Thunder Bay City Council changes mind on shelter village site again

Thunder Bay's proposed temporary shelter village won't be built on Miles Street East. Council approved the site — which was recommended by city administration — at its July 14 meeting. However, on Monday night, councillors voted against ratifying that decision, instead voting in support of a location next to 8th Avenue, known as the Hillyard site. "City council voted for the status quo, so at least in the south core, we're just looking at more of the same," said Coun. Brian Hamilton, who represents the McKellar Ward. The Miles Street East site is part of that ward. "Tough moment for those of us that have been listening to the experts, consulting with the organizations, and really trying to advocate for a well-balanced solution that balances the needs of ... business as well as helping people move their lives forward," Hamilton said. "Tough, emotional night here." Hamilton voted to ratify the Miles Street East site on Monday. Councillors Greg Johnsen, Kristen Oliver, Kasey Etreni, Shelby Ch'ng, and Andrew Foulds also voted in favour of ratification. Councillors Rajni Agarwal, Mark Bentz, Albert Aiello, Dominic Pasqualino, Michael Zussino, Trevor Giertuga, and Mayor Ken Boshcoff voted against. City Manager John Collin said city administration chose Miles Street East because it was the site that offered the best chance for the project to succeed. Administration has noted in the past that the site is close to services that the occupants regularly access. The village would include about 80 sleeping cabins for use by the city's unhoused population, with the goal of helping them transition to permanent housing. In addition, the Miles Street East site is ready for construction, and easy to access by emergency services. Regarding the Hillyard site, Bentz said it has some positives. "It doesn't put revitalization at risk," he said during the meeting. "It offers three times the land area compared to Miles." "It's rather isolated from residential uses." There are some challenges, however, Bentz said, including the site being located near to an active transportation corridor and an off-leash dog park. In addition, Bentz said, there is limited information available in terms of environmental concerns with the site, and it's further away from services. Hamilton had concerns about choosing a new site "on the fly." "I'm certainly not interested in spending money on a site that is not tested," he said. "It has not passed the consultation publicly, and passed the smell test of our senior leadership, and the organizations that are about to serve the people." "This is just throwing spaghetti on the wall. I'm not interested in in throwing good money after bad." Hamilton voted against the Hillyard site, as did Foulds, Johnsen, and Giertuga.

Judge denies request for new trial after State finds Red Bay daycare worker's credentials were forged

RED BAY, Ala. (WHNT) — Attorneys for a Red Bay daycare worker motioned for a new trial, saying the State introduced forged credentials as evidence. Judge Brian Hamilton has denied the motion. Payton Gann's trial for her alleged role in the death of 4-month-old Autumn Wells began Monday. She is facing a manslaughter charge. The State introduced the forged certificates into evidence during the testimony of a DHR investigator on Thursday. The investigator said Gann's DHR file showed that she completed the state-required childcare training of 21 and a half hours. According to court documents, after the close of evidence in court on June 12, the State disclosed to Gann's attorneys that the certificates showing the completion of several training courses were 'in fact, forgeries.' The prosecutors said they were unaware at the time they were brought into evidence that the certificates were forged. 'Whether or not Gann received training on the prevention of SIDS and sleepingenvironments for infants is material evidence that would aid the jury in determining herguilt,' Gann's attorney wrote. He added that the introduction of the forged evidence violates his client's rights to due process and a fair trial under the Fifth Amendment and Section I, Article 6 of the Alabama Constitution. In August 2022, Gann filed a motion for discovery to request that the State provide any information, material, possible testimony, potential evidence or evidence that may be helpful to the defense. Gann's lawyers said that the information about the forged certificates was suppressed until after the close of evidence, even though it was helpful to Gann 'for impeachment of the State's witnesses.' The document continues, saying that the DHR investigator who testified on Thursday said she had gotten the forgeries as part of her investigation for the State of Alabama. She also said that the certificates were for seminars conducted by DHR as part of the policies and procedures. 'The [DHR] worker either knew or should have known the certificates were fraudulent if she had cross-referenced the certificates found in Gann's file at Tiny Tigers with the state system,' Gann's attorneys added. In response, the State noted the 'overwhelming evidence of the Defendant's guilt… inclusive of, but not exclusive to, evidence of numerous false statements given to laypersons as well as investigators.' The prosecutors also spoke with the Autumn Wells' family, who said they did not wish to endure the retrial. Prosecutors stated in the court document that they deny that any evidence was 'suppressed,' saying that the State and DHR were both unaware that the certificates were forgeries. The efforts to prove whether they were forged or not began on June 12 after it was suggested they were fake. The State contacted the vendor that provided the online training. Late Thursday afternoon, after testimony for the day had concluded and jurors had been dismissed, the vendor reached out to prosecutors to tell them that the 'certificates could possibly have been forged by the daycare owner.' Following that, the State said they had a conference call with the Defendant's counsel and the Court to inform them of what the vendor said. Meet the 2025 candidates in the Thunder Bay—Superior North riding

The Thunder Bay—Superior North riding includes the north side of Thunder Bay, as well as a number of municipalities along the north shore of Lake Superior including Marathon, Schreiber, Terrace Bay and Nipigon. It also includes the vast Greenstone municipality. The riding boundaries also include several First Nations communities, such as Ginoogaming, Aroland, Long Lake 58 and Kiashke Zaaging Anishinaabek. Thunder Bay—Superior North covers an area of about 93,000 square kilometres, and as of the 2016 Census, had a population of just over 70,000. The candidates in alphabetical order by surname are as follows: Rick Dumas, PC Rick Dumas is the long-serving mayor of Marathon, Ont. He was acclaimed for his fifth term in 2022. He also runs the Thunder Bay District Municipal League. Dumas has served as a vice-president with the Northwestern Ontario Municipal Association (NOMA) and a board member with the Association of Municipalities of Ontario (AMO). Brian Hamilton, Liberal While Brian Hamilton is a first-time provincial election candidate, he has previous experience in municipal politics. He was elected as a Thunder Bay city councillor for McKellar Ward in 2018. He is currently in his second term. Hamilton has also owned several businesses in the city and is the president of the Bay & Algoma Business Association. John Northey, Green John Northey was previously the Green Party candidate for Thunder Bay—Atikokan in the 2014 and 2018 provincial elections. Lise Vaugeois, NDP Current incumbent Lise Vaugeois was elected in 2022. Vaugeois previously ran in 2018, but finished second to Liberal Michael Gravelle who had held the seat since he was first elected in 1995.
