CHENNAI: Finding prima facie materials to establish his role in the abduction of a boy from Tiruvallur, the Madras High Court on Friday refused to grant anticipatory bail to KV Kuppam MLA and leader of Puratchi Bharatham party 'Poovai' M Jagan Moorthy. Justice G Jayachandran said the court has arrived at an irresistible conclusion that for a fair investigation and fearless trial, the petitioner needs to be secured and subjected to custodial interrogation. The teenager was allegedly abducted as his brother had married a girl outside his caste from an affluent family in Theni. 'The call details collected show that the petitioner was in touch with ADGP HM Jayaram and other persons. These materials prima facie are sufficient to hold that the petitioner is a party to the alleged conspiracy,' the judge said in the order. The matter pertains to the abduction of the teenager from his house in Tiruvalankadu police limits on June 7, 2025, by five unidentified persons in the marriage involving his brother. The kidnapped boy was later let go near the Perumbakkam bus stand. Preliminary probe brought to the fore the alleged involvement of Moorthy and HM Jayaram, an ADGP-rank IPS officer. On Friday, Additional Advocate General (AAG) J Ravindran assisted by Additional Public Prosecutor R Muniapparaj, representing the CB-CID, submitted that the investigating agency has collected electronic evidence, call records, photographs, CCTV footage and recovered Rs 7.86 lakh from the girl's father Vanaraja that point to the MLA's role in the case.

Supreme Court Orders Transfer Of Kidnapping Case Against Tamil Nadu Senior Cop

New Delhi: The Supreme Court on Thursday while hearing suspended ADGP HM Jayaram directed the Tamil Nadu government to transfer the investigation of the teenager's abduction case to CB-CID. The Supreme Court while setting aside the arrest order of the Madras High Court also directed the Chief Justice of the high court to transfer the case to some other bench. However, the suspension of the officer will continue as the Tamil Nadu government told the Supreme Court that his suspension did not come from the high court order, but from rules. Senior lawyer Siddharth Dave appearing for Tamil Nadu told the Supreme Court that he was not suspended because of the orders of the high court, but under Rule 3 of the All India Service Rules, 1969. This rule empowers a disciplinary authority to suspend a member of service in respect of whom or against whom an investigation, inquiry or trial is pending. The senior lawyer said that presently the investigation is underway and depending on the report of the investigating officer, a decision will be taken on the suspension order. The Supreme Court, taking this submission on record, said the suspended ADGP would have options to appeal against the suspension. The Supreme Court was hearing a petition filed by the suspended Assistant Director General of Police HM Jayaram, challenging his arrest in a kidnapping case. The Madras High Court ordered the arrest of Mr Jayaram and criticised Kilvaithinankuppam (SC) MLA 'Poovai' M Jagan Moorthy for "misusing his political power" in connection with the kidnapping of a teenager. The officer approached the Supreme Court saying his arrest order was passed when he was not even a party to the proceedings in the high court. In the last hearing, the Supreme Court expressed shock over the high court order and sought the Tamil Nadu government's reply in withdrawal of suspension. The matter pertains to a May 10 kidnapping of an 18-year-old man in Thiruvallur district. He was reportedly kidnapped by a group seeking information about his elder brother, who had married a woman from Theni district against her family's wishes. The Madras High Court castigated the MLA and the senior police officer for using political muscle to block a lawful investigation. The case has been filed by the mother of the kidnapped man against the group of men who allegedly entered their house in Kalambakkam, searching for her elder son. They allegedly kidnapped the younger son when his elder brother was nowhere to be found. The kidnappers allegedly posed as police officers and later dropped the man near a hotel in a vehicle belonging to Mr Jayaram, the woman said in her complaint.

