‘Riddled with loopholes': Business groups slam NY attorney general Letitia James' consumer bill as legal ‘shakedown scheme'
New York attorney general
Letitia James
is under fire from prominent business groups over her proposed
FAIR Business Practices Act
, with critics warning it could expose
small businesses
to a wave of 'legal shakedowns' driven by opportunistic attorneys, reported The New York Post.
The legislation, aimed at cracking down on
consumer scams
like deed theft, junk fees and AI-powered fraud, is being pitched as a way to protect New Yorkers from abusive practices. But business advocates argue the bill would strip key legal safeguards and lead to a surge in frivolous lawsuits.
'The so-called FAIR Act would be anything but fair to New York's business community, especially Main Street businesses,' Tom Stebbins, executive director of the
Lawsuit Reform Alliance of New York
, was quoted as saying by the New York Post.
He warned it 'replaces due process with a system that invites abuse' by encouraging profit-driven law firms to target small companies with settlement threats.
Stebbins said the bill would allow attorneys to demand pre-suit settlements, creating 'a cottage industry of legal shakedowns' where small businesses settle even baseless claims to avoid costly legal battles.
James, however, has defended the bill as essential in an era of growing digital fraud and reduced federal enforcement.

'At a time when the federal government is making life harder, we want to make life easier for New Yorkers,' she said in March, as per the New York Post. 'The FAIR Business Practices Act will close loopholes that make it too easy for New Yorkers to be scammed.'
The bill targets a wide range of deceptive practices, from student loan servicers steering borrowers into expensive plans, to insurance companies listing in-network doctors who don't accept certain plans.
It also aims to hold car dealers and nursing homes accountable for misleading or abusive conduct.
Still, business groups argue the bill's definitions are vague and open to exploitation. Chelsea Lemon of the Business Council said lawmakers should reject the bill if they are 'truly serious about addressing affordability.'
Ashley Ranslow from the National Federation of Independent Businesses warned it could 'make it easier for lawyers to shake down small businesses with vague legal threats.'
Justin Wilcox of Upstate United echoed similar concerns, saying the legislation is 'riddled with loopholes lawyers will exploit for profit, not justice.'
Despite the backlash, James' office shared support from groups like the Student Borrower Protection Center and the Small Business Majority. As quoted by New York Post, Winston Berkman-Breen from the borrower group said, 'New Yorkers need the state to pass the FAIR Business Practices Act.'
Lindsey Vigoda added that the bill would 'shield Main Street businesses from predatory lenders.'
The legislative push comes as James faces mounting political heat. The Trump administration recently referred her for criminal investigation over alleged mortgage fraud. The justice department probe, centred on claims she misrepresented properties to gain better loan terms, has sparked fierce debate. US President Trump, speaking from the Oval Office, called her 'a total crook' and a 'disaster for New York.'
James has denied any wrongdoing. Her lawyer, Abbe Lowell said the disputed filings were either mistaken or based on outdated records and accused the Trump administration of political retribution. 'She will not be intimidated by bullies, no matter who they are,' a spokesperson was quoted as saying by the BBC.

