SHAH ALAM: The Selangor government is considering asset seizure as a key measure against husbands who evade court-ordered nafkah (financial support) payments. State Islamic Religious Affairs and Cultural Innovation Committee chairman Dr Mohammad Fahmi Ngah highlighted additional proposals, including income withholding and garnishment orders, to enforce compliance. Mohammad Fahmi stressed the importance of selecting the right enforcement mechanism to avoid delays and protect the rights of recipients, particularly ex-wives and children's guardians. 'Failure to choose the right channel can cause confusion and jeopardise the rights of the maintenance recipient,' he said during the State Assembly session. The state is also exploring collaborations with agencies like the National Registration Department, Inland Revenue Board, and financial institutions to trace and seize defaulters' assets. The Selangor Islamic Religious Council (MAIS), alongside legal experts, is reviewing amendments to the Islamic Family Law Enactment (Selangor State) 2003 to strengthen enforcement. - Bernama Since 2022, the Selangor State Family Support Division has received 1,189 complaints related to maintenance violations, underscoring the urgency of stricter measures.

SHAH ALAM: Seizure of assets is among the mechanisms being considered by the Selangor government against husbands who evade and default on court-ordered 'nafkah' (financial support) maintenance. State Islamic Religious Affairs and Cultural Innovation Committee chairman Dr Mohammad Fahmi Ngah (pic) said other proposed measures include income withholding orders, garnishment orders, and the sale of property belonging to defaulters. "The selection of an appropriate and efficient mechanism by the party seeking maintenance, especially the ex-wife or children's guardian, is a crucial factor in ensuring the successful enforcement of maintenance orders. "Failure to choose the right channel or mechanism can cause delays, confusion, and ultimately jeopardise the rights of the maintenance recipient," he told the State Assembly on Monday (July 7). He was responding to an oral question from Mariam Abdul Rashid (PH-Meru) on efforts by the state government to strengthen state laws and enable stricter action against those who evade maintenance payments. Mohammad Fahmi said the state government, through the Syariah Judicial Department (JAKESS), is also exploring strategic collaboration opportunities with other agencies such as the National Registration Department, the Inland Revenue Board, and financial institutions to assist in the process of tracing and seizing the assets of individuals who have defaulted on maintenance orders. "The Selangor Islamic Religious Council (MAIS), together with JAKESS, the Selangor Islamic Religious Department (JAIS), academics, and Syariah legal experts, are currently reviewing and proposing amendments to the Islamic Family Law Enactment (Selangor State) 2003 to improve provisions related to the enforcement of maintenance orders," he said. He also told the State Assembly that 1,189 complaints of maintenance violations had been received by the Selangor State Family Support Division since 2022 until May 31 this year. - Bernama

SHAH ALAM: The Petaling Syariah Lower Court has set June 4 as the next mention date in the divorce proceedings between singer Datuk Nora Ariffin and her husband, Dr Rushdi Ramli. Nora's lawyer, Sarah Mohd Ali, informed the court that the second mention is to facilitate the appointment of a Conciliation Committee (JKP), following Rushdi's refusal to grant Nora a divorce during today's hearing. "Dr Rushdi rejected the divorce application at this stage. Therefore, the court has scheduled a second mention for June 4, to initiate the JKP process," Sarah told reporters outside the Petaling Syariah Lower Court. "However, Rushdi did not specify his reasons for opposing the divorce," she added. The court will now proceed with the process outlined in Section 47 of the Islamic Family Law Enactment (Selangor) 2003. If the JKP process proves unsuccessful, the case will move forward to the hakam stage. Earlier today, Nora, whose full name is Wan Norafizah Ariffin, and Rushdi, represented by syariah lawyer Azmi Mohd Rais, made separate appearances in court for the initial mention of their divorce application. Nora filed for divorce on April 21, citing an irreconcilable breakdown of the marriage. Nora and Rushdi, a senior lecturer in the Department of Fiqh and Usul at a local university, confirmed their marriage in late 2021. Nora was previously married to composer Johan Nawawi in 1992. They had four children together. Johan Nawawi passed away on March 24, 2017, at the age of 52, due to a heart attack.
