Bihar election: SC agrees to hear pleas challenging ECI's voter revision drive on July 10

New Delhi [India], July 7 (ANI): The Supreme Court on Monday agreed to hear on July 10 a batch of pleas challenging the Election Commission of India's (ECI) move to conduct a Special Intensive Revision (SIR) of electoral rolls in poll-bound Bihar.
A bench of Justices Sudhanshu Dhulia and Joymalya Bagchi agreed to list the matter on Thursday and allowed the parties to give advance notice of the petitions to the Election Commission of India and serve copies of the petitions.
Senior advocates Kapil Sibal, Abhishek Manu Singhvi, Gopal Sankaranarayanan and Shadan Farasat jointly mentioned the matter before the apex court.
The advocates told the bench that voters who fail to submit the forms with the specified documents will face the harsh consequence of being deleted from the electoral roll, even if they have voted in elections for the last twenty years.
The petitions challenging the ECI decision were filed by Rashtriya Janata Dal (RJD) MP Manoj Jha, the Association for Democratic Reforms (ADR), activist Yogendra Yadav, Trinamool MP Mahua Moitra, and former Bihar MLA Mujahid Alam.
The petitions sought a direction to quash the ECI's June 24 directive, which requires large sections of voters in Bihar to submit proof of citizenship to remain on the electoral rolls.
ADR, in its petition, has submitted that the ECI order imposes fresh documentation requirements and shifts the burden of proof from the state to the citizen.
The petition also raised concerns over the exclusion of widely held documents like Aadhaar and ration cards, stating that this would disproportionately affect the poor and marginalised voters, especially in rural Bihar.
'The SIR order, if not set aside, can arbitrarily and without due process disenfranchise lakhs of voters from electing their representatives, thereby disrupting free and fair elections and democracy in the country, which are part of the basic structure of the Constitution,' the petition submitted.
RJD MP said the decision, which has been taken without any consultation with the political parties, is 'being used to justify aggressive and opaque revisions of electoral rolls that disproportionately target Muslim, Dalit and poor migrant communities, as such, they are not random patterns but are engineered exclusions.' He is scheduled to march from the Income Tax roundabout to the Election Commission office near the Bihar Assembly at 10 am. This marks his seventh visit to the state in the past five months. Protest Over Alleged Bias in Voter Roll Revision The Congress, along with its allies — RJD and Left parties — is staging the 'chakka jam' to oppose what they claim is a biased Special Intensive Revision (SIR) of the electoral rolls. They allege the process is designed to suppress the votes of the poor, migrants, and marginalised communities. 'This is a direct attack on the voting rights of the poor," said Bihar Congress chief Rajesh Ram. The voter list revision, launched on June 24 by the Election Commission, mandates submission of any one of 11 ID documents. The opposition fears this could disenfranchise Dalits, Mahadalits, migrant workers, and economically weaker groups. They have called the update drive a 'conspiracy to block votes" in favour of the ruling alliance. Gandhi May Visit Family of Murdered Businessman Sources indicate that Rahul Gandhi may also meet the family of businessman Gopal Khemka, who was shot dead near Gandhi Maidan on July 4. The murder has intensified opposition attacks on the Bihar government over deteriorating law and order. Gandhi's visit is likely to add political weight to the opposition's narrative as the state gears up for a heated electoral season. Amid the arrest of Jalaluddin alias Chhangur Baba, the alleged mastermind of a religious conversion racket, Uttar Pradesh Chief Minister Yogi Adityanath on Tuesday (July 8, 2025) said initial investigations revealed that his activities are not only anti-social but also 'anti-national'. Mr. Adityanath added properties of the accused, and all the criminals associated with the Jalaluddin gang will be confiscated and strict legal action will be taken against them. 'Our government is fully committed to the dignity and safety of our sisters and daughters. Initial investigation has revealed that the activities of accused Jalaluddin are not only anti-social but also anti-national. The Uttar Pradesh government will not show any leniency towards law and order. The properties of the accused and all the criminals associated with his gang will be confiscated and strict legal action will be taken against them,' wrote Mr. Adityanath, on X. The U.P. The Uttar Pradesh Police's Anti-Terrorism Squad arrested the alleged mastermind of a religious conversion gang Jalaluddin alias Chhangur Baba, a resident of Madhpur in Balrampur district and co-accused Neetu alias Nasreen on Saturday (July 5, 2025). The case, registered at a police station in Gomtinagar, Lucknow, under various sections of the Indian Penal Code and the Uttar Pradesh Prohibition of Unlawful Religious Conversion Act, 2021, alleges that the accused acted in an organized manner to convert individuals from Hindu and non-Muslim communities to Islam.
