BARGARH : The Additional District and Sessions Court in Padampur on Wednesday sentenced a man and his mother to 10 years of rigorous imprisonment (RI) in connection with a dowry death case. The convicts, Suresh Bhue and his mother Sukanti Bhue of Jhar village under Sohela police limits, were found guilty of the charges related to the dowry death of Priyanka Bhue. Priyanka had married Suresh in March 2019 and died of severe burn injuries on August 16 the same year. Investigations revealed that she had been subjected to repeated physical and mental harassment over dowry demands. The court sentenced both Suresh and Sukanti to 10 years of RI under sections 304 (B)/34 of the IPC. Additionally, they were awarded three years of imprisonment and a fine of Rs 5,000 each under section 498 (A)/34 of the IPC. They were also sentenced to a one-year jail term under the Dowry Prohibition Act, along with a fine of Rs 2,000 each.

The second Additional District and Sessions Court, Dakshina Kannada, overturned the acquittal order of lower court to impose fine of ₹11,500 on a lorry driver for assault of police sub-inspector (PSI), Mangaluru South Police Station, on U.P. Mallya Road in Mangaluru in July 2013. Judge V.N. Jagadeesh, on June 25, convicted Kiran Johnson Pereira, 31, of Farangipet, for offences punishable under sections 506 (criminal intimidation), 323 (voluntarily causing hurt) and 332 (voluntarily causing hurt to deter public servant from duty) of Indian Penal Code (IPC) and under Rule 69 read with section 177 of Indian Motor Vehicle (IMV) Act. The judge imposed fine of ₹5,000 each for offences under sections 332 and 506 of IPC, and ₹1,000 for offence under section 323 of IPC. The lorry driver was asked to pay fine of ₹500 for the offence under Rule 69 read with section 177 of IMV Act. In the judgement the judge observed that there was evidence to show that the lorry driver on July 29, 2013, drove his vehicle on the road where Deputy Commissioner has barred movement of heavy vehicles between 8 a.m. and 8 p.m. On being questioned by the PSI discharging duty on the road, the lorry driver assaulted the PSI, gave a life threat to the officer. After the driver was assaulted by people, he abandoned the vehicle and ran away, the judge noted. The second Judicial Magistrate First Class (JMFC) Court, Mangaluru, on December 29, 2023 acquitted the lorry driver. Allowing the appeal filed by the State, Judge V.N. Jagadeesh said the finding recorded by the trial court was contrary to the evidence available in the case. The judge directed the trial court (2nd JMFC) to secure presence of the accused to pay the fine amount. The entire fine amount of ₹ 11,500 should be remitted to the government, the judge stated.

Mangaluru court grants bail to five accused in mob lynching case

The second Additional District and Sessions Court, Mangaluru, granted bail to five persons arrested in connection with the mob lynching of 38-year-old ragpicker Ashraf, near Kudupu on the outksirts of Mangaluru, on April 27. Bail applications of another seven persons are pending before the court. Police had arrested 20 persons in connection with the case. The court granted bail to Rahul, a resident of Kadri, and K. Sushanth, a resident of Kudupu, on May 31. Bail was granted to Sachin, a resident of Kudupu; Deekshith, a resident of Padil; and Sandeep Basavarajappa Haveri, a resident of Kudupu; on June 5. The bail applications of Saideep, Anil Kumar, Yathiraj, Viviyan Alvaris, Shri Dattha, Dhanush and Kishore Kumar are pending before the court. On April 27 evening, Ashraf, a 38-year-old native of Wayanad in Kerala, reportedly entered a playground near Kudupu where a cricket tournament was in progress. He allegedly raised slogans in support of Pakistan. This lef to more than 25 persons, who were playing cricket, allegedly assaulting Ashraf resulting in his death. Mangaluru Rural police arrested 20 persons for offences punishable under Sections 103 (2)b (mob lynching), 115 (2) (voluntarily causing hurt), 189 (2) (unlawful assembly), 191 (1) (rioting), 191 (3), 240 (giving false information with respect to an offence) read with Section 190 of Bharatiya Nyaya Sanhita, 2023. In the judgment allowing applications of Rahul (accused no. 10) and Sushanth (accused no. 20), the judge observed that while the incident occurred at 3 p.m. on April 27, statements of witnesses were recorded on April 28 night, and the first information report was received by the jurisdictional magistrate on April 29 morning. 'This fact creates serious doubt regarding the manner of occurrence of the incident, involvement of the petitioners and other accused named in the FIR, and the first information statement,' the judge observed. In a separate judgments granting bail to Sachin (accused no. 19), Deekshith (accused No. 17) and Sandeep Haveri (accused no. 16), the judge made note of the bail granted to Rahul and Sushanth. The judge said names of Sachin, Deekshith and Sandeep Haveri were not found in the compliant. Presence of the three petitioners at the time of the incident has to be proved by the investigation agency by filing a detailed charge-sheet, the judge noted. In the hearing on separate bail applications of Saideep and six others on June 6, the court had directed the investigation officer to submit confidentially on June 9 the list of arrested persons whose voice samples are to be collected.

