Girl knocked down when confession box door fell on her settles case for €25,000

Zofia Adamczyk was two years old when the confessional door – which, it was claimed, was unhinged − fell on her, trapping her underneath.
Her counsel, Robert Beatty SC, with Mark Doyle BL, told the High Court the girl had been attending mass with her mother when the incident happened at Oblates Church of Mary Immaculate, Inchicore, Dublin, 14 years ago.
Counsel said the door to the confession box weighed about 15kg and it was a 'traumatising incident' for the child.

Some men had to lift the door off the child, who had also struck her head on the stump of a decorative Christmas tree. A section of the church was under renovation at the time.
Ms Adamczyk (16) of Saggart, Co Dublin had, through her father Andrzej Adamczyk, sued Fr Oliver Barry over the accident on March 4th, 2011.
It was claimed that the door to the confessional fell on top of the toddler after she allegedly tried to open it.
It was claimed there was an alleged failure to take any or any adequate precaution for the child's safety and there was an alleged failure to take any reasonable care to ensure she would be reasonably safe whilst in the church.
It was further contended that there was an alleged failure to ensure that adequate warnings or signs were in place around the confessional while it was under renovation.
Counsel told the court he did not think liability was an issue but causation was at issue in the case.
The little girl was later diagnosed as suffering from head pain and she had bumps to her head, along with some restriction in side-to-side movement, bruising and tenderness. She later had panic attacks and claustrophobia which, it was claimed, had a severe impact on her daily life.
Approving the settlement, Mr Justice Paul Coffey said he was satisfied, considering the difficulties in relation to causation in the case, that the offer was fair and reasonable.

Richard Treacy admitted €100,000 from unknown sources had been spent on the house where he lives in Garryowen, Limerick. But a quantity surveyor who accompanied gardaí when a search warrant was executed at the house estimated the cost of the renovations was three times higher. The higher figure from the surveyor's report was referred to in High Court evidence last month in a case against his cousin Kieran Keane Jnr. Crime boss Christy Keane The Special Criminal Court heard this week that Treacy pleaded guilty on the basis that €100,000 had been spent on the house ,which was accepted by the State. Richard Treacy is a nephew of gang boss Christy Keane and a younger brother of Owen Treacy Snr. Owen Treacy Snr survived being abducted and stabbed multiple times by members of the Dundon-McCarthy gang in one of the most infamous incidents in Limerick's gangland feud. Kieran Keane Snr died in the same incident in 2003 for which five men were jailed for life. As part of that case there was evidence given to the High Court which gave an account of Richard Treacy's alleged criminal activity. An officer stated: 'He currently operates at the highest level within the Keane OCG and is a pivotal player in the day-to-day running of the criminal organisation.' The house in Garryowen 'He is very close with his cousin Kieran Keane and both are regularly observed in each other's company.' The same witness also stated how a surveyor carried out a detailed review of Treacy's home which included 'refurbishment, extension and redecoration.' The final estimate from the review carried out in 2021 came to €315,713. It was also stated that in the early stages of the feud with the McCarthy-Dundon gang that 'Richard was an active participant. 'He was a target of an attack by Frank 'Fat Frankie' Ryan (deceased) and Christopher McCarthy in June 2006 where he was attacked with weapons. He fled uninjured.' It also mentioned the killing of Daren Coughlan in November 2005 for which Treacy along with his cousin Joe Keane and Shane Kelly were convicted of manslaughter. It was stated this was 'a feud related attacked' as the victim had been a relation of David 'Frog Eyes' Stanners. Stanners, who has since died in prison, was serving a life sentence for the murder of Kieran Keane Snr and the attempted murder of Owen Treacy, Richard's brother. His brother Daniel Treacy, who was not involved in organised crime, was shot dead in 2010 by John Coughlan, Darren's brother. Treacy was also stated as being 'the principal suspect in the shooting of Gavin Killeen at O'Malley Park, Southill Limerick on 20 July 2006'. Gavin Killeen was a brother of McCarthy-Dundon gunman Nathan Killeen who is currently serving a life sentence for his role in the murder of businessman Roy Collins. Their sister Ciara was in a long-term relationship with gang boss John Dundon. Also cited were two incidents of violent disorder in in 2006 and 2015 in which Treacy was involved when members of the rival factions clashed in public. During this week's Special Criminal Court hearing, counsel for Treacy objected to garda evidence at the hearing that his manslaughter conviction was 'feud-related'. Counsel said it was an attempt to 'colour' the minds of the three-judge panel and made an application they recuse themselves. The application was denied. The case has now been adjourned for sentencing on October 20.

