Company owner, manager fined for unlawful possession of logs

KOTA KINABALU (May 16): A company owner and its manager were fined by a Sessions Court here today a total of RM100,000, in default, eight months' jail for unlawful possession of 238 logs without paying royalty.
Judge Elsie Primus imposed RM50,000 fine each on Tiong Chee Khong and Yun Ket Chun, both aged 50, after a full trial.
In her reserved decision, the judge held that the prosecution had proven its case beyond reasonable doubt against the two accused. Both of them had paid their fines.
The duo was found guilty of without lawful authority or legal right, having the logs that had not been paid royalty at a log storage area in the Sipitang Forest Reserve on February 7, 2020.
The offence was under Section 30(1) g of the Forest Enactment 1968, punishable under Section 30(2) (b) of the same Enactment.
The indictment provides for a fine of up to RM500,000 or a jail term of up to five years or both, upon conviction.
On December 18, 2024, the duo was freed from three charges of felling 707 logs illegally in the forest reserves and State land in Sipitang without their defence being called.
For this offence, which was their fourth charge, they were called to enter defence.
During mitigation, counsel Aaron Mark who represented the duo, requested for a minimum fine to be imposed on his clients saying that they were first-time offenders.
Aaron argued that that these logs were rightfully cut and it was not related to damaging environment.
In reply, Forestry Department prosecuting officer Peter Jack Empah urged the court to impose a deterrent sentence on Tiong and Yun.
Peter submitted that the offence committed by the duo not only involved a violation of the law, but it also impacted the State Government's revenue in terms of tax collection.
'The unpaid taxes to the State Government amount to approximately RM60,000. Their action of failing to pay taxes to the State Government appeared to challenge the authority of the Sabah Forestry Department as the statutory body responsible for forest resource management in Sabah.
'If such actions are not curbed, they will have long-term effects on society and may encourage more individuals to commit similar offences in the future,' Peter added.
The prosecution had called 12 witnesses to give their evidence while three defence witnesses had testified in the hearing, including Tiong and Yun.
The cases were first brought to court on June 21, 2023.

Kota Kinabalu: A 23-year-old local, believed to be part of a drug syndicate, was arrested following three separate police raids around the city, resulting in the seizure of more than 20kg of various narcotics worth RM960,000. Sabah Police Commissioner Datuk Jauteh Dikun said the operation, conducted by the Kota Kinabalu Narcotics Crime Investigation Division on July 4, began with a raid on a condominium. Officers found 790.56gm of suspected methamphetamine (syabu), along with a money-counting machine, a digital scale and drug packaging tools. The following day, a second raid on another rented condominium uncovered 14.14gm of suspected ketamine. Acting on information from the suspect, police then inspected an abandoned vehicle in a parking lot, which led to the discovery of a suitcase containing 12.7kg of syabu, 6.9kg of ketamine and 25 packets ecstasy juice and 10 ecstasy pills. Jauteh said the drugs were likely intended for both local consumption, especially at entertainment venues, and distribution to neighbouring countries. He added that the suspect is believed to have been actively involved in drug trafficking for the past year. Assets worth RM240,000 suspected to be linked to drug activities were also seized, bringing the total value of the seizures to RM1.2 million. The suspect remains in custody and is being investigated under Section 39B of the Dangerous Drugs Act 1952. On the narcotic trafficking trends, Jauteh said drugs are typically smuggled into Sabah via sea cargo for large quantities and air transport for smaller consignments. 'This is based on patterns observed over the past five years,' he said, calling for stronger collaboration between enforcement agencies and the public to curb drug threats, especially those involving cross-border smuggling. 'We need comprehensive cooperation from all stakeholders responsible for the movement of goods in and out of Sabah. 'Once drugs enter Sabah, the police can act, but prevention must start before entry,' he said. Jauteh encouraged community involvement in combating drug abuse, saying residents should report any suspicious activities if they are unable to intervene directly. 'Everyone has a role, whether offering guidance or reporting to the authorities. The court also ordered them to be referred to the Immigration Department after serving their prison terms. They were arrested at about 9.50pm on June 23 by the roadside along Jalan Teku-Pasai Siong, after failing to produce valid travel documents. They were charged under Section 6(1)(C) of the Immigration Act 1959/63 (Amendment 2002) and punished under Section 6(3), which carries a maximum fine of RM10,000, up to five years' jail, or both, and up to six strokes of the cane. Investigations confirmed the couple had no records of legal entry into Malaysia. It is understood that the arrest was made while police were investigating a separate murder case involving another Indonesian national at a farm hut in Jalan Rantau Panjang. In relation to that case, Heriadi was separately charged with murder at the Magistrates' Court here on July 8. He was accused of killing a fellow countryman, identified as Andi, at around 7pm on June 22. No plea was recorded, as the case will be heard at the High Court. Appeals court reinstates 19-year jail term, whipping for man who raped, assaulted sister

PUTRAJAYA: The Court of Appeal today reinstated a 19-year prison sentence and 19 strokes of the cane on a 24-year-old man for raping and physically sexually assaulting his younger sister when she was just 11 years old. A three-member bench, led by Justice Datuk Hashim Hamzah, allowed the prosecution's appeal to overturn the High Court's earlier decision, which had reduced the sentence to nine years' imprisonment and seven strokes of the cane. The other judges on the panel were Justices Datuk Mohamed Zaini Mazlan and Datuk Noorin Badaruddin. The man, who was 17 at the time of the first offence, had pleaded guilty at the Sessions Court to raping his sister in a flat in Jalan Ipoh, Kuala Lumpur, at night, sometime between 2018 and 2019. He also pleaded guilty to a second charge of sexually assaulting her at the same location on June 12, 2021, when he was 20 years old. In January 2022, the Sessions Court sentenced him to eight years' imprisonment and 10 strokes of the cane for the rape offence, along with an additional two years' jail and two strokes under Section 16(1) of the Sexual Offences Against Children Act 2017. For the 2021 sexual assault offence, the court imposed eight years' imprisonment and five strokes of the cane, plus an additional one year and two strokes under the same law. The Sessions Court ordered all sentences to run consecutively, bringing the total sentence to 19 years' imprisonment and 19 strokes of the cane. The court also directed that the accused undergo counselling throughout his imprisonment and be placed under police supervision for two years after his release. However, in September 2022, the High Court reduced the sentence for the rape charge from eight years to five, set aside the 10 strokes of the cane, and removed the additional punishment under Section 16(1) of the Sexual Offences Against Children Act 2017. However, the High Court maintained the sentences for the sexual assault offence and ordered the sentences for both offences to run concurrently, resulting in a total sentence of nine years' imprisonment and seven strokes of the cane. During today's proceedings, deputy public prosecutor Tengku Shahrizam Tuan Lah argued that the sentence imposed by the High Court for the rape offence was manifestly inadequate as under Section 376(3) of the Penal Code, the offence carries a maximum sentence of 30 years' imprisonment and a minimum of 10 strokes of the cane. He submitted that the High Court judge had erred by failing to consider the seriousness of the offence, particularly as it involved siblings. Meanwhile, lawyer Khor Boon How, representing the man, urged the court to maintain the sentence handed down by the High Court, noting that his client was still considered a minor when he committed the rape offence. He argued that reinstating the original sentence imposed by the Sessions Court would deprive his client of the opportunity to spend his formative years contributing to society. – Bernama
