different types of financial crimes they may encounter in daily life. "These animated booklets are being made available in both soft and hard formats. The aim is to educate citizens on how they might be targeted and how to stay alert and protected. We expect this initiative to significantly raise public awareness," Krishna said. Director general, EOW, Neera Rawat said, "The unit is being equipped with cutting-edge tools like a 24x7 Case Management Software (CMS) for real-time monitoring and faster case resolution. A new EOW logo, a citizen-awareness booklet, and a short film on financial crime prevention were also launched to engage and educate the public," she said.

New Delhi: The Delhi high court denied bail on Monday to DHFL promoter Kapil Wadhawan in an alleged Rs 34,926-crore bank fraud case, noting that his "conduct during custody was not beyond reproach". Justice Ravinder Dudeja rejected his bail plea, saying such economic offences were not only crimes against specific victims but against the financial system at large. The CBI alleged Wadhawan, as promoter and CMD of DHFL, was the principal architect of a massive financial fraud involving diversion and misappropriation of approximately Rs 34,926 crore from a consortium of 17 banks. "The allegations regarding manipulation of valuable assets and transactions carried out during judicial custody are grave and suggest that the applicant continues to exercise significant control and influence," the HC observed. "The court cannot permit the release of a person who is prima facie the mastermind of a deep-rooted financial fraud, especially when the trial is at a nascent stage," it concluded, noting that if released on bail he might tamper with evidence or, worse, flee from justice. "Many of the witnesses in this case are stated to be either ex-employees or associates of DHFL and, as such, there is a high risk and possibility that the petitioner might try to influence witnesses," it said. Wadhawan is accused of creating and operating 87 shell companies in the names of associates, employees, and relatives to siphon off funds, falsely recorded as retail housing loans to over 2.6 lakh fictitious customers through a non-existent "Bandra Branch-001" in DHFL's internal systems. He was taken into custody in the case on July 19, 2022, and granted default statutory bail on Dec 3, 2022, but the Supreme Court cancelled his bail on Jan 24, 2024. The court observed his "effective custody" was two years, and not four years as claimed. "Having regard to the nature and seriousness of the allegations, the gravity of the offence, the applicant's central role in the conspiracy, the potential adverse impact of his release on the trial, and the huge magnitude of the funds siphoned off, this court finds no merit in the present application," the order held.

Chhatrapati Sambhajinagar: Former Parli municipal council chief Valmik Karad's son Sushil on Monday demanded a CBI probe into the 2023 Mahadev Munde murder case, claiming his family was facing political vendetta. This comes amid increasing pressure from Munde's family to name Karad and his two sons as accused in the case. Karad is already behind bars in the Massajog sarpanch kidnapping and murder case. Sushil said, "Neither my father nor my brother or me knew Munde. There's no connection between our family and this murder. Sushil said, "We are fully ready to cooperate with any inquiry. It is just that we are victims of vendetta." Questioning the credibility of the accusations, he said, "How are we being named after 20 months? Where is the proof? We have faith in IPS Kumawat and request him to lay bare the truth."
