Marketing assistant claims trial to flashing, sexually abusing stepdaughters

(Pexels pic) PETALING JAYA : A 27-year-old cosmetics marketing assistant claimed trial today to flashing and sexually abusing his two stepdaughters. The accused, who was not named to protect the identity of his stepdaughters and is divorced, pleaded not guilty to three charges in the Alor Gajah sessions court before judge Aiza Khairuddin, Harian Metro reported. On the first two charges, he is accused of committing physical sexual abuse against the girls in their home in Alor Gajah between May 11 and July 5, in a bedroom and a bathroom. He is also accused of exposing his genitals to the children in the kitchen during the same period. The first two offences fall under Section 14(a) of the Sexual Offences Against Children Act 2017, which carries a maximum 20-year jail term and whipping upon conviction. The third offence is under Section 15(a)(i) of the same Act for non-physical sexual abuse. If found guilty, he faces up to 10 years in prison, a fine of up to RM20,000, or both. Deputy public prosecutor Ali Hussain proposed bail at RM20,000 for all charges, with one surety, and conditions that the accused report to the nearest police station once a month and avoid contact with the victims and prosecution witnesses. Defence lawyer Anif Rafih asked for bail to be reduced to RM12,000, saying his client earns RM2,000 monthly and has to support his two-year-old biological son, who is under the care of his mother in Pendang, Kedah. 'My client has no objection to the added conditions and promises not to disturb the victims,' he said. The court allowed bail at RM15,000 with one surety and imposed the prosecution's requested conditions. Case mention has been scheduled for Aug 25.

He was charged under Section 14(a) of the Sexual Offences Against Children Act (SOACA) 2017, which provides for a maximum 20-year jail term and whipping upon conviction. The accused also faces another charge under Section 15(a)(i) of the same Act for non-physical abuse by exposing his genitals to the two victims in the kitchen of the same house on the same dates. If found guilty, this section carries a maximum jail term of 10 years or a fine of up to RM20,000, or both. Deputy public prosecutor Muhamad Ali Hussain appeared for the prosecution, while the accused was represented by Mohd Anif Rafih. The prosecution proposed bail at RM20,000 for all charges with one surety, along with conditions that the accused must report to the nearest police station once a month during the first week and refrain from contacting prosecution witnesses, including the victims. However, Mohd Anif requested that bail be set at RM12,000, citing his client's low income of RM2,000 a month as an online marketing assistant for cosmetic products. "The accused is also financially supporting both victims and his biological child, aged two, who is currently under the care of his mother in Pendang, Kedah. "My client has no objection to the additional bail conditions and promises not to disturb the victims," he said. The court then set bail at RM15,000 with one surety and imposed the additional conditions sought by the prosecution. Mention has been fixed for Aug 25.

Melaka couple claims trial to neglecting baby boy
ALOR GAJAH: A married couple has claimed trial at the Sessions Court here to a charge of neglecting their two-month-old son, causing him to be injured. The accused, both 22, entered the plea after the charges were read out before judge Aiza Khairuddin on Tuesday (May 13). The housewife and factory operator, as the legal guardians of the child, are accused of exposing him to risk in a manner likely to cause him injuries. ALSO READ: Baby in critical condition in Melaka due to abuse The offence was alleged to have taken place at a house in Taman Seri Pelangi near here between May 2 and 5. The charge was framed under Section 31(1)(a) of the Child Act 2001, read together with Section 34 of the Penal Code, which carries a maximum fine of RM50,000 or imprisonment of up to 20 years, or both, upon conviction. DPP Muhamad Ali Hussain did not offer bail, citing the seriousness of the offence committed against the child. He said this was in line with Parliament's intention when it amended Section 31(1)(a) of the Child Act 2001 in 2016 with increased penalties to reflect the severity of such offences. Lawyer Mohammed Hissham Ramdzan appealed for low bail for both accused, stating that the mother had just completed her postnatal confinement period, while her husband is a factory operator earning a monthly salary of RM1,800. Next mention was fixed for June 12. The alleged child neglect came to light when the mother brought the unconscious infant to Hospital Alor Gajah on the night of May 5, claiming he had suffered a seizure. The baby was later referred to Hospital Melaka, where a CT scan revealed bruises, cuts on the body and neck, with both old and new instances of internal bleeding in the baby's head. A police report was subsequently lodged by a specialist doctor from Hospital Melaka.