Trump push drives stablecoin urgency in Asian financial hubs
. . . 1 2 Asian markets are hurriedly updating their stablecoin rules as President Donald Trump's embrace of US dollar-pegged cryptocurrencies instils a fresh sense of urgency among the region's authorities. Recent developments in South Korea, Hong Kong, Malaysia, Thailand and the Philippines point to a proliferation of stablecoins pegged to Asian currencies - even as authorities raise concerns about capital outflows. Regional heavyweights like and Ant Group plan to capitalise by applying to become issuers. Shares in Kakaopay ballooned on expectations that it would do the same. Even China, which has for years imposed a sweeping crypto ban, appears to be warming to the notion of tokens that serve as yuan surrogates. It all stems from the US, where lawmakers recently passed legislation that will promote wider use of digital tokens that seek to maintain a 1:1 peg with the dollar. The White House earmarked dollar stablecoins as a priority in a Jan executive order, days after Trump's inauguration. "The Genius Act has opened the floodgates for stablecoin adoption," said Benjamin Grolimund, general manager for the UAE at crypto exchange Flipster. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like 15+ Food That Clean Arteries (Most People Ignore) Undo "Whether you support it or not, stablecoins are now unavoidable." Overhanging Asia's flurry of activity is the fear of capital flight. The dollar reigns supreme in today's stablecoin market, with $256 billion in tokens pegged to the greenback. These maintain their price by managing reserves of cash-like assets, such as US Treasuries. By contrast, there's just $403 million of euro-backed stablecoins in circulation, despite a well established regulatory framework covering such products in the form of the Markets in Crypto-Assets Regulation regime. The crypto-curious nation of South Korea offers a case-in-point. Koreans are already piling into dollar-pegged stablecoins. Transactions involving USDT, USDC and USDS - three of the largest dollar proxies - on five domestic exchanges reached 57 trillion won ($41 billion) in the first quarter, Yonhap News reported, citing Bank of Korea. While China's next steps are far from certain, crypto firms including brokers are already preparing for the prospect of yuan-pegged stablecoins. Kennix Chan, VP at Victory Securities, said the firm is in active talks with a range of would-be issuers in Hong Kong. ‘Son of soil' Gavai attributes his rise to Ambedkar, Constitution
1 2 Nagpur: CJI Bhushan Gavai on Saturday made an emotional return to Deekshabhoomi, not as a guest but as "a son of the soil", crediting his rise from a semi-slum school in Amravati to the nation's highest judicial office, transformative legacy of Dr Babasaheb Ambedkar and the Constitution. "If there was no Dr Ambedkar and no Constitution, I would not be in the Chief Justice's chair," he said, addressing students at the Dr Babasaheb Ambedkar College diamond jubilee celebrations at Deekshabhoomi on Saturday. Gavai said he had visited the sacred Deekshabhoomi every Dhamma Chakra Pravartan Din since childhood. "This is not a ceremonial visit. It's deeply personal. I have a lifelong emotional connect with this place," he said, standing alongside CM Devendra Fadnavis, senior judges including Shree Chandrashekhar, Nitin Sambre, Anil Kilor, Anil Pansare, Prafulla Khubalkar, Abhay Mantri, and others. Praising Ambedkar's choice of Buddhism over other religions, Gavai said, "Despite offers to embrace Islam and Christianity, Babasaheb chose Buddhism because it ensures equality for all." He cited the 1981 silver jubilee of the Buddhist movement when former Governor and his late father RS Gavai brought Dr Ambedkar's ashes to Nagpur. "I remember the massive procession in the city. My father carried the ashes on his head. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like These Are The Most Beautiful Women In The World Undo It was a defining moment," he recalled. The CJI also reflected on the Ambedkar college's early struggles when staff salaries were unpaid, and operations ran out of a temporary structure. "My father and Dadasaheb Kumbhare sought help from Manoharbhai Patel in Gondia, who agreed to support on the condition they'd have meals with him at his home one day," he said, praising such sacrifices that built the institution "brick by brick". He lauded the college's evolution into a NAAC-accredited institution. "Back then, the college struggled to get students. Today, under principal Deepa Panekar, it is thriving. It's a symbol of what grit and Ambedkarite values can achieve," he said. Highlighting women's empowerment as a true tribute to Dr Ambedkar's vision, Gavai noted that "80% of today's achievers here are girls". Among them was his own daughter Karishma, who bagged 15 gold medals in LLB and seven medals in LLM, presented by CM Fadnavis during the event. "Ambedkar always said the progress of a society is reflected by the progress of its women. This campus is proving that," he added. Gavai also praised young changemakers like Nikhil, a student who worked with malnourished tribal children in Melghat. "Even after I could no longer work there, doctors like Abhay Bang, Ashish Satav, and Madhukar Kolhe selflessly continued their mission. They could have earned lakhs in cities but chose to serve the poor," he said, calling them "real leaders". He urged students to rise in their careers but never forget their roots. "Dr Ambedkar said there's a difference between a great person and an eminent one — the latter serves society. Always remember your responsibility, no matter how high you rise," he advised. Recounting his student days, the CJI also revealed his contribution to the popular Bhim Geet composed by poet Suresh Bhat. "I helped Bhat Saheb with lyrics when he was in Mumbai and was moved to tears while reciting it. That journey — from the narrow lanes of Amravati to the Supreme Court — is thanks to Babasaheb's ideology of socio-economic equality, justice, and the Indian Constitution," he concluded. The event was attended by Maharashtra social justice minister Sanjay Shirsat, Bhadant Nagarjun Arya Surai Sasai of Deekshabhoomi Smarak Samiti, former Nagpur University registrar Puran Meshram, and others.
