Malaysian Maritime Enforcement Agency foils bid to smuggle out controlled items

LAHAD DATU: The Malaysian Maritime Enforcement Agency (MMEA) foiled an attempt to smuggle out controlled items via Tanjung Batu waters. Lahad Datu Maritime Zone Director, Maritime Commander Dzulfikhar Ali, said a suspicious boat attempted to escape upon realising the presence of MMEA personnel during Ops Pluto Timur and Ops Tiris at about 10.30pm last Saturday. He said the boat was intercepted after 10 minutes of pursuit and upon inspection found two undocumented Filipinos aged between 34 and 41 on board. 'The boat was also found to be carrying 17 gallons containing petrol and 51kg of packaged cooking oil,' he added The detained crew as well as seized items worth RM80,000 were taken to Felda Sahabat maritime jetty for further action. The case is being investigated under the Control of Supply Act 1961, Immigration Act 1959/63 and Sabah Port and Harbours Enactment. In a separate case, the MMEA detained a fishing vessel off Pulau Tabawan, Kunak waters, for violating licence terms, on Sunday. Dzulfikhar said the vessel, operated by four individuals aged between 27 and 39 comprising three Filipinos including the skipper and a local, was detained at about 11.45am. He said further investigation found the vessel was in violation of the Fisheries Act 1985 for fishing less than 1.5 nautical miles from the shore. The boat and the crew were brought to Lahad Datu fishery jetty for further action. Siti Kasim awarded RM160,000 in damages over unlawful arrest by Jawi
KUALA LUMPUR: The High Court has awarded lawyer and activist Siti Kasim RM160,000 in damages after allowing her civil suit against the Federal Territories Islamic Religious Department (Jawi), 15 of its officers, and seven others over her unlawful arrest and detention during a private fundraising event in 2016. In his judgment, High Court Judge Su Tiang Joo ordered the defendants to pay RM100,000 in exemplary damages, RM60,000 in aggravated damages, and RM100,000 in legal costs to the plaintiff (Siti Kasim). The court held that Siti Kasim, whose full name is Siti Zabedah Kasim, had proven on the balance of probabilities that she was wrongfully arrested and falsely imprisoned by two Jawi officers after exiting the ballroom of the hotel where the event was held. "In my considered view, there was misfeasance in public office by the defendants in conducting a raid and apprehending a participant at a state event, without ensuring the lawful exercise of their powers, thereby causing unnecessary fear and discomfort," the judge said. Siti Kasim filed the suit in September 2019, claiming false imprisonment, misfeasance in public office, and a violation of her constitutional right to personal liberty under the Federal Constitution. She maintained that she had not obstructed any officer and was merely discharging her duties as a legal practitioner at the time of the incident. On August 21, 2020, the magistrates' court here acquitted and discharged Siti Kasim of the charge of obstructing public servants, ruling that the prosecution had failed to establish a prima facie case under Section 186 of the Penal Code. – Bernama

Man in Melaka charged with murdering girlfriend's baby

(File pic) PETALING JAYA: An assistant at a fishing equipment shop was charged in the Alor Gajah magistrates' court today with murdering his girlfriend's 19-month-old baby girl early this month. Bernama reported that Isyraf Hifhzan Abdullah, 20, nodded when the charge against him was read before magistrate Teo Shu Yee. Advertisement No plea was recorded as the case falls under the High Court's jurisdiction. Isyraf is accused of murdering the child on the third floor of a shop in Bandar Satelit Pulau Sebang, Alor Gajah, at around 9pm on July 6. If convicted, he faces the death penalty or 30 to 40 years' imprisonment and no less than 12 strokes of the rotan under Section 302 of the Penal Code. Deputy public prosecutor Fiqri Hakim Zamri did not offer bail, and requested a new date for the handover of the autopsy report. Isyraf was unrepresented. The court set Sept 23 for re-mention of the case and did not offer bail. It was reported on July 7 that a couple was suspected of abusing and killing a baby the night before. An inspection by a doctor at Tampin Hospital found bruises to the baby's stomach and back, and injury to the anus. The doctor lodged a police report, leading to the couple's arrest.
