Mangaluru court grants bail to five accused in mob lynching case
Bail applications of another seven persons are pending before the court.
Police had arrested 20 persons in connection with the case.
The court granted bail to Rahul, a resident of Kadri, and K. Sushanth, a resident of Kudupu, on May 31.
Bail was granted to Sachin, a resident of Kudupu; Deekshith, a resident of Padil; and Sandeep Basavarajappa Haveri, a resident of Kudupu; on June 5.
The bail applications of Saideep, Anil Kumar, Yathiraj, Viviyan Alvaris, Shri Dattha, Dhanush and Kishore Kumar are pending before the court.
On April 27 evening, Ashraf, a 38-year-old native of Wayanad in Kerala, reportedly entered a playground near Kudupu where a cricket tournament was in progress. He allegedly raised slogans in support of Pakistan. This lef to more than 25 persons, who were playing cricket, allegedly assaulting Ashraf resulting in his death.
Mangaluru Rural police arrested 20 persons for offences punishable under Sections 103 (2)b (mob lynching), 115 (2) (voluntarily causing hurt), 189 (2) (unlawful assembly), 191 (1) (rioting), 191 (3), 240 (giving false information with respect to an offence) read with Section 190 of Bharatiya Nyaya Sanhita, 2023.
In the judgment allowing applications of Rahul (accused no. 10) and Sushanth (accused no. 20), the judge observed that while the incident occurred at 3 p.m. on April 27, statements of witnesses were recorded on April 28 night, and the first information report was received by the jurisdictional magistrate on April 29 morning.
'This fact creates serious doubt regarding the manner of occurrence of the incident, involvement of the petitioners and other accused named in the FIR, and the first information statement,' the judge observed.
In a separate judgments granting bail to Sachin (accused no. 19), Deekshith (accused No. 17) and Sandeep Haveri (accused no. 16), the judge made note of the bail granted to Rahul and Sushanth. The judge said names of Sachin, Deekshith and Sandeep Haveri were not found in the compliant. Presence of the three petitioners at the time of the incident has to be proved by the investigation agency by filing a detailed charge-sheet, the judge noted.
In the hearing on separate bail applications of Saideep and six others on June 6, the court had directed the investigation officer to submit confidentially on June 9 the list of arrested persons whose voice samples are to be collected.

'Love Jihad' gang busted in UP's Kushinagar, 2 women among 8 arrested
Kushinagar police have busted a gang allegedly involved in trapping Hindu girls in the guise of "Love Jihad" and forcibly converting them to Islam. According to the police, the accused confessed to being part of a well-organised network that targeted Hindu women for religious claimed the gang pursued the victim over a long period, manipulating her through emotional exploitation and inducements, and ultimately coerced her into conversion. They also said Taufiq Ansari used explicit videos and recorded conversations to blackmail the victim's Jahan and Fatima allegedly played a key role in psychologically manipulating the girl, showing her religious content to influence her FIR has been registered under the relevant sections of the Bharatiya Nyaya Sanhita (BNS) and the Uttar Pradesh Prohibition of Unlawful Religious Conversion Act, 2021. ‘Bride' tricks businessman man into trading, vanishes with Rs 1.28 crore
Thiruvananthapuram: A 32-year-old Manacaud-based businessman lost Rs 1.28 crore after an unidentified woman he met on a matrimony website persuaded him to invest in online trading. According to police, the man had created a profile on a matrimony site seeking suitable alliances and the accused woman expressed interest in May this year. She then sent him her family photos, shared other details and also promised to visit him with her family in Sept. After earning his trust, she shared a screenshot of her 'huge account balance' and claimed that she earned it through online trading. She then persuaded him to double his earnings through trading and shared a link for it. "She told me that she was from Thrissur and was working in a Delhi-based multinational company. I was very happy to have finally met a girl I truly liked. She shared with me a link for online trading. As per her direction, I invested a small amount initially and earned amazing returns. Later, I invested Rs 20 lakh and the website showed that I have earned Rs 70 lakh. Delhi HC rejects bail of suspected Isis member in arms case
NEW DELHI: Delhi HC has rejected the bail plea of a suspected Isis member accused of procuring arms and ammunition for the proscribed outfit and using social media to promote its objectives. In a recent order, a bench of justices Subramonium Prasad and Harish Vaidyanathan Shankar upheld a trial court detention order, stating it was not mechanical in nature. HC said accused Mohd Rizwan Ashraf could not be released due to the ongoing investigation, as releasing him and others at a crucial stage would impede the probe. "This court is satisfied that the trial court applied its mind to the grounds set forth. The trial court categorically observed the investigation progressed substantially during remand extensions granted by it and the investigation was not stagnant. Order of the trial court extended custody not as a matter of routine but based on credible material outlining the investigative steps requiring completion," the bench observed. Ashraf was arrested by NIA in 2023 under Unlawful Activities (Prevention) Act (UAPA) provisions. He challenged various orders of the trial court extending his custody, including on Feb 24, 2024, when his judicial custody was extended by 25 days. On the same day, the trial court dismissed his plea for default bail. Ashraf's counsel submitted the orders were passed by the trial court in a mechanical and perfunctory manner and did not indicate any individual assessment of his role. He argued NIA failed to demonstrate why Ashraf's continued detention was necessary for probe. However, HC said three accused persons, including Ashraf, were active ISIS and they were propagating the ideology of the organisation and trying to recruit youth for its objectives. "At the time when the remand orders were being considered, material was being unearthed to establish that the accused, including the appellant (Ashraf), were conducting recce at various Indian cities including, but not limited to, Delhi, Mumbai, Ahmedabad, and Surat for terrorist activities," it pointed out, adding conspiracy was also being hatched in other countries. "A money trail from Maldives was also being investigated. Material on record indicates that investigation was also underway to find out about other associates of the accused," HC noted.
