Mumbai: While the Opposition legislators did not submit a dissent note on the Maharashtra Public Security Bill 2024, which was passed by the assembly on Thursday, NCP (SP) leader Jayant Patil told TOI that several key suggestions they had made as members of the joint select committee were orally accepted, but not implemented in the bill. Govt had re-drafted the bill based on the joint select committee of legislators' report. "We asked for certain clauses to be dropped altogether and for some changes to be made. These were orally accepted, but now I find they are not included in the bill. We are concerned that this law should not be used against the Opposition and protesters," Patil told TOI. "We did not submit a dissent note because we were assured that our suggestions would be accepted." Opposition MLAs wanted this removed because it could be applied to protesters, sources said. The bill states that govt can issue a notification in the official gazette to declare an organisation unlawful. The notification will have no effect until the advisory board, led by a former or current Bombay high court judge, confirms it. However, the bill also states that if govt is of the opinion that the organisation needs to be deemed unlawful with immediate effect, "it may direct that the notification shall, subject to any report of the advisory board that may be made, have effect from the date of its publication in the official gazette". The Opposition legislators wanted this clause dropped, as they felt it bypassed the advisory board, sources said. Although the notification has to specify the grounds on which it is issued, there is another clause that says govt is not required to disclose any fact which "it considers to be against the public interest". Opposition legislators wanted this clause dropped on the grounds of transparency. The bill allows for an organisation declared unlawful to make a representation to govt within 15 days. The Opposition wanted this to be extended to 30 days. Further, in the bill, the advisory board will comprise a chairperson, who is or was an HC judge, and two members. One of these will be a retired district judge and the other, a govt pleader appointed by state govt. The Opposition had asked for both members to be retired district judges. The bill empowers a district magistrate and police commissioner to notify any place used for the activities of an unlawful organisation and also take possession of movable property. An appeal against this has to be made to govt. The Opposition MLAs wanted a judicial magistrate for this role instead, and the appeal to go before the advisory board. The Opposition legislators on the joint select committee included Nana Patole, Vijay Wadettiwar, and Satej Patil from Congress, Jitendra Awhad and Shashikant Shinde from NCP (SP), and Ambadas Danve and Bhaskar Jadhav from Shiv Sena (UBT).

Maharashtra Revenue Minister Chandrashekhar Bawankule on Thursday presented the report of the Joint Committee on the Special Public Security Bill 2024 in the Assembly.
