SC grants bail to man despite murder co-accused absconding

Pune: The Supreme Court last month granted bail to Rohit Koli (35) from Ganeshnagar in Yerawada, arrested in connection with the murder of a money lender in Yerawada in 2019.
The court ruled that an accused being held in Yerawada central jail cannot be denied bail if the co-accused was absconding.
The Supreme Court (SC) bench comprising Justice Ujjal Bhuyan and Justice K Vinod Chandran, issued the order on June 26, stating, "Barring the co-accused, who is absconding, most of the other accused have been granted bail.
We are of the view that the appellant/accused Koli cannot be denied regular bail for the conduct of the co-accused."
The court noted that Koli was granted Covid bail for around two years, but he later surrendered before the jail.
Even then, Koli underwent actual incarceration of more than five years. "The charges in the murder case have not been not framed, and the trial has not commenced. In such circumstances, we are of the view that a case for the grant of bail has been made out by Koli," the court observed.

Following the directive from the apex court, Koli was produced before the sessions court in Pune. It ordered his release on bail on the condition to remain present for trial.
Koli was released from jail on July 3.
The Yerawada police had arrested Koli on January 10, 2019, with six others on the charge of fatally assaulting Sandip Deokar, a 55-year-old money lender from Yerawada, on January 6 in Khadki because of previous enmity. The prosecution had prayed to reject Koli's bail because investigations revealed that he bludgeoned Deokar with a stone (tile). Koli filed a special leave petition before the Supreme Court after the Bombay high court rejected his bail plea on February 24.
Lawyer Sana Raees Khan, representing Koli, argued that the inefficiency of the investigating agency to arrest the co-accused cannot be a ground to curtail the liberty of her client. Khan submitted that the information given by eyewitnesses that Koli bludgeoned the victim to death with a stone did not corroborate with the post-mortem report.

It must encompass healing, restoration, and the hope of a future unmarred by the past,' he said at the conference, organised by the women safety wing of the Telangana police in collaboration with the women development and child welfare department, the Telangana State Legal Services Authority and UNICEF. He praised Telangana's Bharosa Centres as a model worth replicating nationwide, calling them 'spaces of safety, listening, and healing' due to their integration of police, legal, medical, and psychological support under one roof. 'Such convergence should not be the exception but the norm,' he said, urging similar models to be scaled across India. The apex court judge also acknowledged the challenges of delays in the Protection of Children from Sexual Offences (Pocso) trials, gaps in trained personnel, and the lack of infrastructure. He questioned whether institutions truly had the will and capacity to implement child protection laws effectively and empathetically. He urged the judiciary, investigators, and legal aid lawyers to adopt a child-sensitive approach, insisting that legal aid must be timely and rehabilitation must be holistic—going beyond compensation to include education, counselling, family reintegration, and community care. Recognising the growing threat of online exploitation, he called for better digital safeguards, increased cybercrime investigation capacities, and active collaboration with tech platforms to combat abuse facilitated by technology. He also stressed the importance of digital literacy for children, parents, and teachers. Justice Nath called for sustained judicial training grounded in empathy, psychological insight, and field experience. 'Our goal must be to create a justice system where children are not mere witnesses, but participants whose well-being is our central concern,' he added. 'Their testimonies, their experiences, their suggestions must inform our laws and our institutions. We are accountable not just to the Constitution or to the statutes, but to every child who looks to us for safety and justice. Each case of child sexual abuse is not just a legal file; it is a broken world. And while we may not be able to undo the past, we have a duty to ensure that the future is filled with dignity and hope,' the apex court judge said. Quoting Nelson Mandela, he concluded: 'There can be no keener revelation of a society's soul than the way in which it treats its children.' Justice Nath added, 'Justice must have a human face. A 17-year-old Dalit teenager was allegedly paraded half-naked with his face blackened in the streets of Seeda village in Ludhiana district, after being accused of helping his friend in eloping with a woman. The humiliating act, allegedly carried out by the woman's family, was recorded on video and widely circulated in the area. Police said that the incident was the fallout of a love marriage solemnized by Gurpreet Singh, a resident of the village, who eloped with a young woman on June 19. Suspecting the victim of helping the couple escape and solemnize inter-caste marriage, members of the woman's family humiliated him. The victim said that on July 1 when he was present at a local salon when a group of men—identified as Gurpreet alias Gopa, Simranjeet Singh alias Simma, Sandeep alias Sam, Rajveer, and Ramandeep alias Kaka—barged inside, dragged him out, and assaulted him. They blackened his face, shaved his beard and moustache, tore his clothes, and then marched him semi-naked through the village. The victim added that when he tried to escape the accused chased and thrashed him. The accused made him sit on the road and kept on filming the act. He alleged that caste-based slurs were also hurled at him. The video was also circulated by the accused and it went viral. Police said that an FIR was registered at Meharban police station under the sections of Bhartiya Nyaya Sanhita (BNS) including 115(2) (voluntarily causing hurt), 127(2) (wrongful confinement), 351 (criminal Intimidation), as well as under Sections 66A and 67B of the Information and technology Act, and provisions of the SC/ST (Prevention of Atrocities) Act, 1989. One accused has been arrested so far, and police say more arrests are likely as the investigation progresses. Agra: A violent clash involving stone-pelting and physical assault broke out on Saturday evening in Mathura during the wedding procession of two Dalit grooms, allegedly over DJ music featuring songs dedicated to BR Ambedkar and those "glorifying" the Jatav community. Police said the incident occurred between 6:30 and 7:30 pm in Dahrua village under Jamunapar police station limits. According to the FIR filed by Devendra Kumar, cousin of the grooms Ram Kumar (22) and Saurabh Kumar (23), "In the wedding procession, the DJ was playing songs praising the Jatav community. Some members of the Thakur community objected to the songs and started pelting stones and hurling abuses." The objection quickly escalated into a physical altercation, in which two people sustained minor injuries. Local police rushed to the spot and brought the situation under control. Jamunapar SHO Ajay Kishore said, "An FIR has been filed in connection with the matter under BNS sections 115(2) (voluntarily causing hurt), 352 (assault or criminal force), 351(3) (criminal intimidation), 125 (endangering life or personal safety of others), and relevant provisions of the SC/ST Act against three people." DSP Sandeep Singh of Mathura's Sadar area added, "I am investigating this case. Prima facie, we have found that the issue was with the DJ playing the songs, not with the people in the wedding procession. Two people have been detained for questioning and the probe is ongoing."
