‘It was consensual': Court gives teacher, 40, bail over sexual relationship with 16-year-old boy

The 40-year-old female teacher of a prominent Mumbai school who was booked under the Protection of Children from Sexual Offences (POCSO) Act for engaging in sexual activity with one of her students, was granted bail on the grounds that the boy was over 16 years of age, and evidence shows there was a 'consensual relationship subsequently.' She was arrested last month after the boy's family complained to the police. In a detailed order, the special court for cases under POCSO Act noted that the accused's resignation from the school last year — during which the alleged sexual assaults took place — had diluted the 'student-teacher dynamic.' Special judge Sabina Malik also said the trial will take time to commence, so keeping the woman behind bars would not serve any purpose. The court granted the woman bail after considering that she is the mother of two minor children. 'He has a tattoo of my name' The accused has denied all the allegations, claiming the FIR was 'motivated' and filed at the insistence of the boy's mother who disapproved of their relationship. In her bail plea, she stated that the boy was emotionally attached to her and referred to her as his 'wife'. She also claimed that he had sent her affectionate messages and handwritten notes, and had a tattoo of her name on his body, adding that these facts were deliberately omitted from the police complaint. The teacher also claimed that she had resigned from the school in April 2024 to distance herself from the boy and insisted that she would only meet him with his mother's permission. However, he continued to contact her, she alleged. According to the FIR, from January 2024 to February 2025, the woman had sex with the boy at various five-star hotels and also in her car. She allegedly also gave him alcohol and medication for anxiety, and used a female colleague to persuade him to meet her. She then resigned from the school last year after the boy passed Class 11. 'Made to sign document in Marathi, did not understand' In the bail order, the court noted, 'As the accused had resigned from the school, the relationship of a teacher and student no longer existed and, hence, the influence was diluted.' The court also took note of the accused's contention that the police had provided the grounds of her arrest to her in Marathi, a language she does not understand, and that she was made to sign the documents without a translation. The court recorded this as part of its reasoning while noting improper compliance with arrest procedures under the Bharatiya Nagarik Suraksha Sanhita, 2023 (BNSS). In her bail plea, the accused pointed to her responsibilities as a single mother of 11-year-old twins — one of whom suffers from a respiratory condition — as grounds for leniency. She submitted her daughter's medical records and argued that her incarceration was affecting the children's education and mental health. Opposing bail, both the prosecution and the complainant cited trauma, threats, and concerns over tampering with evidence. However, the court said these risks could be addressed through strict bail conditions. 'The potential risk to the victim, if any, could be catered to by imposing necessary terms and conditions,' the court order stated, while also warning that 'breach of any condition will amount to cancellation of bail'. The teacher was granted bail on furnishing a personal bond of ₹50,000, with one or more solvent sureties of the same amount. Additional DM Biraj Boruah issued the prohibition order on Monday, restricting drone operations within a one-kilometre radius of Assam Medical College & Hospital, Naharkatia HS School Field, CM's secretariat in Dibrugarh, and Dibrugarh University from 6 am on July 22 to 6 pm on July 24. The order, issued under Section 163 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) 2023, cites public safety and security concerns as the primary reason for the temporary restriction. "It has been brought to the notice of the undersigned that the use of UAVs, commonly known as drones, poses a potential threat to public safety, security and law and order," the order said. While the directive does not explicitly mention the CM's visit as the reason for the ban, the timing coincides with Sarma's scheduled activities across the four restricted locations. Nagpur/Amravati: Two of the three prisoners convicted in the 2006 Mumbai suburban train bombings were released from Nagpur Central Jail on Monday evening following their acquittal by the Bombay High Court earlier in the day. Another four convicted in the same case were simultaneously released from Amravati central prison. The men — Ehtesham Qutubuddin Siddiqui and Mohammad Ali Alam Sher Sheikh — spent more than 17 years behind bars. A third inmate, Naved Hussain Rashid Hussain Khan, remains in custody in connection with a separate case, jail superintendent Vaibhav Agey confirmed to TOI. The four released from a jail in Amravati, 155km off Nagpur, include Mohammad Majid Mohammad Shafi (51), Jamir Ahmad Latifur Rehman Sheikh (55), Tanveer Ahmad Mohammad Ibrahim Ansari (56) and Sohail Mehmood Sheikh (52). The High Court's acquittal of all 12 accused brought a dramatic end to one of the most closely watched terrorism trials in the country, stemming from the July 11, 2006, bombings on Mumbai's suburban train network. The attacks killed over 180 people and injured more than 800. The case drew criticism over the alleged custodial torture and lack of forensic evidence against the accused. Siddiqui and Khan were sentenced to death, while Sheikh was serving a life term. They were then flown to Mumbai on an Indigo flight from Nagpur airport. Jail authorities confirmed that under updated Supreme Court guidelines, an accused can now be released on the basis of a digitally signed judgment, eliminating the need to wait for a hard copy. "We only need approval from the High Court's local office. Warrants from the sessions court are required only in bail cases," a jail official clarified. During their incarceration, Siddiqui enrolled in a law degree course through Yashwantrao Chavan Maharashtra Open University and is now in the final semester of his LLB. Khan started a BA course but did not complete it. All three actively used the Right to Information (RTI) Act to file applications challenging prison rules, legal procedures, and lack of academic access. The high court noted in its ruling that all four accused alleged custodial torture at the hands of Mumbai ATS and later retracted their confessions in court. Each of the acquitted individuals was directed to execute a personal bond of ₹25,000 under Section 481 of Bharatiya Nagarik Suraksha Sanhita, 2023, for future court appearances in the event of an appeal by the state in the Supreme Court.

Four hockey trainers were picked up by Jajpur district police in Odisha after a minor girl alleged that they had sexually assaulted her in a lodge in the first week of July. A girl had lodged a complaint with Jajpur Town Police on Sunday evening alleging that the four trainers had invited her to a lodge for dinner on July 3 and sexually assaulted her. 'We have picked up four hockey trainers for questioning after a minor girl, a hockey player, levelled allegation of sexual assaults. We will proceed further on the case after the girl records her statement before a magistrate,' said Sarat Patra, Inspector-in-Charge at the police station. ' They [trainers] have allegedly gang-raped her in the lodge. Police have recorded a statement of the girl under Section 180 of BNSS,' said Rajiv Mohanty, special public prosecutor in the Protection of Children from Sexual Offences Act (POCSO) court. Mr. Mohanty said the girl had recorded her statement under Section 183 of Bharatiya Nagarik Suraksha Sanhita (BNSS) before a woman magistrate in POCSO court. He, however, said the girl had not undergone medical examination. Meanwhile, the district collector of Jagatsinghpur has ordered suspension of the principal and mathematics teacher of Swami Arupananda College following alleged suppression regarding sexual harassment of a minor girl in the college.