GAA pay tribute to Fermanagh shooting victims at All-Ireland football final
The GAA have paid tribute to the victims of a fatal shooting in Maguiresbridge with a minute's applause at Croke Park ahead of Sunday's All-Ireland SFC final. Vanessa Whyte, who was 45, and her children, Sara (13) and James (14) died after they were shot at their home in the Co Fermanagh village on Wednesday. A male who also suffered gunshot wounds remains in a serious condition in hospital. Vanessa Whyte and her children were active members of two local GAA teams. In separate statements on Wednesday night, both St Mary's Maguiresbridge Gaelic Football Club and Lisbellaw St Patrick's Hurling Club offered "heartfelt condolences to the families and friends of those impacted by the tragic incident. Vanessa Whyte and her children, Sarah and James "We are working with the GAA at county, provincial and national level, to implement the Association's critical incident protocols. We will work closely with all appropriate services to ensure that those who require support at this difficult time can access it. "The deceased were all active and beloved members of our club. We will not be making any further comment at this difficult time." A murder investigation has been launched, and police are probing a triple murder and attempted suicide line of inquiry. Ahead of today's All-Ireland SFC final at Croke Park between Donegal and Kerry, a minute's applause was warmly received with a picture of the mother and children displayed on the big screen at Croke Park. Ulster champions Donegal, managed by Jim McGuinness, are hoping to win their third All-Ireland title today as they take on Jack O'Connor's Kerry, who are bidding to win the Sam Maguire Cup for the 39th time.

‘We are coming here with hearts broken': Prayer service to be held for Fermanagh shooting victims
A prayer service will be held in Co Clare for a mother and two children killed in a shooting incident in Co Fermanagh . Vanessa Whyte (45), a vet from Co Clare, her son James (14) and daughter Sara (13), were killed in a suspected triple murder and attempted suicide at a house in Maguiresbridge on Wednesday morning. Ms Whyte was originally from Barefield, a village near Ennis in Co Clare. A murder investigation has been launched, while an adult male remains in a serious condition in hospital. READ MORE A prayer service will take place at the Church of Immaculate Conception in Barefield on Sunday evening. A notice on the parish website describes it as a service to remember Vanessa, Sara and James. Barefield parish priest, Fr Tom Fitzpatrick, said the community wanted to gather together to remember the family. The prayer service has been organised to take place on Sunday evening to allow for Ms Whyte's brother, Ivor, to travel home from Australia . 'The prayer service was organised by the community, myself and the pastoral council. We planned it days ago,' Fr Fitzpatrick said. 'The purpose of the service is to gather as a community and be with the family and let them know we are thinking of them and we are here in shock and in pain. 'When something happens in a rural community, even to one person, it affects everybody. We are coming here with hearts broken. A lot of the community knew Vanessa and she was so well loved.' It is understood that the funeral of the mother and her two children will take place in Barefield later this week. On Saturday, detectives from the major investigation team, who are carrying out the murder investigation, said they are continuing with their inquiries and appealed for information involving the movements of a vehicle. Detective Chief Inspector Neil McGuinness said: 'Our investigation is ongoing and we are working tirelessly to determine the exact circumstances of this tragedy. 'I would continue to appeal generally for anyone with information to come forward, and more specifically, I would ask anyone who saw a silver Mercedes saloon car being driven in the Clones Road area of Newtownbutler, or between Maguiresbridge and Newtownbutler, on the evening of Tuesday July 22nd, to call detectives on 101, quoting reference 276 23/07/25. 'Anyone who was travelling in the area and who may have captured dashcam footage which could assist, please get in touch.' The man who remains in a serious condition in hospital was a member of the same household, the PSNI said. On Friday, hundreds of people attended a community vigil for the family in Maguiresbridge. – PA