An Uttarakhand court on Friday sentenced the son of a former Bharatiya Janata Party leader and his two associates to life imprisonment in the 2022 Ankita Bhandari murder case, India Today reported. The Additional District and Sessions Court in Kotdwar also imposed a fine of Rs 50,000 each on Pulkit Arya, son of former BJP leader Vinod Arya, and his associates Saurabh Bhaskar and Ankit Gupta. All three were convicted for the murder of the 19-year-old. Bhandari was a receptionist at a resort in Uttarakhand's Rishikesh that was owned by Pulkit Arya. She went missing on September 18, 2022. A day later, Pulkit Arya, along with Bhaskar, who was the manager of the resort, and Ankit Gupta, its assistant manager, filed a missing person report. They later confessed to killing Bhandari by pushing her into a canal after an altercation. Messages sent by Bhandari to a friend on the messaging platform WhatsApp, which were uncovered later, suggested that the men had allegedly tried to force the 19-year-old into prostitution. Bhandari's body was recovered from the Chilla Canal in Rishikesh six days after she went missing. A preliminary forensic examination of visceral samples ruled out that she had been sexually assaulted. A Special Investigation Team had filed a 500-page chargesheet listing 97 witnesses in the case, of whom 47 testified during the trial that began in March 2023. Pulkit Arya and the two co-accused were charged under sections of the Bharatiya Nyaya Sanhita pertaining to murder, destruction of evidence and sexual harassment. They were also booked under the Immoral Traffic Prevention Act and the Gangster Act.

An Uttarakhand court on Friday convicted Pulkit Arya, the son of a former BJP leader, and two others — Saurabh Bhaskar and Ankit Gupta — for the 2022 murder of 19-year-old receptionist Ankita Additional District and Sessions Court in Kotdwar held all three accused guilty of killing Ankita, who worked at the Vanantara Resort owned by Pulkit Arya in the Yamkeshwar area of Pauri had gone missing on September 18, 2022. Days later, her body was recovered from the Chilla canal, and the incident rapidly turned into a national flashpoint over women's safety, political influence, and justice delivery. Allegations of a botched early investigation and political shielding further inflamed public anger.A Special Investigation Team (SIT) had filed a 500-page chargesheet, naming 97 witnesses, 47 of whom were deposed during the trial that began on March 28, Arya and two other accused were charged under Bharat Naya Sanhita sections 302 (murder), 201 (causing disappearance of evidence), 354A (sexual harassment), and the Immoral Traffic (Prevention) Act. Later, Gangster Act was also invoked against the three Arya, the son of now-suspended BJP leader Vinod Arya, is accused of pressuring Ankita Bhandari to provide 'special service' to clients at the ahead of the court's verdict, Ankita's mother urged the judiciary to sentence all the three accused to death. "May the criminals be sentenced to death...I appeal to the public of Uttarakhand to keep on supporting us and come to the Kotdwar court to boost our morale," she said while speaking to news agency Reel
