Public outcry and media coverage do not lessen the seriousness of an offence, the Delhi High Court has said while denying bail to a man accused of raping and murdering his eight-year-old cousin. (HT Archive)
The man was booked under various provisions of Indian Penal Code including murder, kidnapping, and Section 6 (penetrative sexual assault) of Protection of Children from Sexual Offences (Pocso) Act, 2012.
The FIR, filed in 2016, was based on a complaint by the victim's father, who reported that his daughter had been abducted while playing outside their home. Police learned that the accused had raped the girl, strangled her, concealed her body in a plastic bag, and buried it in a pit.
In his bail petition, the man said he was falsely implicated in the case under public pressure and glare of media trial. He said he had already spent more than nine years in jail and there was no likelihood of the trial to conclude in the near future.
The Delhi police, represented by additional public prosecutor Amit Ahlawat, said there had been no delay in trial and four out of 20 witnesses had supported prosecution's case. The complainant's lawyer opposed the bail asserting that the accused's family members had been threatening him.
Rejecting the man's contention, justice Girish Kathpalia in his ruling delivered on Friday, said , 'The broad picture recorded above shows the gruesome manner in which an eight-year-old girl was raped and killed, that too by her own cousin. Merely because there was public outcry and media coverage of the incident, gravity of offence does not get diminished.'
In its five-page ruling, the judge said the man exploited the relationship of trust between the cousins in a 'brutal manner.' 'One also cannot ignore that a relationship of trust between the cousins was exploited by the accused/applicant and in such a brutal manner,' the court said.

He raised concern over a renewed surge in tiger trade and offered a detailed overview of India's illegal wildlife trade (IWT), particularly the illegal pet trade and its ecological impact. He urged enforcement agencies to prioritise the issue. The second session, led by Delhi high court advocate Lovish Sharma, focused on recent amendments to the Wildlife (Protection) Act, including the integration of the Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES). Mumbai: In a shocking incident of extortion and violence, a 44-year-old badminton coach was brutally attacked by three local goons who demanded a weekly ransom of Rs 1,000 from him. The incident took place late night on Sunday evening at Babasaheb Ambedkar SRA Building in Prabuddha Nagar, Chembur. The complainant, Prafulla Ghatvisave, was chatting with a friend near his residence when the accused—identified as Sunny Madhukar Bhosale (30), Sunny Ramdas Buchude (32), and Vikas Khetre (28)—approached the victim saying he was from Sunny gang. They demanded that Ghatvisave pay them Rs 1,000 per week from the rent of a room belonging to his friend's sister, Shobha Sakhra. When he refused, the accused forcibly snatched his gold bracelet and assaulted him. Amidst the scuffle, Sunny Bhosale allegedly pulled out a broken beer bottle and stabbed Ghatvisave in the stomach multiple times, leaving him grievously injured. Ghatvisave was immediately rushed to Sion Hospital, where he is currently undergoing treatment. A Delhi court Monday accepted the closure report filed by the Central Bureau of Investigation (CBI) in favour of Aam Aadmi Party (AAP) leader and former Delhi minister Satyendar Jain in a case related to alleged irregularities in hiring in the Public Works Department (PWD). 'When the investigating agency has not found any incriminating evidence over such a long period to prove the commission of any offence, particularly under the POC (Prevention of Corruption) Act, 1988, further proceedings would serve no useful purpose,' said Special Judge Dig Vinay Singh of Rouse Avenue Court in his order. 'When CBI could not find any evidence of criminal conspiracy, abuse of power, pecuniary gain, or wrongful loss to the Government Exchequer, and the alleged acts are at most administrative irregularities, no offence under section 13(1)(d) of the Prevention of Corruption Act or criminal conspiracy is established,' he added. The CBI had claimed in its report that it found no irregularities in the case after an investigation that lasted almost four years. On May 29, 2019, an FIR was lodged against Jain, the then PWD minister, in the case based on a complaint from the Directorate of Vigilance, which alleged irregular engagement of professionals in the PWD in violation of rules, and payments made from unrelated project funds. The allegations against Jain involved hiring a 17-member creative team of consultants irregularly for PWD projects without proper approvals from the Finance department by bypassing 'standard recruitment procedures'. After an FIR was registered, the CBI examined the justification and need for hiring such professionals, the transparency behind the recruitment process and the approvals and use of project funds, among others. Following its investigation, the CBI concluded that the need to hire professionals was justified. It also found that the hiring process began with an open advertisement that resulted in 1,700 applications for the jobs. The agency also found that the selection was based on merit. The CBI stated that the hiring of professionals was necessary due to urgent departmental needs and that no payments were made beyond prescribed norms and approved limits. At the time of hiring, it pointed out, there were close to 50 per cent vacancies in the posts of architects and that major infrastructure projects had to be executed in a time-bound manner by the then Delhi government.
