Sexual acts on girl, 14: Factory worker charged

Kota Kinabalu: A tyre factory worker was charged in the Sessions Court here Monday with two counts of committing physical sexual offences against an underage girl in Tuaran. The 19-year-old man pleaded not guilty before Judge Amir Shah Amir Hassan to committing the offences, each framed under Section 14 (a) of the Sexual Offences against Children Act 2017. On the first count, the accused allegedly kissed and fondled the breasts of the 14-year-old girl (now 16) in the mid of June 2023, between noon and 1pm, in an entertainment outlet in Tuaran town. On the second charge, the accused was accused of kissing the same girl in February 2024, between 7pm and 8pm, in an entertainment outlet, also in Tuaran town. Each charge carries a jail term of up to 20 years and whipping, on conviction. The prosecution, in applying for a new mention date, objected to bail on the grounds that the charge was non-bailable, involved a serious offence, and there was a risk the accused might abscond or tamper with prosecution witnesses, particularly the alleged victim. The prosecution further submitted that if bail were granted, it proposed that bail be set at RM10,000 for each charge, with the following conditions: the accused would report to the police every two weeks, surrender his passport to the court, and refrain from contacting any of the prosecution's witnesses. The accused, who was not represented, requested to be released on bail, saying among others, that he is currently working as a tyre factory worker. Amir fixed July 30 for pre-trial case management and released the accused on a bail of RM4,000 in two sureties each. The court also imposed a condition to the bail requiring the accused to report to the Tuaran Police Station on the first day of every month until the disposal of the case. His passport was to be surrendered to the court, and he was prohibited from contacting or interfering with the prosecution's witnesses, particularly the alleged victim. CBT accused left without lawyer due to financial constraints
The Kota Kinabalu Court Complex. KOTA KINABALU (June 24): A defence counsel representing a lorry driver charged with committing criminal breach of trust (CBT) involving frozen products worth RM39,326, has discharged herself from the case. Sessions Court judge Amir Shah Amir Hassan recorded the lawyer's withdrawal on Tuesday following her application to discharge herself. The accused, Azlan Limin, 38, did not object to the application and informed the court that he currently lacks the financial means to appoint a new lawyer. Azlan was charged under Section 407 of the Penal Code for criminal breach of trust by a carrier, which provides for imprisonment of up to 10 years, whipping, and a possible fine upon conviction. He is accused of breaching the trust entrusted to him as a lorry driver by his employer involving 316 cartons of frozen goods on April 9 at the company premises in Papar. The prosecution has served several relevant documents to Azlan for use in the upcoming trial. The court fixed July 24 for the next pre-trial case management. Azlan's RM3,000 bail with two local sureties was extended pending the disposal of the case.

Indonesian man claims trial to rape of teen in Tuaran

Ari Ambo Tang pleaded not guilty before Sessions Court Judge Amir Shah Amir Hassan to allegedly committing the offence in a worker's quarters at Kampung Giling between 5pm and 8pm in mid-March this year. He was charged under Section 376(2)(d) of the Penal Code, which carries up to 30 years' jail and whipping upon conviction for raping a girl under 16, with or without her consent. The court fixed July 22 for pre-trial case management and released Ari on RM6,000 bail with two local sureties, ordering him to report to Tuaran police station twice a month and prohibiting contact with prosecution witnesses. Babysitter pleads not guilty to negligence causing infant's injuries
The Kota Kinabalu Court Complex. KOTA KINABALU (June 18): A babysitter pleaded not guilty in a Sessions Court here on Wednesday to a charge of negligence that allegedly caused injuries to an infant under her care. Cherries Ferreline, 21, appeared before judge Amir Shah Amir Hassan and was charged under Section 31(1)(a) of the Children Act 2001, which is punishable under Section 31(1) of the same Act. The charge carries a penalty of up to RM50,000 in fines, a maximum jail term of 20 years, or both upon conviction. According to the charge, Cherries' alleged negligence could have caused injuries to the infant's head and cheeks. The alleged incident took place in Tuaran at 5.33pm on December 17, 2024. The court fixed July 17 for pre-trial case management. In the meantime, Cherries was released on RM5,000 bail with two local sureties. She was unrepresented.

Duo charged with raping their relatives

Kota Kinabalu: Two men were charged separately with raping their own relatives in Penampang and Tuaran, last year. Both the men who appeared separately before Sessions Court Judge Amir Shah Amir Hassan, pleaded not guilty to the charges against them. Advertisement In the first case, the 34-year-old man is accused of raping his 14 years and eight-month-old cousin at a house in a village in Penampang in July 2024. The man was charged under Section 376(1) of the Penal Code which provides for a jail term of up to 20 years and whipping, on conviction. The court set July 16 for mention and the man was released on bail of RM6,000 in two local sureties with permanent address and job. Additional conditions were imposed on the man, namely to report to Penampang police station on the first day of every month until the disposal of his case, to surrender his passport, if any, to the court and not to disturb or contact any of the prosecution witnesses especially the alleged victim. Deputy Public Prosecutor (DPP) Bryan Francis appeared for the prosecution while the man was not represented. In the second case, the 24-year-old man allegedly raped his 16-year-old niece at 11pm in June 2024 at a house in a village in Tuaran. He was charged under Section 376(3) of the Penal Code which carries a jail term of between eight and 30 years and whipping of at least 10 strokes, on conviction. His case would be mentioned back on July 17 and succeeded to obtain bail of RM6,000 in two local sureties as well as to report to the nearest police station once a month.