The Supreme Court today set aside the Madras High Court's order that led to the arrest of Tamil Nadu Additional Director General of Police (ADGP) HM Jayaram. The top court also directed that the investigation in the kidnapping case allegedly involving him be transferred to the Crime Branch–Criminal Investigation Department (CB-CID).The apex court made the observations during the resumed hearing of Jayaram's petition challenging the June 16 High Court order, which had directed police to arrest him in connection with a minor's kidnapping case. The high court's order came while it was hearing an anticipatory bail petition by an MLA implicated in the same bench of Justices Ujjal Bhuyan and Manmohan also requested the Chief Justice of the Madras High Court to assign the bail petition and other matters connected to the kidnapping case to a different bench, noting the 'controversial circumstances' in which the high court had passed its order. In yesterday's hearing, the Supreme Court had questioned the basis of the ADGP's suspension and called the High Court's order of a ranked officer's arrest 'demoralising'.The bench also noted that there were 'other issues' with how the case had been handled and asked the state government to 'transfer the investigation to an independent authority like the CID.'The Tamil Nadu government informed the court that it would now entrust the investigation to the advocate Siddharth Dave, appearing for the state, submitted: 'We would want the suspension to continue till investigation is complete. It's according to the rule.'advertisementThe bench, however, questioned the basis of the suspension, pointing out that the state had earlier claimed Jayaram had not been arrested. 'If he was not arrested, then on what basis is he suspended? Do you have a copy of the suspension order?' the bench responded that the officer was suspended under Rule 3 of the All India Services Rules, which allows suspension when an inquiry related to a criminal charge is pending. 'As soon as it's completed, a decision will be taken for revocation of the suspension,' he added, clarifying that it was 'dehors (outside) the High Court's order.'Counsel for Jayaram argued that there was no departmental inquiry or FIR against him when the High Court passed its order. 'The High Court has acted as a police station. They arrested me and kept me in custody for 24 hours,' he said. 'I had appeared before the court as an officer of the court and appeared on court orders.'The case concerns an incident involving a runaway couple who have since gotten married. According to submissions made in court, the boy's mother filed an FIR after members of the girl's family allegedly entered their house and kidnapped the boy's younger brother. Fathers of both the girl and the boy have since withdrawn their complaints, telling the court they are 'now samdhis (becoming family through marriage).'advertisementJayaram's counsel maintained that all proceedings against him arose solely from the High Court's order. The Supreme Court observed that since the suspension was independent of the High Court's direction, Jayaram could seek remedy as per the court granted a passover to allow the state counsel to seek instructions. Following this, the state confirmed its willingness to hand over the investigation to the its order, the Supreme Court recorded the state's submission that Jayaram's suspension was not a result of the High Court's directive but in accordance with service rules, and that a decision on continuing or revoking it would be taken upon completion of the Supreme Court last heard the matter yesterday, when it sought clarification from the state on the grounds for the suspension and the counsel for Tamil Nadu told the court that the state government will entrust the investigation to the Crime Branch-Central Investigation Department (CB-CID).Senior Advocate Siddhartha Dave, who appeared for the Tamil Nadu government, however, said, 'We would want the suspension to continue till the investigation is complete. It's according to the ADGP is alleged to be involved in an abduction case of a minor, along with the MLA who had evaded arrest in the same case.

NEW DELHI: Supreme Court on Wednesday disapproved of Tamil Nadu govt's decision to suspend additional director general of police (ADGP) H M Jayaram after Madras HC ordered his arrest in an abduction case and asked it to inform the court within 24 hours "why the suspension be not withdrawn". When Jayaram's counsel Aditya K Choudhary said the IPS officer had an unblemished 28-year service record and that he was not involved in the abduction case, a partial working day bench of Justices Ujjal Bhuyan and Manmohan asked TN govt's counsel, "why have you suspended him? He is a senior police officer, and he has joined the investigation. Such suspension orders are very demoralising". TN govt counsel Misha R Mohta informed the court that Jayaram had not been arrested and was released after questioning. However, he was placed under suspension, she accepted, asking the court for time to obtain instructions from state govt on whether the suspension order, issued following the HC's directive, would be withdrawn. Jayaram has been accused of aiding and abetting the kidnapping of a 19-year-old youth, whose brother had married a woman without the approval of her family members. This order was passed during the hearing of an anticipatory bail plea filed by legislator K V Kuppam, who is also an accused in the case. The high court denied the MLA relief and ordered him to cooperate with the investigators probing the case.
