Karnataka HC declines to quash proceedings against man in ‘suicide abetment' case following live-in partner's death

The Karnataka High Court has declined to quash proceedings against a man in connection with the alleged abetment of his live-in partner's suicide, observing that the facts of the case had to come out in a trial. The order was passed on Wednesday by a bench consisting of Justice M Nagaprasanna after the accused approached the high court to quash the proceedings against him under the Indian Penal code and sections of the Information Technology Act. 'The nuances and textures of this tragic narrative must be unfolded in a full-blown trial,' the court stated, adding, 'It cannot be forgotten that a young life has been extinguished in a manner that raises grave concern.' The accused and his partner had been in a relationship for three years and the man had allegedly promised to marry the woman. However, the woman died by suicide in December 2023, following which her father filed a complaint against her partner. The counsel for the accused argued that the statements referred to in the complaint, such as 'go and die' or 'do whatever you want', could not alone be considered as abetment to suicide. He also argued that the deceased had been suffering from depression due to loss in investments and health issues. The opposing counsel stated that the investment losses faced by the accused and the deceased were beside the matter, and alleged that the accused had blackmailed her for money from time to time using her nude photographs which were in his possession. He also pointed out that the Forensic Science Lab had retrieved the images from the accused's phone, stating that a sum of Rs 51 lakh had been extorted. The court stated that this was a matter that had to come out in the trial. It said, 'It is the submission of the learned Additional State Public Prosecutor that the petitioner has blackmailed or threatened the deceased to part with close to Rs 50 lakh through credit card or otherwise for his business or business of both…' '(It) is a matter of trial as laptop and mobile phone of the petitioner is full of pictures and videos between the deceased and the petitioner, all taken during the live-in relationship of the petitioner with the deceased,' it added. Refusing to quash the criminal proceedings, the court stated, ' …the contents of the phones, the FSL report and the testimonies recorded, do not allow this Court to step into the shoes of the trial Court. The plea that this is a case of mere scorned affection or a casual taunt cannot be countenanced when placed against the backdrop of deliberate humiliation and alleged extortion.'

Patna: A 24-year-old woman, Khushi Raj, was found dead under mysterious circumstances at her in-laws' place at Gurhatta under Khajekalan police station area of Patna City on Monday morning. Tired of too many ads? go ad free now Her father, Mahesh Kumar, said his daughter was married to Harsh Kumar Yadav, an office attendant in the Vidhan Sabha, in Feb 2023. After marriage, Khushi gave birth to a son, who is now one-and-a-half-year-old. He alleged that ever since the marriage, Harsh was constantly demanding money. "A few days ago, he demanded Rs 5 lakh. When he did not get the money, he strangled Khushi," he alleged. Considering the seriousness of the case, the police took Harsh into custody for questioning. The Forensic Science Lab (FSL) team was also called to the spot to collect evidence. The body was sent to the NMCH for postmortem. According to the police, the real cause of death will be known after the arrival of the medical report. SHO of Khajekalan police station, Prabhat Ranjan Saxena, said the Dial-112 team received information about the death of a woman at Gurhatta around 3am, following which the police team immediately reached the spot. "Her in-laws alleged that Khushi died by suicide. There is some injury mark around her neck. The police are further investigating the matter. Her husband has been taken into custody on the complaint of the victim's family," he said.

New Delhi: A court acquitted two women of charges of cruelty and causing dowry death, observing that they proved that they were falsely implicated in the case. A case was registered by one Meena, who alleged that her daughter Sushmita alias Sonam was tortured by mother-in-law Rekha and sister-in-law Kanchan for dowry, pushing her to kill herself on July 22, 2022. Badarpur police station registered a case under IPC sections 498A (cruelty by a husband or his relatives towards a married woman) and 304B (dowry death). The court of additional sessions judge Sheetal Chaudhary Pradhan on June 2 said Meena did not depose against the accused persons in terms of the complaint that they demanded dowry, following which she was declared hostile. The judge noted that the statements of the deceased's husband and father-in-law and her brother did not support the prosecution's story and their depositions were discarded as being unreliable. The court observed that the Forensic Science Lab report regarding the data retrieved from the mobile phone of the deceased showed she was in touch with one Adarsh Mishra, with whom she had shared an emotional bond. "Further, the deceased did not leave any suicide note, which could imply that she was subjected to cruelty," it added. All the other witnesses examined by the prosecution also didn't mention any incident that could mean that the deceased was subjected to any kind of dowry demand, the court said, adding that the family members' claim regarding the demand of a gold chain was vague. BENGALURU: A 14-year-old deaf-mute girl was found murdered next to the Bengaluru-Mysuru railway track at Bhadrapura in Bidadi on Monday morning. The body was in a semi-nude state and the victim's head was smashed with a blunt weapon, said the police. 'The postmortem was conducted at Rajarajeswari Hospital. The killer is yet to be arrested. The Forensic Science Lab report will throw light if there was an assault on the victim,' said R Srinivas Gowda, Ramanagara District Superintendent of Police. The victim was a ninth standard student at a residential school at Tavarekere in Magadi and had come home due to summer holidays. The girl, who stays at Hakki Pikki Colony in Manchanayakanahalli in Bidadi, had gone missing around 5 pm on Sunday. The next morning around 7 am passersby saw the body and alerted the police. The victim's mother, who was informed by the villagers, rushed near the railway track and identified that it was her daughter. She then filed a complaint with the police on Monday morning. The police suspect that the victim must have been murdered late Sunday night elsewhere and the body was thrown next to the railway track to mislead investigations. 'Even the victim's elder sister and elder brother are also verbally challenged and cannot hear. Her father has died,' a police officer said. DCM visits victim's family, gives Rs 4.25 lakh compensation 'She has a stepfather and mother. A few suspects have been taken into custody and are being questioned,' said a police officer. Deputy Chief Minister DK Shivakumar visited the family and said the government would provide justice to the family. 'The family is not suspecting anybody. Probe will be done from all angles, including that of rape. We have given Rs 4.25 lakh as compensation to the family,' the DCM told the media. G Pallavi, Chairperson of the Scheduled Castes and Scheduled Tribes Nomadic and Semi- Nomadic Development Corporation, visited the family and also held a meeting with the Ramanagara DC and Superintendent of Police. 'As per the police, the accused must be locals. The family had to be convinced to cremate the body on Wednesday,' Pallavi said.
