SRC board, not Najib, responsible for company's funds, says ex-PM's lawyers
Published on: Tue, Jul 08, 2025
By: Faisal Asyraf, FMT Text Size: SRC International is suing ex-prime minister Najib Razak (left) and former CEO Nik Faisal Ariff Kamil for US$1.18 billion. Kuala Lumpur: The High Court here was told today that SRC International Sdn Bhd's board and management had exclusive control of the company's operations and loan funds received from the Retirement Fund Incorporated (KWAP). Lawyer Farhan Shafee Abdullah – representing former prime minister Najib Razak in SRC's US$1.18 billion civil suit against him and former SRC chief executive officer Nik Faisal Ariff Kamil – submitted that his client had no control over the company. Farhan said all transactions were carried out by the board, which also bore responsibility for overseeing the company's affairs. 'If any misappropriation occurred, it was the result of the board's own decisions. 'Even taking Najib's alleged instructions at their highest, responsibility ultimately rested with the board to properly manage the funds within those parameters,' he said. Farhan also dismissed SRC International's claim that Najib acted as a shadow director or the de facto controller of the company. He submitted that Najib was not part of the company's governing board and did not assume the fiduciary duties of a director. 'The evidence shows the SRC board exercised independent judgement and was not accustomed to act on Najib's instructions,' he said. Farhan added that SRC had not produced any instance of Najib issuing a binding directive to the board on operational matters. He said the company's own witness, former BSI Bank wealth management head Kevin Swampillai, had testified that he did not receive, see or become aware of any instruction from Najib directing the transfer or investment of SRC's funds. 'All instructions for the movement of funds came from Jho Low and SRC officers, including (former director) Suboh Yasin – not Najib. This is a striking admission from the plaintiff's own witness. 'Despite Najib's position, no directive from him was ever communicated to the bank handling the money,' he said. The hearing before Justice Ahmad Fairuz Zainol Abidin will continue at a later date. SRC International is suing Najib and Nik Faisal – who remains at large – for allegedly misappropriating company property and conspiring to convert it for their own use. Judgment in default of appearance has been entered against Nik Faisal. The suit originally included former SRC chairman Ismee Ismail and former directors Suboh Yasin, Shahrol Azral Ibrahim Halmi, Azhar Osman Khairuddin and Che Abdullah @ Rashidi Che Omar as co-defendants. SRC later dropped the case against them, but Najib named them as third parties in his defence. Najib is currently serving a jail sentence in Kajang Prison for misappropriating RM42 million from SRC International. * Follow us on our official WhatsApp channel and Telegram for breaking news alerts and key updates! * Do you have access to the Daily Express e-paper and online exclusive news? 643 roadside traders benefit cash aid
Published on: Wednesday, July 09, 2025 Published on: Wed, Jul 09, 2025 By: Hayati Dzulkifli Text Size: Assistant Minister of Local Government and Housing Datuk Isnin Aliasneh said the initiative aimed at supporting small businesses, following criteria approved by the State Cabinet during a meeting on March 19 this year. Kota Kinabalu: A total of 643 licensed roadside traders across Sabah have been identified to receive a special one-off cash assistance of RM5,000 each, involving a total RM3.215 million, as of April this year. Assistant Minister of Local Government and Housing Datuk Isnin Aliasneh said the initiative aimed at supporting small businesses, following criteria approved by the State Cabinet during a meeting on March 19 this year. He was replying to Nominated Assemblywoman Datuk Amisah Yassin, who sought details on the distribution of the aid, including in the district of Ranau. Isnin said the State Ministry of Finance had already channelled the necessary allocations to the relevant local authorities (PBT) based on the number of qualified recipients. He said these lump sum payment funds would be distributed directly to eligible traders. 'This one-off RM5,000 assistance is targeted at small licensed roadside traders across the state to help them sustain their businesses,' he said. Replying to a supplementary question by Amisah, Isnin said the petty women traders, operating by the roadside, could apply for the RM5,000 one-off assistance and they must have licences issued by local authorities including District Council. * Follow us on our official WhatsApp channel and Telegram for breaking news alerts and key updates! * Do you have access to the Daily Express e-paper and online exclusive news? Sabah records RM35.4 billion investments under SMJ 1.0 development plan
Published on: Wednesday, July 09, 2025 Published on: Wed, Jul 09, 2025 By: Ricardo Unto Text Size: Nizam noted that domestic investments exceeded foreign investments in both 2023 and 2024, with RM11.21 billion and RM5.37 billion recorded, respectively. Kota Kinabalu: Sabah recorded RM35.38 billion in total investments between 2021 and 2024 under the Sabah Maju Jaya (SMJ) 1.0 development plan, with 420 approved projects comprising both domestic and foreign investments. Assistant Minister to the Chief Minister, Datuk Nizam Abu Bakar Titingan, said the State saw the realisation of 52 investments worth RM17.42 billion during that period. He told the State Legislative Assembly on Tuesday that RM10.9 billion in investment was approved in the first quarter of this year alone. 'Of the RM35.38 billion total, RM20.61 billion came from domestic sources while RM14.77 billion was contributed by foreign investors,' he said in response to a question from Nabawan Assemblyman Datuk Abdul Ghani Mohamed Yassin. Nizam noted that domestic investments exceeded foreign investments in both 2023 and 2024, with RM11.21 billion and RM5.37 billion recorded, respectively. 'In 2023, foreign investments amounted to only RM130 million, while in 2024, they reached RM1.08 billion,' he said. He said foreign investments focused on specialised sectors such as copper foil manufacturing, solar panels, oil and gas, and steel production. 'In comparison, domestic investors were involved in a broader range of industries outside of those specialised sectors,' he added. Nizam said the State's success in attracting investors reflected growing confidence in Sabah's economy under the current administration. To sustain momentum, the State Government plans to establish three new industrial parks – the Blue Economy Industrial Park in Kudat, and two Integrated Industrial Parks in Kota Belud/Kota Marudu and Beaufort/Kimanis. * Follow us on our official WhatsApp channel and Telegram for breaking news alerts and key updates! * Do you have access to the Daily Express e-paper and online exclusive news? Global trade grows by US$300bil in 1H25 with uncertain outlook
GENEVA: Global trade grew by an estimated US$300 billion in the first half (H1) of 2025, despite showing a slower growth pace, the United Nations Trade and Development (UNCTAD) said in a report released Tuesday, reported Xinhua. In its latest Global Trade Update report, the UNCTAD warned that the global trade outlook remains uncertain due to persistent policy instability, geopolitical tensions, and signs of weakening global growth in the second half of the year. According to the report, global trade rose by about 1.5 per cent in the first quarter and was expected to grow by 2 per cent in the second quarter. The report noted that price increases contributed to the overall rise in trade value, while trade volumes grew by just 1 per cent. Prices for traded goods edged up in the first quarter and continued to rise in the second quarter. Services trade remained the primary driver of growth, rising 9 per cent over the last four quarters. The report showed mixed trends in merchandise trade among major economies in the first quarter of 2025, with developed economies outpacing developing countries. The report attributed this to a 14 per cent surge in imports by the United States and a 6 per cent rise in exports from the European Union. Meanwhile, the United States has seen a widening trade deficit over the last four quarters, contributing to deepened trade imbalances. The report also highlighted the heightened risks of trade fragmentation brought by recent US tariffs, including a 10 per cent baseline tariff and additional duties on steel and aluminum. It warned that a further wave of unilateral actions could trigger trade tensions.
