'I will be applying for bail in the future,' she said, adding that she would notify the gardai in advance.
Judge Finan granted free legal aid at the request of the defence after hearing the accused was 'not a man of means' and was in receipt of disability allowance. Ms Frayne handed a statement of her client's financial means in to court.
Judge Finan asked if the accused wished to make his next court appearance by video link but Ms Frayne asked if it could be 'in person, if that's alright.'
The judge also recommended the accused should receive appropriate medical care while in custody.
Mr Rostas, wearing a black and grey North Face jacket, light grey tracksuit bottoms and black and white runners, was assisted by a Romanian interpreter and the court heard he had 'very limited English.'
He was not required to address the court during the brief hearing and has not yet entered a plea to the charge, which is under Section 4 of the Non Fatal Offences Against the Person Act.
He was remanded in custody to appear in Cloverhill District Court on July 3.
Gardai have said Mircea Rostas was struck by a car as he stood on a footpath on Monday night.
Emergency services were alerted to reports of a road traffic collision and found him seriously injured on the ground.
He was treated by paramedics at the scene, but died a short time later.
Gardaí have appealed for witnesses and any dashcam footage. They also asked people not to share a graphic video showing the immediate aftermath of the collision.
The footage, posted online, shows Mr Rostas lying motionless on the ground while a bystander attempts CPR. Family members are seen becoming distressed after arriving on the scene.

Man remanded in custody accused of sitting driving theory tests for other people
A MAN HAS been remanded in custody after being charged with conspiring to pose as driving theory test candidates in a learner permit fraud. It follows an investigation by the Garda National Economic Crime Bureau, which opened in March 2021 and targeted fraudulently obtained driving permits. Andre Contagariu, 26, with an address at Castlecurragh Park, Dublin 15, was arrested shortly before 7am this morning. The married father of two was then charged with two offences. It is alleged that between 14 September 2018 and 29 June 2021, he conspired with one or more persons to do an act that constitutes serious offences. The first was the unlawful use of a computer within the State by undergoing driver theory tests on behalf of third parties to obtain driver theory test pass certificates. According to the second conspiracy charge, he allegedly carried out deceptions over the same period 'by unlawfully undergoing driver theory tests in the names of third parties to induce the issue of driver theory test pass certificates' to make a gain or cause a loss to another by deception. Advertisement He appeared before Judge John Hughes at Dublin District Court today, where Detective Garda Barry McCormack gave evidence of arrest, charge and caution. Judge Hughes heard the man 'made no reply' when charged. Due to the offence category, the High Court must decide if Mr Contagariu can be released on bail. Defence solicitor Sandra Frayne said her client, who did not address the proceedings, was seeking legal aid and had no income. The judge heard that Mr Contagariu was not getting social welfare and was supported by his family. Noting there was no Garda objection, he agreed to grant legal aid. Judge Hughes remanded the accused in custody to appear at Cloverhill District Court for directions from the DPP on Thursday, 3 July. His trial venue was not stated; it has yet to be detailed whether the case will be dealt with at the District Court level or be sent to the Circuit Criminal Court, which has greater sentencing powers. The conspiracy allegations are under section 71 of the Theft and Fraud Act, which can, on conviction, carry a maximum 10-year sentence. A man and woman have already been jailed on connected charges.

Beauty and the Geek reality show runner-up Tamika Chesser has been charged with the murder of Julian Story. Picture: Facebook News in 90 Seconds - June 28th According to Kiya-May, Chesser had experienced a life of trauma and abuse that had 'fried her brain'. Kiya-May said 'a lot had happened' in Chesser's life since she appeared on Beauty and the Geek and 'she's become very mentally ill' over the last five years, 'This is a loss not only for Julian's family but ours too,' she added In addition to the murder charge, Chesser, who was seen walking her dogs on the street in the wake of the killing, was also charged with assaulting police. Another charge involves 'knowingly performing an act or omission intending to result in human remains being less likely to be found for the purposes of concealing the commission of an offence relating to the human remains', court documents state. Detective Superintendent Darren Fielke, speaking with reporters on Friday afternoon, said the former reality TV star had dismembered Mr Story's body and removed his head. 'We know that after his alleged murder, Julian's body was dismembered and while I won't provide any further detail about that at this time, I can tragically say that we have not recovered the head of Julian Story,' he said. 'I can only imagine, and I want you to imagine, the grief this news is causing Julian's family. 'We have spoken with Julian's family, who are devastated by his loss and the circumstances surrounding his death.' Officers are appealing to the public for help in tracking Chesser's movements In an effort to find Mr Story's head. 'We know that Tamika did not drive a vehicle and regularly walked around the township of Port Lincoln,' Det Fielke said. A spokesperson for Mr Story's family said they were 'navigating an unimaginable loss' as they thanked police and first responders for their 'compassion and professionalism during this devastating time'. 'Your care has brought comfort amid the chaos,' the spokesperson said. 'We are also deeply grateful to our family and friends and this extraordinary community whose kindness and support have helped carry us through. 'Your prayers, presence, and quiet strength mean more than words can say.' 'He states he arrived home about 2 or 3pm and saw smoke coming from Unit 3,' the statement reads. 'He went out the back and spoke with witness 1 or told him he had extinguished a fire in the bathroom of the unit. 'The accused had returned from her walk and was now sitting in the communal garden of the units at the rear of unit 3. 'Witness 1 called emergency services and Ambulance staff were first to arrive.' The police entered the unit bathroom and sighted the 'severely burned and disfigured' remains of Mr Story, the documents also state. 'Police exited the premises and requested more resources. 'The accused was seated in a garden chair in the rear yard adjacent to Unit 3 in a catatonic and unresponsive state at this time. Chesser was the runner-up on the 2010 season of Beauty and the Geek and later modelled for men's magazines including Playboy, Ralph and FHM. The identities of Ms Chesser, 34, and Mr Story, 39, were initially suppressed in a court order as investigators processed what they referred to as a 'complex' crime scene. After Chesser appeared in court via a video link from James Nash House, a mental health facility on Friday, Magistrate Ben Sale lifted the suppression, allowing Ms Chesser's image and name to be made public. She has been refused bail and a committal hearing has been scheduled for December.
