Interpret rules beneficially to protect families of staff posted at ‘non-family' stations: HC

Chandigarh: The Punjab and Haryana high court has held that families of govt staff transferred to "non-family stations" with harsh conditions or security concerns should be allowed to retain their official accommodation.
The court emphasised a "beneficial interpretation" of rules to prioritise the welfare and stability of employees' families.
The ruling came from a division bench of Justice Anupinder Singh Grewal and Justice Deepak Manchanda, who dismissed a petition by the Centre. The Union govt had challenged a Central Administrative Tribunal (CAT) order that quashed a penal rent imposed on a joint director of the Military Engineering Service (MES) from July 16, 2020, to Dec 2, 2020.
The case involved an MES officer initially posted in Chandigarh, who was allotted a Type-V house in Sector 38-A in May 2012. Upon transfer to the Leh zone in Oct 2015, a non-family station, he was permitted to retain his Chandigarh accommodation. He was subsequently transferred to another non-family station, Udhampur zone, in June 2018, and was again granted permission to retain the Chandigarh accommodation until June 18, 2020.

Due to the Covid-19 pandemic, an extension was granted to all allottees until July 15, 2020.
When the officer failed to vacate, he was issued a show-cause notice for unauthorised occupation and directed to deposit penal rent. He eventually vacated the accommodation on Dec 2, 2020, after depositing Rs 4,39,764 as penal rent.
The CAT later quashed the penal rent order, prompting the central govt to appeal to the high court.
The high court, however, upheld the CAT's decision, observing that the transfers to Leh and Udhampur should be considered independent, allowing the officer to retain accommodation for three years from the June 18, 2018, transfer, or until June 30, 2021, whichever was earlier.
In its detailed order released Monday, the bench stated that the officer could not be deemed an unauthorised occupant, thus invalidating the penal rent.
The court further directed the government to refund the penal rent to the officer's family, as he passed away during the litigation, with interest, within one month.
The high court also reiterated a fundamental legal principle: when statutory provisions are clear, they must be given their natural meaning. The court emphasised that it is not the role of the judiciary to delve into legislative intent or alter the wording of the law, as that power rests solely with the legislature.

Bengaluru: Deputy Chief Minister DK Shivakumar today informed that the Cabinet has approved a Rs 237 crore project to supply treated water from Bengaluru to 164 tanks in Shidlaghatta and Chinthamani taluks. 'Treated water will be supplied to 45 tanks in Shidlaghatta taluk and 119 tanks in Chinthamani taluk from the second phase of Hebbal-Nagavara valley. A Rs 36 crore project to build a new tank in Chinthamani taluk has also been approved,' he said while addressing a press conference after the Cabinet meeting. 'The Cabinet has also approved a project to renovate and develop the fort built by Kempegowda in Magadi taluk at a cost of Rs 103 crore. Administrative approval has been given by the Irrigation department to build a reservoir at Mallamma valley. The Cabinet also resolved to seek a no objection certificate from the Union Home Ministry to rename Bagepalli as Bagya Nagara,' he said. 'A Cabinet Sub-committee has been formed under the leadership of Law minister to study the report on mining irregularities carried out by the Lokayukta SIT. There were many lacunae in the previous Sub-committee report and hence a new Sub-committee has been formed to work out ways and means to conserve state's mineral wealth,' he added. 'Rs 50 crore has been granted to develop a hotel and other facilities in Nandi Hills. Bailahongala town municipality in Belagavi district and Harapanahalli town municipality in Vijayanagara district has been upgraded to city corporations. Hanumasagara village panchayat in Koppala district has been upgraded,' he informed. 'A grant of Rs 306 has been given to Karnataka Residential Educational Institutions Society to build 14 residential schools. Morarji Desai school has been approved for Chintamani taluk in Chikkaballapur district. A hi-tech flower market with a cost of Rs 141 crore has been approved for Chikkaballapura. The Cabinet also decided to upgrade primary health centres in Kaiwara and Nandi villages. Bagepalli public hospital has been approved for an upgrade,' he said. 'A grant of Rs 40 crore and Rs 20 crore has been given to upgrade basic amenities at Government Boys college and Government Girls college respectively in Kolar. A grant of Rs 123 crore has been released to develop second phase of the Bengaluru North campus in Amaravathi village in Shidlaghatta taluk. Rs 21 crore has been approved for purchase of MRI equipment for Nandi medical college in Chikkaballapura and KIMS Hubballi,' he added.

Newly elected Ludhiana West MLA Sanjeev Arora will take oath as minister in Punjab Chief Minister Bhagwant Mann's cabinet on Thursday, it is learnt. Governor Gulab Chand Kataria will administer the oath of office and secrecy to Arora at 1 pm in a brief ceremony at the Raj Bhawan. AAP leader and industrialist, Arora, resigned from the Rajya Sabha on Tuesday. He submitted his resignation to Rajya Sabha chairman Jagdeep Dhankhar, who accepted it. Arora, a first-time MP, was elected to the Rajya Sabha from Punjab on April 10, 2022, and his tenure was to end on April 9, 2028. With his induction into the Cabinet, Mann will have 17 ministers, including himself. As per rules, Mann can have 18 ministers, including himself, but he is likely to keep a berth vacant. In the run-up to the by-election, AAP national convenor Arvind Kejriwal had announced that Arora would be made a minister after his victory. Sources said the party wanted to fill all Cabinet berths, but with the by-election necessitated in Taran Tarn after the death of AAP MLA Kashmir Singh Sohal last week, the party decided to fill only one seat and leave another vacant. 'A Cabinet berth has been kept vacant so that the party can promise the electorates of Tarn Taran that if they elect the AAP candidate, their representative will be inducted into the Cabinet,' a party leader said. Arora was sworn in as the Ludhiana West MLA on last Friday, but his induction is taking place a week later as the Governor was away in Udaipur for a couple of days. Kataria returned to Chandigarh on Wednesday. Arora secured a decisive victory in the recently concluded by-election, defeating Congress's heavyweight Bharat Bhushan Ashu by 10,637 votes, helping the AAP to tighten its grip over the urban Ludhiana West Assembly constituency, where a bypoll was necessitated after the death of AAP MLA Gurpreet Singh Gogi. Arora secured 35,179 votes, increasing AAP's vote share to 39.02%, an upswing of more than 4% over the party's 2022 performance. Before entering politics, Arora was a well-known businessman and philanthropist. He heads Ritesh Industries Ltd, a textile export firm, and Hampton Sky Realty Ltd. He also founded Femella Fashions, a women's apparel brand, and Teneron Ltd, a manufacturing unit supplying non-ferrous alloys to firms like Suzuki. In 2005, he established the Krishna Pran Breast Cancer Charitable Trust in memory of his parents, both of whom succumbed to cancer. The trust has since supported hundreds of patients. Arora also contributed extensively to Covid-19 relief efforts and medical institutions like Dayanand Medical College. Sources said owing to his interest in the field of healthcare, he may be handed the Department of Health, a portfolio held by Dr Balbir Singh.

A notification issued by the state government has hiked the marriage advance amount officially, benefitting lakhs of government employees and their families. It has been a long-standing demand of government employees to increase the marriage advance. Previously, male government employees and their sons could get an advance of up to Rs 3,000 for weddings, while female employees and their daughters were eligible for up to Rs 5,000. Now, with the latest order, these amounts have been doubled! Male employees and their sons can now receive up to Rs 6,000, and female employees and their daughters can get up to Rs 10,000. This move comes after Chief Minister M.K. Stalin announced several welfare schemes for government employees during the 2025–26 Budget Session.
