Three Filipinos jailed, fined for possessing green turtle parts

KOTA MARUDU: Three Filipinos have each been sentenced to one year in jail and fined RM220,000 for possessing green turtle derivatives, with an additional eight months of imprisonment in default of payment.
Sessions Court judge Akhiruddin Acho handed down the sentence after the trio pleaded guilty to possessing an estimated 865kg of green turtle (Chelonia mydas) derivatives, stored in 39 sacks and 14 boxes.
On Sept 27, 2023, enforcement officers from the Malaysian Maritime Enforcement Agency (MMEA) apprehended them in Sabah waters near Simpang Mengayau, Kudat. The case was then referred to the Sabah Wildlife Department for further investigation and prosecution.
The trio were identified as Erwin Monares Comendo, 39; Rudyzon Darol Infante, 37; and Arnel Meniano Getes, 52.
They were charged under Section 41(1) of the Wildlife Conservation Enactment 1997, read together with Section 34 of the Penal Code, which provides for heavier penalties for possession of fully protected wildlife derivatives.
Sabah Wildlife Department director Mohd Soffian Abu Bakar said the successful prosecution was the result of strategic collaboration between enforcement agencies.
"The Sabah Wildlife Department highly appreciates the cooperation and swift action of the Kudat Malaysian Maritime Enforcement officers in thwarting the attempt to smuggle turtle derivatives in Sabah waters.
"This success reflects our continued commitment to protecting endangered marine species, particularly the green turtle."

Azjuriyahti and her husband, Datuk Sri Mohd Nazrul Izad Mohd Arsad, 46, are accused of allowing Kumpulan Maju Desa Industri (KMDI) Holding Sdn Bhd company secretary Hasnifalina Ramlee to submit a false statement concerning the resignation of three individuals as company directors. The false statement involving the resignation of L. Sivakumar, Associate Professor Dr Mohd Zainizan Shahdan and Shahkeer Azzat Zailan via a Section 58 form was allegedly committed at Wisma KMDI, Jalan Gambut, on June 20, 2023. She was charged under Section 591(2)(a) of the Companies Act 2016 (Act 777), which carries a maximum penalty of 10 years' imprisonment, a fine of up to RM3 million, or both, upon conviction. SSM prosecuting officer Abdul Hadi Abdul Muti proposed bail at RM30,000 with one surety. However, defence counsel Muhammad Nazrin Mohd Seth requested a reduction to between RM5,000 and RM8,000, citing that the surety is a contractor with irregular income. The court allowed bail at RM8,000 and fixed Aug 28 for mention and submission of documents. The court also issued a warrant of arrest against Mohd Nazrul Izad for failing to appear for today's proceedings. Muhammad Nazrin informed the court that his client was hospitalised at a private facility due to multiple health issues and submitted a hospital admission letter. However, Abdul Hadi argued that a private hospital letter was insufficient, and the accused must furnish a medical certificate from a government hospital or clinic. The court subsequently ordered Mohd Nazrul Izad to submit a medical certificate issued by a government medical officer of Grade 41 or above, on the next mention date. - Bernama

SHAH ALAM: A Pakistani man wept in court after he was slapped with charges of sodomy and physical sexual assault on three male teenagers and a boy between April and June this year. After proceedings ended, Muhammad Hassan, clad in a cream-coloured kurta and handcuffed in the dock, cried uncontrollably as he spoke to an interpreter in Urdu, saying he wanted to contact his family in Pakistan. He managed to calm down before he was escorted out of the courtroom by policemen. Earlier, the 24-year-old unemployed was charged with two counts of sodomy, two counts of sexual assault and one robbery on the four victims, aged between 8 and 19. The troubled-looking Hassan had the charges against him read out in Urdu by an interpreter, who told the court that he understood and claimed trial to all of it before judge Norazlin Othman. Hassan was charged with two counts of committing carnal intercourse against the order of nature against the will of two teenage boys aged 15 and 19. He allegedly committed the offences at about 10.05pm at a forest area next to Jalan Kota Raja in Section 27 on June 26, and at about 1.30pm at a hall in the same area on April 18. The charges under Section 377C of the Penal Code carries a jail term not less than five years and a maximum 20-years and whipping upon conviction. He was also charged with robbing the 19-year-old of RM230 and had threatened to cause harm before fleeing the scene. The charge under Section 392 of the code provides a jail term up to 14-years, with a fine or whipping upon conviction. On two other counts, he was charged with sexually assaulting a minor aged 8 by hugging him and touching his private parts with sexual intent at a playground at a flat area in Section 28 in early June. The other charge read he had committed sexual assault by rubbing his genitals on the anus of a 13-year-old boy at 1.30pm at a shrub area near a school field at Persiaran Kuala Langat in Section 27 on May 27. Section 14(a) of the Sexual Offences Against Children Act carries a maximum 20-year jail term and whipping upon conviction. Deputy public prosecutors Nurul Sofea Jaysal and Ruthra Raj Selvarajoo did not offer bail and asked the court to set a date for document submission. Hassan, who did not have a legal representation, pleaded through the interpreter to be provided with a court-appointed lawyer. He had said he did not know how to secure a lawyer while in prison and he has no family and friends in Malaysia that could help him with that. To this, the judge told Hassan to speak to the case's investigating officer who will guide him on appointing a lawyer. Norazlin set Sept 23 for mention with the presence of an Urdu interpreter, the appointment of a lawyer and document submission. On July 9, Shah Alam police chief Assistant Commissioner Mohd Iqbal Ibrahim said a Pakistani man wante d for allegedly sodomising and molesting several boys was arrested at Durian Burung in Baling, Kedah just before he attempted to flee the country. Iqbal said the suspect had gone into hiding in a rubber estate where his friend, a 43-year-old Pakistani man, worked as a rubber tapper. Police launched a hunt for the suspect after receiving reports of the alleged sexual assaults, involving boys aged between 9 and 19, which took place at Sections 27 and 28 here. The suspect's modus operandi was to seek help from the victims before taking them to a secluded area, where he would sodomise or molest them.

JOHOR BARU: Johor Domestic Trade and Cost of Living Ministry launched an enforcement operation to curb profiteering following the implementation of the expanded Sales and Service Tax (SST). The operation codenamed Op Kesan 4.0, is a statewide enforcement blitz, which took effect early this month. State ministry director Lilis Saslinda Pornomo said enforcement officers had conducted checks on 48 business premises involving 235 items, which was carried out under the Price Control and Anti-Profiteering Act 2011. During a walkabout at a supermarket in Larkin Junction here today, Lilis said the 48 premises were issued price information verification notices to obtain detailed data on cost, pricing, and profit margins. "The ministry also received four complaints related to suspected profiteering under the operation, and investigations are ongoing. "The operations main focus is to ensure that businesses do not exploit SST adjustments as a blanket excuse to increase prices without justification," she said in a statement today. The enforcement operation will also monitor four key elements, which includes items and services affected by SST changes, businesses above the SST registration threshold, price movement timelines aligned with SST enforcement dates, and profit margins to detect unreasonable mark-ups. Lilis warned that offenders found guilty of profiteering can be fined up to RM100,000 or jailed up to three years, or both. Companies face fines of up to RM500,000. She urged businesses to assess the four elements before adjusting prices or charges and reminded the public to report suspicious hikes through official channels, including the Ez ADU app, WhatsApp, and the KPDN e-complaint portal.
