Over 6,000 residents of Indira Colony in north-west Delhi have received a temporary reprieve as the Delhi High Court ordered a stay on a demolition drive scheduled for Saturday and directed that no coercive action be taken until the next hearing on July 31.
The court passed the interim order on a petition filed by the Indira Colony Resident Welfare Association, which challenged an eviction notice issued by the Northern Railway on July 4, citing 'unauthorised occupation' of railway land. The court observed that the issue 'requires further examination'.
Broken promise
Amid legal proceedings, the issue drew sharp political reactions. At a press conference, Leader of the Opposition Atishi said: 'Before elections, the Prime Minister promised every slum dweller a pucca house under the slogan 'Jahan Jhuggi, Wahan Makaan'. But ever since the BJP came to power, bulldozers have arrived at poor people's homes.'
Former Shalimar Bagh AAP MLA Bandana Kumari said panic spread in the area on July 4 when the notice was pasted. 'This is CM Rekha Gupta's constituency. Despite her assurances, bulldozers razed one jhuggi earlier. Now, Indira Camp faces the same threat,' she said.
While there was no immediate response from the BJP, the CM had previously assured residents that no demolition would occur without legal process or rehabilitation, and that any demolitions under way were court-directed.
Policy breach
The petitioners argued that the eviction violated Article 21 of the Constitution, which guarantees the right to life and dignity, including shelter, and that authorities had not followed due process under the Delhi Slum and JJ Rehabilitation and Relocation Policy, 2015, and the 2016 Draft Protocols.
'None of the required steps were taken,' it said, pointing out that the colony appears as Serial No. 74 on the Delhi Urban Shelter Improvement Board's (DUSIB) list of 675 eligible jhuggi jhopri (JJ) bastis. The protocol mandates that the land-owning agency must send a request to DUSIB, which must examine the eligibility of the basti for rehabilitation. Only if found ineligible, can demolition proceedings begin, the plea said.
Appearing for the Northern Railway, the Central government's counsel submitted that the land belongs to the railway and that the occupants were in 'illegal possession'. The eviction notice, the counsel argued, was issued in accordance with the law.

Himachal chief minister Sukhvinder Singh Sukhu (File) Sukhu said the government has taken a tough stance regarding the alleged misbehaviour with cabinet minister Jagat Singh Negi in Seraj and the insult to the national flag. 'Any insult to the Tricolour will not be tolerated under any circumstances. A final decision regarding the entire incident will be taken after a meeting with Negi,' he said. Sukhu said, 'This act of BJP workers is indecent. The government has taken strict cognizance of this.' On Friday, in Janjehli area of Seraj assembly, some people showed black flags to revenue minister Jagat Singh Negi in protest against shifting of Thunag Horticulture College and threw shoes and black flags on his tricolour-bearing vehicle. The Mandi police on Saturday registered a case under sections 126 (2), 189 (2), 190, 191 (2) of BNS. 'On the demand of the children studying in the horticulture college and their parents, the government shifted Thunag College not far away but to Gohar of Nachan adjoining Mandi district. The revenue minister was repeatedly telling the public that this is the government's decision. But the people of BJP misbehaved with him. The government condemns this,' Sukhu said. Case should be withdrawn immediately: BJP state spokesperson Calling Sukhu-led state government 'insensitive', BJP state spokesperson Ajay Rana said, 'We strongly condemn the Himachal government for the way a case was registered against more than 65 people in Thunag area. The case should be withdrawn immediately by the government. The government should also have seen against whom they are registering FIRs, we clearly want to convey this voice to the ears of the government that 90% of the people in that protest were those who have been devastated by this disaster. Is this an attempt to scare the innocent people of Himachal? The public got angry because Jagat Negi's language was not right,' said BJP spokesperson. 'How was the tricolour insulted,' questioned BJP leader, while pointing at some past similar incidents that happened with BJP leaders.

'BJP leaders should also raise the issue of permission to build houses on forest land with the Centre, because many people's land has been washed away in the disaster and there is no place left to build houses. During recent interaction with media on July 24 governor Shukla had expressed dissatisfaction over lack of government rehabilitation centres while questioning political will to fight the menace. 'There is only one Red Cross-run drug rehabilitation centre in Kullu. We have been hearing about identification of land for setting up a centre in Sirmaur but nothing is moving on ground. This shows the seriousness of the government.' He had warned that if prompt action is not taken, Himachal would become 'Udta Punjab' in the next five years. The CM said that the state government is continuously taking action against drug addiction and many strict steps have been taken. He added de-addiction centres are being opened in the state.
