Zayn Rayyan's father says child neglect charges against him, wife absurd

PETALING JAYA: Zaim Ikhwan Zahari contended today that he and his wife should never have been charged with child neglect in connection with the death of their six-year-old autistic son, Zayn Rayyan Abdul Matin, in 2023.
The 30-year-old said this after he was acquitted of the charge by Sessions Court judge Dr Syahliza Warnoh.
However, his wife, Ismanira Abdul Manaf, also 30, was ordered to enter her defence after Syahliza ruled that the prosecution had established a prima facie case against her.
Speaking outside the courtroom, Zaim said he was disappointed with the police, despite the full cooperation he and Ismanira had given throughout the investigation.
"I cooperated fully and placed my trust in the police to find and arrest my son's killer, who is still out there, free.
"But this is the result of it (wife told to enter defence)? I am extremely disappointed.
"There should have been no charges. This is all ridiculous," he said.
Ismanira took the stand as the first witness today after Syahliza ordered her to enter her defence for the charge under Section 31(1)(a) of the Child Act.
She is accused of committing the offence between 12pm on Dec 5 and about 9.55pm on Dec 6, 2023, around Block R, Apartment Idaman, Damansara Damai, up to a nearby stream.
Zayn Rayyan was reported missing from Block R of the apartment on Dec 5, 2023, after Ismanira fetched him from school at 12.30pm.
His body was found a day later in the stream, about 200m from his home.
Lawyers Haresh Mahadevan, Ramzani Idris, and Lavanesh Haresh acted for the couple.
The prosecution is represented by deputy public prosecutors Raja Zaizul Faridah Raja Zaharudin, Aqharie Durranie Aziz, and Nur Sabrina Zubairi.

KOTA KINABALU (July 24): A businessman pleaded not guilty in a Sessions Court here today to three charges of cheating in connection with the acquisition of an honorary 'Dato'' title. Datuk Ling How Ee, 40, entered his plea before judge Jason Juga, who had the charges read to him in Mandarin. Ling is accused of dishonestly inducing a man to transfer RM2,500, RM500, and RM3,000 into his bank account for the purported purchase of gold accessories for ceremonial attire, and to assist in securing a 'Dato'' title from Pahang, despite having no authority to do so. The alleged offences took place at a bank branch here on April 19, April 20 and May 17, 2023. All the charges fall under Section 420 of the Penal Code, which carries a penalty of imprisonment between one and ten years, whipping, and a fine upon conviction. The court set September 3 for pre-trial case management. Ling was granted bail of RM10,000 with a RM3,000 deposit and one local surety. Additional conditions imposed included reporting to the Malaysian Anti-Corruption Commission (MACC) once every two months, surrendering his passport to the court (if any), and refraining from contacting or interfering with prosecution witnesses. He was represented by counsel Ngui Kuang Kee @ George Ngui. Ling was arrested on July 2 after giving a statement at the Sabah MACC Office.

No plea was recorded from Pui Yong Fock, 31, who nodded in understanding after the charges under Section 376(1) of the Penal Code were read to him in Mandarin by a court interpreter. The Section provides for up to 20 years' imprisonment and whipping, upon conviction. Pui, from Sungai Rait, Jalan Bakam, was charged with committing the offence against a 15-year-old girl on July 12, July 16, and July 17, each at around 1am at the same location along Jalan Niah-Bintulu. Magistrate Ashok Linggam set Aug 19 for further mention of the case at the Sessions Court following an application by deputy public prosecutor Muhammad Asymawi Ghazali. The court also denied the accused bail and ordered him to be further remanded pending the date.

KUCHING (July 24): The Sessions Court here today sentenced an unemployed man to six months in prison for stealing electricity to power cryptocurrency mining machines at a rented shoplot. Judge Saiful Bahari Adzmi convicted Hii King Lee, 49, on his own guilty plea to a charge under Section 33(5) of the Electricity Ordinance (Chapter 50), which provides for a fine not exceeding RM200,000 or imprisonment for up to five years, or both. Hii, from Miri, committed the offence at a commercial shop lot in Siburan, Jalan Kuching-Serian at around 10.50am on June 21, 2023. Based on the facts of the case, a team of inspectors from Syarikat Sesco Berhad were conducting routine inspections of electricity meters at the commercial premises when they detected direct-tapping cables connected from the main wirings that bypassed the electricity meter. Further checks found 60 cryptocurrency mining machines connected directly via the direct-tapping cables, all of which bypassed the electricity meter. It was informed that Hii is currently serving a six-month jail sentence for power theft linked to cryptocurrency mining activities, after he was convicted on July 11 this year at the Miri Sessions Court. The accused is also currently facing several drug-related cases and corruption cases in Miri. Deputy public prosecutor Ronald Felix Hardin of the State Attorney-General's Chambers handled the prosecution, while Hii was unrepresented. Meanwhile in the same courtroom, Chang Foh Foong, 53, the landlord who rented the shoplot to Hii, was jointly charged with the same offence but was given a discharge not amounting to an acquittal (DNAA). His lawyer Michael Kong in a statement to the press after the proceedings said his client maintained that he had no role in the offence committed by his tenant. 'After considering the circumstances and lack of direct involvement, the charges against the landlord were withdrawn, and the court granted him a DNAA,' he said. Kong said his client's only mistake was renting the premises to the wrong tenant and failing to transfer ownership of the electricity meter from his name to the tenant's after the tenancy agreement was signed. 'This incident should serve as a serious reminder to all property owners to always ensure that the name on your electricity meter reflects the current user or tenant. 'Failing to do so may expose you to criminal liability even if you had no involvement in any wrongdoing,' he added. Kong urged landlords and property managers to be vigilant and proactive in managing their tenancy agreements. 'It is not just about protecting your rights, but also safeguarding yourself from unnecessary legal consequences.'
