PHC seeks reply on PTI's independents petition

The Peshawar High Court (PHC) has issued a written order in response to a petition filed by Khyber-Pakhtunkhwa Chief Minister Ali Amin Gandapur, challenging the Election Commission of Pakistan's (ECP) decision to declare Pakistan Tehreek-e-Insaf (PTI) lawmakers as independent members of the provincial assembly.
The bench, comprising Justice Ijaz Anwar and Justice Faheem Wali, has sought a response from the Attorney General's Office. According to the written order, the Additional Attorney General has been directed to submit a reply before the next hearing. The court also ordered that this petition be heard alongside other related petitions filed by the Chief Minister and the Speaker of the K-P Assembly. The hearing has been adjourned until August 5.
Chief Minister Gandapur filed the constitutional petition against the ECP's decision to strip PTI-affiliated assembly members of their party status and designate them as independents. In a related matter, the Chief Minister and the Speaker have also challenged the oath-taking of women elected on reserved seats at the Governor House, requesting the court to declare the move null and void.
In his petition, Gandapur contended that PTI remains a functioning political party and still holds a majority in the K-P Assembly. He argued that the ECP's exclusion of PTI from the legal definition of a political party is unlawful. According to the ECP rules, a party must possess an election symbol to be officially recognized; however, Gandapur pointed out that under the Elections Act, 2017, the presence of an election symbol is not a mandatory criterion for political party recognition. He maintained that where there is a conflict between election rules and the Act, the provisions of the Act must prevail.
The petition asserts that the ECP has no authority to declare PTI candidates as independents, and it requests the court to declare PTI lawmakers as legitimate party members.
Furthermore, Gandapur urged the court to nullify the allocation of reserved seats, alleging that PTI was unjustly denied its rightful share despite being the majority party. The petition also calls for multiple ECP orders to be declared unlawful, citing deliberate exclusion of PTI in the distribution of reserved seats and allocation to rival parties.
Meanwhile, PHC on Saturday deferred further proceedings and transferred the case to another bench regarding a petition filed against the sharing of videos from an event at Women University Swabi on TikTok.
During the hearing, Deputy Commissioner (DC) Swabi Nasrullah, Additional Assistant Commissioner Fakhar Alam, and representatives of Women University Swabi appeared before the court. The case was heard by a bench comprising Justice Ejaz Anwar and Justice Faheem Wali.
The petition, filed by Advocate Muhammad Hamdan, alleged that videos from a university event, attended by the DC and other officials, were later uploaded to the DC's personal TikTok account. The petitioner argued this act violated several articles of the Constitution and the official Code of Conduct, which may warrant penalties including dismissal from service.
Advocate Hamdan contended that the DC's actions were contrary to social and cultural norms, sparking concern among the local community.

Talking to journalists, PTI spokesman Sheikh Waqas Akram said the sons of Imran Khan — Suleman and Kasim — are Pakistani nationals holding National Identity Cards for Overseas Pakistanis (NICOPs), and should be legally allowed to enter the country. The party alleged that the authorities have not responded to the visa applications submitted to the Pakistan High Commission in London. Akram said both applications had been filed and assigned tracking numbers, but claimed that officials cited the need for clearance from Islamabad and the Ministry of Interior, followed by a lack of response. 'IK's sons submit visa applications' 'The Ministry of Interior has stated that visa issuance falls under the jurisdiction of the Ministry of Foreign Affairs and the ambassador,' he said, adding that this contradicted official statements that no applications had been received. PTI also released NICOP details for both sons. Kasim's NICOP expired in 2021 and is currently under renewal, while Suleman's document remains valid until 2030. The party called on the government to facilitate their entry rather than delay it, describing the obstruction as politically motivated. Separately, PTI condemned what it described as a crackdown on party members and the closure of motorways ahead of its planned nationwide protest on August 5. The Punjab government said the restrictions were related to the visit of the Iranian president. PTI has called for mass demonstrations to demand judicial independence, media freedom, and the release of its leader. The party maintains that Imran Khan's imprisonment is politically driven and unconstitutional. LONDON: Kasim Khan, the son of Pakistan Tehreek-e-Insaf (PTI) founder Imran Khan, has said that US President Donald Trump is the only world leader who can make a difference in his father's case and help secure his release. Kasim Khan and his brother Suleman Khan gave an exclusive interview to British journalist Piers Morgan. During the interview, Kasim Khan stated that he had also met Trump's close aide Richard Grenell, who has been active on social media for Imran Khan's release, to discuss cases against his father. It may be recalled that 26-year-old Kasim and 28-year-old Sulaiman publicly spoke out for the first time against their father's imprisonment in May this year. Responding to questions, Kasim Khan said, 'We know that our father and President Trump had a cordial relationship in the past. When both were in power, they had great conversations and both respected each other.' He further said that if Trump issues a statement or contacts the Pakistani establishment at some level, it could play a significant role in Imran Khan's release. Kasim Khan said it has been three years since he last met his father, adding he has not spoken to him for the past four months.

ISLAMABAD: Pakistan Tehreek-e-Insaf (PTI) founding chairman Imran Khan on Saturday said that his sons will come to Pakistan to meet him and will stay away from politics and any protest movements. Talking to media persons informally in Adiala Jail during the hearing of Toshakhana-II case against him, Khan also confirmed that he had spoken to his sons, Suleman Khan and Kasim Khan, for over an hour. 'My sons will come to meet me. They will not be involved in any political activity or movement,' he said. The jailed former Prime Minister also confirmed that his access to newspapers and television had been restored. Outside Adiala Jail, Khan's sister Aleema Khan, while relaying his [Khan] message to the media, said that Khan had urged Khyber Pakhtunkhwa Chief Minister Ali Amin Gandapur military operations should not be carried out in the province. Khan also emphasised the importance of maintaining friendly relations with Afghanistan, calling it a neighbouring country with which ties should remain cordial. She said that Khan further said that PTI will not participate in the by-elections for seats which were vacated after illegal disqualification of PTI parliamentarians. Regarding Khan's sons, she said both hold National Identity Cards for Overseas Pakistanis (NICOP) and have applied for renewals through the Pakistan Embassy in London. They can take months to issue them new copy. Do they not want to issue visas to children? She asked. Earlier, the special court, hearing the Toshakhana-II case against Pakistan Tehreek-e-Insaf (PTI) founding chairman Imran Khan and his wife, Bushra Bibi summoned two more witnesses for recording their statements after the defence counsel completed cross examination of witnesses summoned during the previous hearing. Special Judge Central Shahrukh Arjumand, while hearing the case at Adiala Jail, adjourned the case till August 6 and summoned two more witnesses including Rabia and Sana for recording their statements. Jail authorities produced Khan and his wife before the court. Khan's counsel Qausain Faisal Mufti and Bushra Bibi's lawyer Arshad Tabrez as well as Prosecutor Zulfiqar Abbas Naqvi appeared before the court. During the hearing, the court completed recording the statement of prosecution witness Assistant Director National Accountability Bureau (NAB) Aftab Ahmed. Khan's lawyer Qausain Mufti will conduct cross examination of Aftab Ahmed during the next hearing. Bushra Bibi's lawyer completed cross examination of prosecution witness Ahmed.
