SC closes PFI' leaders' interim bail case after State agrees to provide physio in Tihar
ANI 27 Jun 2025, 14:44 GMT+10 New Delhi [India], June 27 (ANI): The Supreme Court on Friday closed the plea filed by Popular Front of India (PFI) leader and UAPA accused AS Ismail seeking interim bail on medical grounds, after noting the State authorities' assurance that physiotherapy facilities are available in Tihar Jail and will be provided to him as per medical advice. The bench had earlier rejected Ismail's interim bail request and sought a response from the State on whether adequate medical care could be ensured within the jail premises. Senior counsel Archana Pathak Dave appearing for the State authorities (Delhi government) informed a bench of Justices KV Viswanathan and N Kotiswar Singh that physiotherapy as sought by Ismail is available in Tihar jail one and if so required by the petitioner, the same can be provided in Tihar jail three as well, depending on the medical advice of an authorized doctor. After noting the same, the bench disposed of the matter. In the last hearing, the top court had refused to grant interim bail to Ismail over medical grounds and had asked the Tihar Jail authorities whether he could be provided physiotherapy inside the jail. Ismail had moved a plea seeking interim bail on medical grounds. He has been arrested by the National Investigation Agency (NIA) under the UAPA for allegedly radicalising Muslim youth and inciting them against the Indian government and other organisations that do not support the establishment of Islamic rule in India. Ismail was earlier associated with the banned Students Islamic Movement of India (SIMI), served as PFI's Tamil Nadu president, and later became a member of its National Executive Council. After satisfying itself of the submissions in today's hearing, the Court closed the matter. (ANI)

Delhi HC denies interim bail to AS Ismail, orders continued medical care
New Delhi [India], May 16 (ANI): The Delhi High Court has denied interim bail to Popular Front of India (PFI) leader AS Ismail, accused under the Unlawful Activities (Prevention) Act, 1967, stating there was no need to interfere with the trial court's ruling. A bench of Justices Subramonium Prasad and Harish Vaidyanathan Shankar rejected Ismail's appeal, citing significant improvement in his medical condition. According to AIIMS reports, he now has only mild facial asymmetry, his right-side weakness has improved, and he is no longer wheelchair-bound. However, the Court ordered that he continue physiotherapy and prescribed medications, with regular blood pressure monitoring and monthly checkups at AIIMS. The National Investigation Agency (NIA) alleges Ismail was part of a conspiracy led by PFI members to collect funds domestically and internationally for terrorist activities across various states. According to the NIA, he was previously associated with the banned Students Islamic Movement of India (SIMI), served as PFI's Tamil Nadu president, and later became a National Executive Council member. He is accused of radicalising youth and inciting them against the government and non-Islamic leadership, allegedly disrupting communal harmony and national integrity. Ismail was arrested in September 2022, with chargesheets filed in March and April 2023. He had earlier sought interim bail citing his daughter's marriage, which the trial court rejected, but granted him custody parole for eight days. In October 2024, he suffered a stroke and was treated at Safdarjung Hospital. Later, the Supreme Court extended his parole for medical treatment at Apollo Hospital, New Delhi. He later applied for six months' interim bail for further treatment at Royal Care Super Speciality Hospital, Coimbatore. Still, the trial court denied it in December 2024, leading to his current appeal. (ANI)

This indicates that the appellant is being given proper treatment in Jail," the bench court in its May 13 order added, "Moreover, the latest medical report by the medical board of the AIIMS shows that the condition of the appellant is not such that it will deteriorate if the appellant is not granted interim bail, as prayed for by the appellant."The court directed the jail authorities to continue with the treatment as prescribed by the doctors including regular physiotherapy and continuous monitoring of the blood pressure of Ismail who was arrested on September 22, jail authorities were further asked to take him to AIIMS once every month for his condition to be to the NIA, the case relates to conspiracy hatched by the office bearers, members and cadres of PFI who were involved in raising or collecting funds from within India and abroad through banking channels, Hawala and donations for committing or getting committed, terrorist acts in various parts of India including Kerala, Tamil Nadu, Karnataka, Uttar Pradesh and the arrest of all accused persons, including the appellant, a chargesheet was filed against 19 accused persons, which included PFI, under the provisions of the Unlawful Activities (Prevention) NIA alleged Ismail was involved in the conspiracy of radicalising the gullible muslim youth by provoking them against the Indian government and leaders of organisations who do not believe in the establishment of islamic rule in India.
