Ahmedabad: A new disclaimer uploaded on Gujarat Police's Citizen Portal has triggered concerns over its impact on the effectiveness and accessibility of digital policing. According to the disclaimer, no action will be taken on an online complaint if a complainant fails to physically visit the police station within three days of filing it. The clause — uploaded without any public announcement — contradicts the very principle of citizen-centric, technology-driven governance, sources said. The message on the website reads: "It is mandatory for the complainant to visit the police station for signing the complaint within three days after registering it. If the complainant does not visit the police station within three days, no action will be taken on such complaint. " It has left people and experts divided. Sources said that this move could mar the govt's vision on enhanced public convenience. In 2022, the minister of State for home, Harsh Sanghavi, while promoting the online complaint facility as a cornerstone of modern policing, had asserted that filing basic complaints like theft of a phone or car should not require physical presence at a police station. They added that it's ironical that policemen visit a passport applicant's residence for verification, but this onus falls on a complainant who has notified an offence online. There has been no explanation from the home department on norm. Advocate Jayendra Abhavekar called the new diktat unconstitutional. "Govt or police cannot fix the timeline or deadline for a complainant to lodge a complaint. If a person is unwell, elderly, or unaware of the police station, then how can his rights for filing a complaint be refused?" asked Abhavekar. Utkarsh Dave, a high court lawyer, defended police action, saying if a complainant is not present, then how would the probe proceed?

The Gujarat Police, under the guidance of DGP Vikas Sahay, launched a statewide checking campaign, and checked 7,575 medical stores, to curb the misuse and illegal sale of narcotic drugs. The campaign aimed to ensure compliance with the Narcotic Drugs and Psychotropic Substances (NDPS) Act, specifically targeting the sale of prescription-only medicines without a valid prescription, excessive storage of prohibited substances, and unauthorized sale of intoxicating substances. The drive was conducted in collaboration with the Gujarat Food and Drugs Control Administration (FDCA), said a statement from the Gujarat Home Department. The drive focused on medical stores located near educational institutions, said sources. Strict action was taken if a medical store was found to be selling drugs like Amidopyrine, Phenacetin, Nialamide, Chloramphenicol, Phenylephrine, Furazolidone, Oxyphenbutazone and Metronidazole without prescription. DGP Vikas Sahay in a video statement said, ' The drive to check the medical shops, especially the ones near schools and colleges, for illegal sale of drugs was organised following a meeting conducted by MoS Home Harsh Sanghavi on July 9. The drive was held in collaboration with the FDCA.' Over 1,600 teams checked a total of 7,575 medical stores across the state during which irregularities were found in several stores and cases were filed against them, said Sahay. He also appealed to the public to inform the police if there is any illegal activity going on in medical stores in their vicinity. 'We are eager to act on any such information. The intention isn't to harass anyone, but to fight against illegal activities,' said the DGP. A total of 235 cases were filed against 54 people by the Ahmedabad City Police after checking 880 medical stores. Of these 178 cases were filed under the Cigarettes and Other Tobacco Products Act (COTPA), 53 under the Juvenile Justice Act, two under the NDPS Act, and two for possession of e-cigarettes. A total of 333 stores were checked in Surat city, where 93 codeine syrups were seized from one medical store and 15 codeine syrups and five alprazolam bottles from another medical store, said the police. In Valsad, 282 medical stores were checked, in Patan 61, 184 in Navsari, 66 in Jamnagar, 258 places in Bharuch district and 23 in Dangs district. Checking was also carried out in 129 medical stores in Dahod district, 112 in Panchmahal district and 317 in Gandhinagar district among others.

A mobile phone purchased as a gift from a central Kolkata store by a Salt Lake-based advocate, hailing from Sakharipara in Muchipara, for his wife has become a major headache for the couple. The mobile is now at the centre of a cybercrime investigation being carried out simultaneously by Gujarat Police and Bowbazar Police. According to Kolkata Police, the phone was purchased for Rs 49,000 from a store on Mission Row Extension in Feb. The advocate said the mobile phone was in a sealed condition and even a GST bill was issued against it. Yet, a few days after his wife began using it, the Gujarat Police arrived at his doorstep, alleging that it was used to commit cybercrimes before its sale. The couple, who believed they purchased a new device, learned of the connection when officers from Rajkot police station, under Gujarat Police, matched their phone's IMEI number to one used in a criminal case. "We were shocked when Gujarat Police contacted us about a cybercrime investigation linked to our phone," said the advocate to Gujarat cops. "This is a clear case of deception," said an investigator. The case was later handed over to Bowbazar Police as the shop fell in their jurisdiction. Bowbazar Police Station, now handling the investigation, has summoned the store owners for questioning. They have also summoned the distributor. "We have gone through the records of the seller and found nothing suspicious. Hence, we have now summoned the distributor. The seller claimed he had no inkling that the phone was used earlier." The phone has been seized and sent for forensic examination to determine its history and whether the sellers were aware of its previous use. "We are investigating how an old phone was sold as new and whether there is a larger network involved in such practices," said a senior cop. The case has raised concerns about consumer protection and the need for stricter regulations in mobile phone retail. Legal experts suggest this incident could lead to enhanced scrutiny of mobile phone vendors and their sales practices. The Gujarat Police continue to investigate the original cybercrime while local authorities focus on the fraudulent sale. The case remains under investigation, with both the couple and law enforcement awaiting forensic results. TNN

The startling turn of events has now triggered a cross-state investigation into what could potentially be a racket involving the resale of criminally tainted devices as new. The incident unfolded in the Salt Lake area earlier this year, when the lawyer purchased a premium smartphone worth Rs 49,000 from a shop located in Kolkata's Mission Row Extension. The device was sealed, came with a GST invoice, and appeared brand new in every respect. Believing it to be a perfect present, he gifted it to his wife on their wedding anniversary in February. However, weeks later, officers from Rajkot Police in Gujarat arrived at the couple's residence, saying that the very phone his wife was using had been flagged in an ongoing cybercrime probe. The police had traced the phone's International Mobile Equipment Identity (IMEI) number and confirmed that it matched a device used in an online fraud. Stunned by the accusation, the couple insisted they had purchased the phone legally and had no connection to any criminal activity. Realising the severity of the matter, the lawyer promptly approached Hare Street Police Station in Kolkata and lodged a formal complaint against the mobile phone store. The case was then transferred to Bowbazar Police Station, under whose jurisdiction the shop falls. Officers there have begun questioning both the shopkeeper and the distributor who supplied the device. While initial scrutiny of the shop's documentation did not reveal any irregularities, police sources say the focus has now shifted to the distributor. The mobile phone has since been seized and sent for forensic analysis to determine its ownership history and whether it had previously been tampered with, reused, or repackaged. Investigators are also probing whether this was a one-off incident or part of a larger scam involving the resale of used or compromised mobile phones as new. This could be the tip of the iceberg, a senior police officer familiar with the case said, adding that if there was an organised racket behind this, it posed a serious threat to unsuspecting buyers.
